<figure><img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/2022111016118/636d14a89c7e80680e0a998ajpeg.jpg" alt="" width="1500" height="1000"/><figcaption>Photos: MONIKA DEUPALA</figcaption></figure>Sakar Pudasaini, founder at <a href="https://www.karkhana.asia/" target="_blank" rel="noopener noreferrer">Karkhana</a> explores innovation, technology, education, and their social consequences in this new monthly column for Nepali Times.The recent release of the ‘<a href="https://www.washingtonpost.com/technology/2021/10/25/what-are-the-facebook-papers/" target="_blank" rel="noopener noreferrer">Facebook Papers</a>’ and public testimony by whistleblowers have drawn attention to the use of social media, specifically Facebook, as a tool of civic and <a href="https://qz.com/india/2088427/facebook-whistleblower-sophie-zhang-on-indian-democracy/" target="_blank" rel="noopener noreferrer">political</a> action.The ensuing firestorm has drawn much needed scrutiny and triggered a debate on how to regulate the social media giant. It has also made clear that the global governance of social media will deprioritise peripheral countries such as Nepal.Both technological and human resource solutions that regulate social media are unlikely to take local needs into account. Thus, it is incumbent on domestic actors to develop ‘herd immunity’ through social consensus on how they use Facebook and other social media to advance their agenda and, engage in contentious debate.Documents from Facebook whistleblowers show <a href="https://www.theverge.com/22743753/facebook-tier-list-countries-leaked-documents-content-moderation" target="_blank" rel="noopener noreferrer">that the company does not treat all countries equally</a>. Tier 0 (higher priority countries) such as the United States and India get strong content moderation that includes algorithmic monitoring and ‘war rooms’. Facebook develops technology to proactively identify misinformation, falsehood and inflammatory content in these high-priority markets.These technological tools, built to understand local languages and local patterns of social media use, are supplemented by local moderators with contextual knowledge.However, in Tier 3 countries like Nepal, Facebook appears to make no proactive effort to identify and moderate polarising content. Instead, it relies on user reporting to identify problematic content. In a Tier 0/1 country, content inciting violence could be proactively removed by algorithms or moderators. In a Tier 3 country, significant challenges would have to be overcome before such action is taken.To begin with, enough local users would have to flag the content as a problem. Then, a moderator who is unfamiliar with the local context would have to make a decision to remove the content. Even if such a scenario comes to pass, it is unlikely to happen fast enough to prevent significant harm in rapidly-evolving situations.It is therefore important that countries like Nepal develop mechanisms to fend for ourselves. The most important domestic actors that need to buy into the need for self-regulation are <a href="http://archive.nepalitimes.com/article/nation/Campaigning-in-cyberspace,864" target="_blank" rel="noopener noreferrer">political parties</a>.There are three reasons:First, disinformation, untruths and polarising propaganda are most prevalent around elections when both emotions are elevated and the stakes are high. With political power and its benefits at stake, political partisans will be more willing to cross the line from political posturing to problematic polarising messaging during these times. This is particularly relevant to Nepal, where federal and local elections are due in early 2023.<figure><img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/2022111016118/636d14ab9c7e80680e0a998bjpeg.jpg" alt="" width="1400" height="934"><figcaption> </figcaption></figure>Second, political parties have the power to <a href="https://www.nepalitimes.com/opinion/indias-new-social-media-politics/" target="_blank" rel="noopener noreferrer">amplify content</a>. Political leaders have massive followings on social media, but even more importantly, parties are nation-wide networks of people that can reshare and reinforce messaging. Recent research suggests that political influence on social media works differently from traditional advertising.In traditional advertising, messaging is carried to a large number of people by a celebrity they know and trust, which is why Nepal’s MaHa Jodi seem to be selling us everything from cement to water tanks. This is thought to drive sales by positive association with the trusted figures. Political influence on social media, however, appears to be more effective when information is (re)shared in small groups of trust, rather than by a widely followed influencer.Finally, political parties have the means and skills to craft effective messages. While it is easy to blame technology for causing the problems of disinformation, we have to remember that a human hand guides it. Political parties have skilled communicators with a deep understanding of the public's moods, desires and also prejudices.At their best, these people help advance democratic discourse by effectively representing the different streams of public sentiment in the national dialogue. However, this same skill in capturing public sentiment also allows them to construct rumours, disinformation and conspiracies that capture the public imagination and go viral.It may seem fanciful to imagine that <a href="https://www.nepalitimes.com/review/nepals-new-digital-landscape/" target="_blank" rel="noopener noreferrer">political parties</a>, especially in the heat of the battle for power, can be relied on for self-regulation. Yet, there are many examples of this in Nepal. The most obvious one is the peace process that some have poetically described as leading from the ‘bullet to the ballot box’.More encouragingly, political violence, such as ‘booth capture’, have steadily declined to the point where individual incidents are rare enough to be widely noted.This suggests that there are ways to cultivate consensus by making political forces understand the self-interest. Political violence diminishes their legitimacy to rule and increases the risk to their person and cadre. Thus, it is worth trading the momentary advantage of violence in one location to ensure advantages in the exercise of national power.Social media manipulation and polarisation through disinformation have similar, perhaps even more destructive consequences. Around the world we see what political scientists McCoy and Somer call <a href="https://www.researchgate.net/publication/328538486_Toward_a_Theory_of_Pernicious_Polarization_and_How_It_Harms_Democracies_Comparative_Evidence_and_Possible_Remedies_Forthcoming_in_a_Special_Issue_of_the_Annals_of_the_American_Academy_of_Political_and" target="_blank" rel="noopener noreferrer">pernicious polarisation</a> -- an us vs them mentality where the drive to identify with your political tribe outweighs other sociopolitical considerations, the <a href="http://healthline.com/health-news/yes-some-people-are-getting-secretly-vaccinated-for-covid-19-heres-why#What-you-can-do-to-ensure-you-get-vaccinated" target="_blank" rel="noopener noreferrer">politicisation of masking and vaccination for example</a>.Pernicious polarisation fragments social and political structures so as to make nations impossible to govern, but also creates national security risks. Highly fragmented and polarised societies are primed by their own political leaders to believe disinformation and polarising propaganda are easy targets for manipulation by international powers.It is tempting to imagine there are technological solutions to technologically enabled problems. The Facebook Papers, however, make clear that countries like Nepal must not depend on faraway technological wizards to find us solutions because we are not their priority. Technological solutions, even if they can be found, will take a long time before they can be customised for the local context. Instead, we must face Facebook ourselves.While it is not possible to prevent all attempts to infect <a href="https://www.nepalitimes.com/editorial/the-message-is-the-medium/" target="_blank" rel="noopener noreferrer">the social and political system</a> through social media manipulation, a ‘herd immunity’ that protects us from the worst of it, can be achieved by building a self-regulation consensus among key actors, chief among them political parties, with the skills and resources to mount large scale manipulation campaigns.Fortunately, this is possible in the most low tech way through face-to-face conversations over countless cups of chia and many plates of samosa.Sakar Pudasaini, Founder at Karkhana, explores innovation, technology, education, and their social consequences in Makeshift, a new monthly column in the Nepali Times. The name Makeshift gestures to the tenuous uncertain nature of new ideas and initiatives as well as their potential to drive profound change.

Face-to-face to counter Facebook

<figure><img width="1500" height="1000" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221108151124/636a67049c7e80680e0599b7jpeg.jpg" alt=""/><figcaption>Lavkant Chaudhary</figcaption></figure>As they enter Lavkant Chaudhary’s Masinya Dastoor exhibition at the Siddhartha Art Gallery, the visitors are strongly drawn to one particular work on display.  They are three canvases titled DDT depicting circles within circles in the first one. Chakra, the circle of life, but it is also a bullseye, and the tiny figures of animals and people are rendered in the style of a traditional Tharu folk art. The figures are the size of an adult mosquito, and a greyscale exterminator points directly at the centre of the target, ready to spray dichlorodiphenyltrichloroethane.The other painting are lifelike paintings of three DDT cans amidst a backdrop of insects, and the third is of a colourful cloud of butterfly silhouettes. <figure><img width="1500" height="1476" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221108151124/636a67089c7e80680e0599b8jpeg.jpg" alt=""><figcaption> </figcaption></figure>Chaudhary says the American-supported <a href="https://www.nepalitimes.com/here-now/the-mosquito-that-changed-nepals-history/" target="_blank" rel="noopener">eradication of malaria</a> from Chitwan and the Tharu homeland in the Tarai destroyed not just mosquitoes but but also the Tharu people. The paintings, he says are the “silenced histories of the Tharu community.”The Tharu were genetically immune to malaria, but once the disease was eradicated by killing mosquitos, settlers came in to clear the forests, land was bought at a pittance from Tharus unable to read the land deeds.The Masinya Dastoor is expression through art of an aboriginal people the rulers in Kathmandu treated as expendable. The works are housed in two floors with earthy acrylic on canvas paintings (pictured below), land title copies with ink superimposed, wood carvings, an art installation and video. Each artwork across these various medium connect back to the historical persecution of the Tharu people. <img width="1500" height="1573" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221108151124/636a670b9c7e80680e0599b9jpeg.jpg" alt="">Chaudhary says he used to be as ignorant about Tharu history as the rest of Nepalis, but was inspired when he began researching his community during a six-month art project initiated by Artree Nepal in Bhaktapur after the 2015 Earthquake.“All I came across were recurring stereotypical ideas about the Tharu. We were just <a href="https://www.nepalitimes.com/banner/tharu-escargots/" target="_blank" rel="noopener">water snail eaters</a>  jungle dwellers, alcohol drinkers, and an honest tribe. That was our identity,” he recalls.Sangeeta Thapa of the Siddhartha Art Gallery says some indigenous groups in Nepal were taken as bonded labourers since Lichhavi times 1,400 years ago. Later on, under the Shah and Rana dynasties when the caste hierarchy was codified into the first Mulki Ain of 1854, indigenous groups were placed under the category of paani chalne masinya matawali (touchable but enslavable alcohol drinkers) which made them expendable by the state. <figure><img width="1500" height="1000" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221108151124/636a670e9c7e80680e0599bajpeg.jpg" alt=""><figcaption> </figcaption></figure>Despite slavery being abolished in 1926, the <a href="https://archive.nepalitimes.com/article/nation/Modern-day-domestic-slaves-domestic-workers,3785" target="_blank" rel="noopener">kamaiya bonded labourer system</a> persisted until it was outlawed as late as 2004. But by then the Tharu had lost most of their land.One of Chaudhary’s art installations is of small wooden boxes hung from the ceiling, each filled with grain and a single brass bullet. Next to it, the Diary series recreates pages carved into wood from the diary of Jokhan Ratgainya, a Tharu journalist and revolutionary who was killed in June 2001. <figure><img width="1500" height="2078" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221108151124/636a67119c7e80680e0599bbjpeg.jpg" alt=""><figcaption> </figcaption></figure>In one corner, the Tamasuk series, with pen and ink drawings on Nepali paper, leads into the Dastoor series, stippling drawings of day to day activities on archival paper prints of the dastoor (legal orders).The second floor hosts large striking oil paintings that detail day to day scenes alongside violence: from the conflict years, and the Tikapur massacre of 2015. Another installation is of ghaila pots hanging inside a darkroom which projects light on the walls. On one wall, a video replays a barmasiya folk song and then shows a burning miniature village as eyewitness accounts of violence. <img width="1500" height="1000" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221108151124/636a67149c7e80680e0599bcjpeg.jpg" alt="">Chaudhary writes in a description that he has used art to fill the gaps left by Nepal’s mainstream media to communicate the atrocities: “I found strength in unearthing what has remained silent and kept silent by the Nepali media, the state, and civil society.”His art speaks volumes about displacement and resistance, easily comparable to the struggles of indigenous peoples in the subcontinent and beyond. Atrocities against Tharu expressed in art

What is not so clear is whether gender-based violence is becoming more common in this plains province, or that better educated women are now taking complaints to the police.The number of complaints of violence against women in the eight districts of Province 2 surged dramatically from 602 three years ago to 10,243 in the past year. Most of the complaints involved dowry-related violence, polygamy, physical domestic violence against women, trafficking, rape and attempted rape. There were 125 murders of women in the past three years, mostly by drunk husbands or in-laws.Read also:<a href="https://www.nepalitimes.com/opinion/using-numbers-to-fight-gender-based-violence/" target="_blank" rel="noopener"> Using numbers to fight gender-based violence</a>, Lisa HonanProvince 2 police statistics show women are more unsafe outside of homes than inside. In the past five months, 50 women who were driven out of their homes due to domestic violence sought refuge in a shelter run by the Women’s Rehabilitation Centre (WOREC) in Janakpur. “Women are unsafe everywhere, but the statistics for Province 2 look alarming,” says Gyankumar Mahato of the provincial police office. However, DIG Pradyumna Karki, chief of Province 2 police, thinks the number of crimes has increased because more people are reporting them. “Previously, people used to try and hush up crimes like rapes. But now more people are aware of the presence of the police, and we get all sorts of complaints,” Karki says. Advocate Rekha Jha agrees: “Women have tried to hide these incidents in the past but are now coming forward with their testimonies. That is the reason the numbers look higher.”Others, however, say that while there may be an increase in complaints, the number of incidents has also shot up because of new factors like the spread of social media, unregulated sale of alcohol, drugs and entrenched patriarchy in the still largely conservative region.Read also: <a href="https://archive.nepalitimes.com/regular-columns/Here-We-Go/2013-jun-21-here-we-go-gender-violence,122" target="_blank" rel="noopener">#Genderviolence</a>, Trishna Rana “The misuse of social media is contributing to violence against women,” says Rekha Dutt of the National Human Rights Council, Janakpur Office. “Weak implementation of laws further encourages criminal tendencies. When perpetrators go free because of political pressure, it raises the confidence of those who prey on women.”Yagya Prasad Acharya of the district court in Dhanusha district has a different take on the problem: “Now, men also have the right to file for divorce. In the past when only women could file for divorce, men hesitated to commit violence. Now that fear is gone.” Court records show that abuse of social media was a cause in increasing numbers of violence against women in the province. With the rise in female literacy, young women are now also more assertive, refusing to get married early, or if they do, brides are not as submissive towards in-laws as in the past.Another reason for the rise in violence against women is mismatched marriages, activists say. Poor families still try to marry their daughters into rich families by offering dowry, even by incurring large debts. Dowry-related violence against young women is still a major cause of domestic violence -- police records show that the number of incidents rose from 3,609 last year to 4,671 this year. Read also:<a href="https://www.nepalitimes.com/editorial/corrosive-conduct/" target="_blank" rel="noopener"> Corrosive Conduct</a>, EditorialIn the past three years the highest number of complaints about gender-based violence was from Bara and Parsa districts, and rape cases were most prevalent in Siraha, Saptari and Sarlahi.  Politicians at all three levels of government underline that ending violence against women and establishing gender equality is their priority. Province 2 Chief Minister Lalbabu Raut had even announced the ‘Chief Minister Educate Daughter, Save Daughter’ campaign amidst much fanfare. Padam Prasad Pokharel, information officer in the province’s cabinet office, says the campaign is mainly focused on education. “The campaign aims to end child marriage through education -- it is also working on women's safety,” he says. The province's Ministry of Social Development is imparting self-defence training to girl students of public schools, aiming to protect them from abuse, violence, and rape. “The schools wrote to us saying the program was effective, so we are continuing it this year,” Pokharel says. In the past year the ministry spent Rs11 million on self-defence training at schools, but it has taken no other initiative to reduce violence and crimes against women. 			<h2>Violence against women in Province 2</h2>		
		<ul><li>Usha Devi Das of Janakpur has been enduring torture and abuse from her in-laws for not delivering enough dowry when she got married. She complained to the police twice, but law enforcement only forced the couple to sign a pledge and sent them home. The abuse did not stop. Das complained again, but her in-laws got a stay order from the district court. </li></ul><ul><li>Rita Devi Yadav of Bhangaha of Mahottari district registered a complaint against her husband and his family at the District Police Office, Dhanusha on 4 September, accusing them of physical and mental torture and of throwing her out of the house. Yadav then started living with her parents. She accuses her father-in-law and brothers-in-law of mistreatment. Yadav's husband has gone into hiding after the complaint was filed. The couple has a 21/2 –year-old son. </li></ul><ul><li>Shyam Mahara of Shahidnagar of Dhanusha beat his pregnant wife Rinadevi until she fainted, and left her alone at the provincial hospital in Janakpur. Mahara filed a complaint against her husband 5 days later on 8 September. Her father-in-law then took her home a week later. Mahara was again admitted to the hospital this month when her baby was due. The baby was delivered with a caesarean section, but was in poor health. Her in-laws disappeared after they admitted her, leaving her with Rs1,700 in hospital charges per day. Alarming rise in violence against women

The 14-year-old was attacked with acid on her way to school. Images of a recovering Muskan went viral on social media. Messages of support poured in from strangers, celebrities visited her bedside, popular Indian actors called her on video.Muskan, which means smile, might be one of the luckier survivors. Her family supports her wish to get an education, the Nepali public has praised her for staying positive and despite her harsh scars, she remains hopeful for the future.Between 2010 and 2017, Burn Violence Survivors (BVS-Nepal), a Kathmandu-based NGO, has recorded about 40 cases of acid attacks annually. On several occasions, these attacks have led women to develop depression. Half of the suicide cases in Nepali women aged 15-49 follow burn violence.Read also: <a style="background-color: #ffffff; font-size: 15px; letter-spacing: 0.01em;" href="https://www.nepalitimes.com/from-the-nepali-press/alarming-rise-in-violence-against-women/" target="_blank" rel="noopener">Alarming rise in violence against women</a>On 25 November, as we mark the International Day for the Elimination of Violence against Women and Girls, we must remember Muskan’s plight and think about what more we can do to help end all forms of <a style="background-color: #ffffff; letter-spacing: 0.01em;" href="https://www.nepalitimes.com/editorial/corrosive-conduct/" target="_blank" rel="noopener">gender-based violence</a>.I am encouraged that the Government of Nepal has declared Nepali year 2076 as the year for ending gender-based violence. The federal government, along with provincial and local authorities, is working hard to ensure that the campaign’s messages trickle down to the local level.Gender-based violence has many different forms and varies in magnitude. To make sense of it all and support the government’s initiatives, having good data is crucial. This gives the work better direction by identifying pertinent issues and informing good decision-making, especially where resources are limited.Read also: <a href="https://www.nepalitimes.com/banner/four-fold-increase-in-reported-rape-in-10-years/" target="_blank" rel="noopener">Four-fold increase in reported rape in 10 years</a>, Sewa BhattaraiIn my short time in Nepal, I have been fortunate to engage with heads of governments at all three levels, as well as with women human rights activists and community leaders. I am convinced that the Government of Nepal has taken ending gender-based violence seriously.The UK is happy to be supporting this work in Nepal, along with several other donors, multilateral agencies and civil society actors. Our global strategic vision for gender work has five main components, all of which need to be underpinned by good data if we are to be successful in eliminating gender-based violence.Data shows us that education plays a critical role in helping reduce the instances of gender-based violence. While 49% of Nepali women who experienced gender-based violence at home were illiterate, only 13% who had higher than secondary level education had similar experiences. The UK’s Girls’ Education Challenge focuses on communities that have fallen behind in educating the girl child.Read also: <a href="https://www.nepalitimes.com/editorial/republic-of-rape/">Republic of rape</a>There is lots of room for progress, but data shows that overall, only 53% of currently married women use a method of family planning, with 10% using a traditional method. Three out of every 5 women who began using a contraceptive method in the 5 years before the survey discontinued the method within 12 months.Because there are more new stories around gender-based violence, it tends to give the impression that people’s awareness has also improved. However, data has helped us identify that we need to do more work around building awareness of violence against women and girls: 78% of Nepali women and girl survivors of gender-based violence have never sought any help, including from the police or even getting checked by a doctor. 66% of survivors remained completely silent about the violence.In Nepal, women spend more hours doing paid work and shoulder more than three times the amount of unpaid labour as their male counterparts. Despite this, women earn less money and own but a small percentage of the country’s wealth. Although Nepal has one of the highest rates of economic participation by women in Asia, most women do lower skilled, insecure jobs that pay less than men. Only 11% of women own their own piece of land, while only 8% of women own a house.Read also: <a href="http://archive.nepalitimes.com/news.php?id=15584#.XdZzKdUzbIU">The invisible</a>, Mallika AryalNepal’s new Constitution has put more women in decision-making roles than at any point in Nepal’s history. One way for these decision-makers to be effective at their roles is by being able to understand and use data to make evidence-based decisions. Our Evidence for Development program (E4D) aims to improve the quality of such data, including better data disaggregation, to provide better information to policy and decision-makers on specific groups of people, including women. It also trained civil servants to understand and use data better.Working with data helps us to continually assess our work to tackle gender-based violence, better understand the current challenges and empower women and girls to take control of their lives. This is why DFID is supporting the upcoming 16 days of activism, with a social media campaign focusing on how data can help us address gender-based violence.Publishing this data helps us work in an open and transparent manner. Using numbers to fight gender-based violence

Some design flowers in bright colours, others draw homes nestled below mountains.Many of the children are survivors of rape or domestic violence, from rural parts of Nepal. The one thing they have in common is mental trauma.For Colombian painter Dairo Vargas (pictured with students of Kitini College) who is coaching these and other Nepali children, the situation is very familiar to that of his own country. Vargas himself suffered depression as a teenager, and believes art can be a great healer in a country wracked by war.“When I was depressed, I could not focus on anything. But when I start painting, I am able to concentrate on what I am creating. Nepal signed a peace accord with the Maoists in 2006, and Colombia made peace with the FARC rebel group 10 years later, ending a conflict that killed over 220,000 people and displaced 7 million.While many victims and their families have received compensation for physical wounds or loss in Nepal, mental trauma has been largely ignored. Likewise, various studies indicate that up to 40% of the population in Colombia suffer from mental illness at some point, and lifetime prevalence may be up to 20%. There too, the Ministry of Health has recognised that the issue is under-reported and inadequately addressed.Vargas works with former FARC guerrillas and others in Colombia who suffer post-traumatic stress, but finds it hard.“Of course the guerrillas have many mental health issues, but they are not happy to do anything about it at the moment. His mission is to spread awareness about mental illness, and make painting more accessible to traumatised people through his movement #TheArtListens. He is using the technique with children at a shelter for rescued children in Godavari, where they paint, sketch and draw.As in Colombia, mental health is <a href="https://archive.nepalitimes.com/article/nation/stigma-and-silence-mental-health-nepal,3486" target="_blank" rel="noopener">still a stigma in Nepal</a>, especially for families of the disappeared, children who witnessed violence and victims of war rape.These survivors rarely seek help, even though a 2012 study showed 80% of conflict-affected people suffer anxiety and depression, 50% have <a href="http://archive.nepalitimes.com/article/nation/psychological-scars-of-maoist-conflict-on-young-survivors-take-longer-to-heal,1519" target="_blank" rel="noopener">PTSD (post-traumatic stress disorder</a>), and former child soldiers are far more likely (45-50%) to suffer from these symptoms than children never conscripted (20-37%). Social reintegration continues to be a challenge, and many former combatants and relatives suffer stigma.Suraj Koirala of TPO (Transcultural Psychosocial Organisation) has surveyed and counselled many <a href="http://archive.nepalitimes.com/news.php?id=16930#.Xa_KL-Yza70" target="_blank" rel="noopener">conflict-affected Nepalis</a>, and says the most common problems are depression, anxiety and PTSD.“Children and women have suffered the most, and it is prolonged for victims of sexual abuse and family members of the disappeared,” says Koirala.Read also: <a href="https://archive.nepalitimes.com/article/nation/Neglect-of-the-neglected,3157" target="_blank" rel="noopener">Neglect of the neglected</a>, Bibhav Acharya And Soniya HirachanOne of them is Bhagiram Chaudhary of the Conflict Victims’ Common Platform, whose brother and sister-in-law were disappeared during the conflict but who has never sought counselling or therapy.“If I see anyone who looks like my brother, I still take a second look, wondering if it is him,” he says. “We are unable to perform his last rites, because we don’t know if he is still out there. Not having closure means that we are still undecided about how to take our life forward.”Gita Rasaili of the Conflict Victims’ National Network was 13 when she saw soldiers taking away her sister. Her family later found the decomposed remains of her body. After that, Rasaili’s mother used to faint often and was unable to perform household chores. After years of therapy, she did get better.“There are many war victims like me who suffer from mental health crises, but we do not recognise it and never seek help,” says Rasaili. “If you go to a mental hospital people think you are mad. The bigger concern is that these problems could transcend generations.“If parents are unable to deal with trauma and express their mental state in unhealthy ways, their children could be impacted as well,” says Koirala of TPO. “Social reintegration is already difficult for combatants, and this could create another generation of outcasts.”As in Colombia, some victims of the conflict and <a href="https://www.nepalitimes.com/here-now/its-all-in-the-mind/" target="_blank" rel="noopener">the 2015 earthquake in Nepal</a> have found ways to express themselves through art. Rasaili keeps a journal, saying it helps her find relief from stress, and she knows others who paint and sketch. The mental scars of violence

In fact, everything about this case has been mocking the rule of law for the past 12 years.Before Nepalis could enjoy Dasain and witness C<a href="https://www.nepalitimes.com/banner/what-is-xi-jinpings-big-surprise/" target="_blank" rel="noopener">hinese President Xi Jinping’s visit</a> this month, they were shocked by the revelation of the Rajpur Farhadwa massacre, which had been covered up since 2008, and its perpetrators had gone scot free. The terrifying stories that have surfaced have shocked the nation, offering proof of the criminalisation of politics and politicisation of crime in Nepal.  Nepali Congress politician Aftab Alam is accused of burning dozens of people alive in a brick kiln. A day before the first Constituent Assembly election in 2006, several people were making improvised explosives bombs at a farm house in Rautahat, Farhadwa - 4. The house belonged to Sheikh Idris, a deceased NC politician and relative of Alam.An influential leader in Rautahat, Aftab Alam wanted to win the CA election at any cost, and decided to import Indian bomb-makers to place explosives at various election booths to scare voters and capture the booths. He had collected raw material for bomb-making, arms and ammunition from across the border.  While the explosives were being assembled, they accidentally went off at the farm house, killing three people and injuring many. Those injured were rendered unconscious with injections, and thrown into the furnace of a nearby brick kiln along with the bodies of the dead. The number of those whose bodies were disposed of that day is not known, but is said to be more than 20, including the professional bomb makers from India.Alam's apt nickname in the district is 'Tiger', and he did not want the injured to reach a hospital, and the truth to come out. The police would have taken their statements and conducted autopsies on those killed. He feared a backlash against him a day before the election, which would cost him the coveted CA seat. Instead, he resorted to an inhumane way of ‘managing’ the causalities, depriving the living of treatment and the dead of proper funeral rites.What was even more scocking was the coverup that followed in which the Nepali Congress, local police and bureaucrats appeared to be involved. The local administration seems to have assisted Alam in removing evidence of the massacre, and threatening witnesses and relatives.According to a field report by the human rights group INSEC (Informal Sector Service Centre) immediately after the crime, residents said it was the police themselves who escorted the tractor with victims to a brick kiln owned by a family member of Alam. Some of the victims were still conscious and weeping, and behind them in a car was Alam himself. Relatives and residents were terrified by what they saw. The house damaged in the blast was soon repaired, the brick kiln demolished, and all evidence destroyed.Police inspector at the time Indra Subedi was the first police officer on the scene, but was mysteriously transferred away the same night, suggesting political collusion in the coverup. Miya’s mother Ruksana Miya filed a complaint at the police station, but she was also murdered -- found dead a few days later with a bullet wound in her temple. There has been no investigation of any of the other deaths.Read also: <a href="http://archive.nepalitimes.com/news.php?id=18693#.XbFoV5IzbIU" target="_blank" rel="noopener">The lords of Impunity,</a> Kanak Mani Dixit Victims were too scared and traumatised for many years, and shuttled from one government office to another. Often, officials gave them answers like "there was lack of proper investigation", "there is insufficient evidence", and "it is not necessary to file a case". The district police office, government attorney’s office, the courts, and the attorney general’s office all seem part of the nexus to protect Alam.The Farhadwa massacre is a crime against humanity, committed by the powerful to protect their power. It was covered up for more than a decade with active collusion of politicians, police and successive governments. Alam himself was elected to the constitution-drafting assembly, benefitting from respect and government protection, while the families of those massacred lived in sorrow and were threatened by the state into submission and silence. The Nepali Congress was unwilling to accept any action against Alam when the Maoist party had the majority in the CA with the Congress in the role of opposition. As the political power play continued during the post-war transition, Alam avoided investigataion and evaded justice. A Supreme Court verdict four months ago forced the state to arrest him. On 21 June, a Supreme Court bench of judges Anilkumar Sinha and Kumar Regmi ordered the Attorney General, Police Headquarters and the District Police of Rautahat to implement earlier court verdicts and present a detailed, updated report of the case to the court within 30 days.Read also: <a href="https://www.nepalitimes.com/banner/justice-for-sale/" target="_blank" rel="noopener">Justice for Sale</a>, Tufan Neupane  <figure><img width="640" height="416" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221108141156/636a60cd9c7e80680e056e9ajpeg.jpg" alt=""><figcaption> </figcaption></figure>While this is a shocking tale of impunity and lack of the rule of law, it now sends the message that the judiciary's role is being respected. The Farhadwa massacre is a litmus test for independent legal prosecution.Combined with the arrest of <a href="https://www.nepalitimes.com/banner/the-rise-and-fall-of-comrade-mahara/" target="_blank" rel="noopener">Speaker Krishna Bahadur Mahara</a> on a charge of attempted rape, the prosecution of MPs who have resorted to violence and vandlaism in the past month show that no one can get away with crimes just because they wield power and political clout. This has restored a level of confidence in the rule of law.A lot now will depend on whether the Mahara and Alam investigations are independent and the verdicts are implemented. Alam’s emissaries are already trying to woo the relatives of the victims with money, imploring them to take back their accusations. The victims are terrified that if Alam is released, their lives will be in danger.Mahara himself is said to be reluctant to give up his Speaker's chair, and is resisting persecution, alleging a political conspiracy against him by rivals. Everyone who had a part in committing or covering up the Fardawah massacre must be brought under the purview of the law and receive maximum punishment. Justice in this case is necessary not just for the victims, but also to send a message that the rule of law is not dead in Nepal.Violence on this scale cannot be justified, it is not related to any political philosophy or the religion of the perpetrators.The Farhadwa massacre will be a milestone in turning back the tide of impunity in Nepal. The ruling NCP touts stability and prosperity as its slogans. There can be no stability without good governance, and there can be no prosperity without ordinary citizens feeling that they have the full protection of the law. Getting away with murder

Austin is a cultured man with an Ivy League degree trying to make it as a screenplay writer. Lee is a wanderer who lives in the shadows. But when they come together in a difficult situation, it seems they are not different at all: each brims with <a href="https://www.nepalitimes.com/opinion/the-roots-of-rape/" target="_blank" rel="noopener">toxic masculinity</a>.Nepal-based director <a href="http://archive.nepalitimes.com/blogs/thebrief/2016/08/23/bhagvad-gita-as-opera/" target="_blank" rel="noopener">Deborah Merola</a> has chosen to stage this Pulitzer-nominated 1980 play by American playwright Sam Shepard without translation or much adaptation. You can Google the plot, spoilers and all, but we are just going to tell you that Austin suddenly stands to lose his dreams, despite his superior education and manners. And Lee, though on the brink of gaining everything, knows he cannot make it without his brother’s refined education. And so the brothers blame each other for their plight and battle it out, with an alcoholic father and a passive mother added to the mix.Brothers envying one another is familiar to most of us: while Lee thinks that Austin — with his fancy degree and a foothold in Hollywood — is living the glamorous life, Austin thinks that Lee is a daredevil racking up new adventures every day.Read also: <a href="https://www.nepalitimes.com/review/the-violence-of-violation/" target="_blank" rel="noopener">The violence of violation</a>, Sewa BhattaraiThis intense drama simmers with an undercurrent of violence that threatens to explode. And sitting in the present, we cannot help remind ourselves of masculinity today — that however much things change, they remain the same. Lee’s desire to dominate everyone around him is an obvious example but so is Austin, whose manners are a mere veneer for what lies underneath.“This drama is relevant today in the era of Donald Trump, when toxic male machismo is on the rise,” Merola tells us after a rehearsal this week at Kausi Theatre.Perhaps because of its contemporary resonance, the drama is enjoying a revival today with a recent Broadway production starring Ethan Hawke and another starring <a href="https://www.nepalitimes.com/review/game-of-thrones-familiar-to-nepalis/" target="_blank" rel="noopener">Game of Thrones</a> protagonist Kit Harington. Set in the US 30 years ago, it is considered a quintessentially American play, but the cast here feel that it has universal resonance today.“We in Nepal think the grass is greener on the other side, and many of us go abroad with great expectations. But often what awaits is disillusionment,” says Divya Dev, who plays the younger Austin. Dreams can come crashing down any time and when that happens, Austin has nothing to hold on to, and reverts to base instincts.Read also: <a href="https://www.nepalitimes.com/banner/hop-over-the-gender-gap/" target="_blank" rel="noopener">Hop over the gender gap</a>, Reeti K.C.Alejandro Merola, who is menacing as the older Lee, feels every well-written drama has a wide resonance. “The lone alcoholic who slowly drifts out of respectable social circles and lives a criminal life on the edges is a universal character,” he says. “The play reminds us that there is an increase in such characters today.”Eelum Dixit has a powerful stage presence as the easily manipulated producer Saul who doesn’t speak up against bullies, and Kurchi Dasgupta makes an impact as the lost, possibly depressed, mother who stays indifferent even as her sons fight. Divya Dev is at his best as the melancholy Austin, who appears a gentleman but is full of passive aggression. Alejandro Merola frightens us with his outright hostility until he makes an unbelievable transformation.The drama is a stark portrayal of the unrealistic standards of success that modern society demands, and of the loss of simplicity and innocence. We see these mores manifesting now in Nepal, as well. Replaying male machismo

A hagiography is therefore an admiring book about people who are praised for being much better than they are in real life. Abiram Baburam (Non-stop Baburam) by journalist Anil Thapa fits the definition of a hagiography perfectly. It follows the tradition of heroic Panchayat-era portrayals of the Sri 5, praising them to high heaven.Thapa begins with this <a href="http://archive.nepalitimes.com/news.php?id=2690#.XTlxLfIzbIU" target="_blank" rel="noopener">brilliant PhD graduate</a> who chose the ‘hard’ life of politics while he led a Nepali students’ union in India. Baburam Bhattarai says he was inspired to enter politics after he saw Nepalis washing dishes in India, and wanted to start an armed class struggle back home for their salvation. When he returned to Nepal he adopted a mixture of Marxism and BP Koirala socialism as a means towards that end, joining various communist parties, even contesting elections, and ending up with the Maoists. Read Also: <a href="https://www.nepalitimes.com/?p=30527&amp;preview=true" target="_blank" rel="noopener">Need to remember</a>, Sewa BhattaraiAs chief ideologue he was the architect of the revolution with Pushpa Kamal Dahal and Mohan Baidya that was to rage for 10 years. After the ceasefire, and after serving as an elected prime minister (2011-2013) <a href="http://archive.nepalitimes.com/blogs/thebrief/2015/09/26/bhattarai-quits-maoist-party/" target="_blank" rel="noopener">Bhattarai set up his own Naya Shakti party</a>, which won only one seat in Parliament (his own). This year he joined former comrade Upendra Yadav to form the Nepal Socialist Party. Most of Thapa’s book dwells on the ups and downs of the Maoist party, recounting how it persecuted Bhattarai, accusing him of being an Indian agent and putting him and his wife Hisila Yami under house arrest in Rolpa for several months.Read also: <a href="https://www.nepalitimes.com/from-the-nepali-press/revolutionary-violence-or-terror/" target="_blank" rel="noopener">Revolutionary violence, or terror?</a>    The last chapter of Thapa’s book lays out Bhattarai’s blueprint for a prosperous Nepal in which he thinks a new era has dawned after the 2015 Constitution.Now 65, Bhattarai dreams of abolishing poverty and unemployment within a decade. He still does not think he has done anything wrong, and has nothing to repent. But Bhattarai does concede that he is ‘not a god’ and may have some weaknesses. It does not look like Thapa talked to any victims of Maoist violence or their families. It is also clear that neither he nor his relatives suffered from violence during the conflict. When Pushpa Kamal Dahal was elected prime minister, he was naturally not going to listen to the Adhikari couple, nor other victims of the conflict. The next PM, Madhav Kumar Nepal, was no better.Read also: <a href="https://www.nepalitimes.com/banner/when-our-son-was-killed/" target="_blank" rel="noopener">When our son was killed</a>, Gangamaya AdhikariMeanwhile, Maoist cadres kept threatening the Adhikari couple to give up their campaign for justice. Bhattarai and his wife Hisila Yami asked the couple’s landlords to expel them, Khadka writes, and after some harrowing events the Adhikaris end up at the old-age home run by social worker Dilshova Shrestha. The author recounts how Yami did not leave the Adhikaris alone even there.  Bhattarai could not have not known of the cruelty, and when he became prime minister in 2013 he had police arrest the couple from the gates of Baluwatar. On hunger strike, they were taken to Bir Hospital, where they <a href="https://www.nepalitimes.com/latest/gangamaya-breaks-fast/" target="_blank" rel="noopener">broke their fast upon government assurances</a> — promises that were repeatedly broken. The movement spawned the Biplav faction, which is now hell bent on taking the country back to war. There has been no closure for relatives of the disappeared and victims. War crimes went unpunished, and the culture of violence and impunity continues to plague Nepali society to this day.Thapa’s book does not address that side of the story, and is likelyto have little historical value. Dreams and nightmares of the Nepal conflict

This localised version is based on stories of Nepali women and is therefore much more relatable and impactful to the local audience.The meta performance starts with a group of theatre artists who are actually acting out a rehearsal of a production of Vagina Monologues. Nepali stories have been adapted to fit the original frame of the play -- Nirmala Panta tearfully speaks graphically of the moment she was violated, while a conflict-era sexual abuse victim explains how prolonged her pain has been. These stories are presented in a sensitive, and not sensationalised way, which makes viewers share the trauma themselves.As the women rehearse the pieces, they begin talking about how it relates to their own lives, and story has a desperate intensity because of the scandal rocking Nepal's own drama scene with several male directors stand accused of sexual harassment."If this guy is bugging you so much, why do you still work with him?" one character asks, while the other replies: "Then who do I work with? There isn't anyone else."In another scene, actresses urge one among them to share her story in the mainstream and social media. But then they realise that the survivor is the one who will be blamed, whose life will change dramatically, and who will have very little support to continue her acting career. The scenes in the play bring alive a world of women: how they talk to each other, how they open up gradually after one person starts a thread, how they console each other, and finally, how they often end up being silent because there are no options. But the play also depicts how things are changing by renacting the sexual harassment cases that are rocking Nepal's theatre world in real time. Actresses have accused three noted theatre directors of sexual harassment in a popular weekly tabloid, leading to much discussion and division in the world of Nepali drama. Their confessions led the theatre community temporarily banning some actors -- a significant achievement here. The fallback argument is often 'not all men', but the play gives a fitting comeback to that as well: "If I am being followed by a potentially dangerous person and I am scared, it won't help me to say not all men are like that."Directed by Akanchha Karki, the play does not create any strong characters because the cases represent the experiences of all kinds of women. Nevertheless, together the stories create an emotionally intense experience that makes viewers question and reevaluate their values. Several talented actors and actresses bring these stories to life, among whom Loonibha Tuladhar deserves special mention for her perfect timing, both in serious and comic scenes with their dark humour. The play tackles conversations among men about sexuality, abuse, and consent. It presents the viewpoint of a lot of people who think that gender inequality and abuse don't exist, because today women can go out to work, wear the clothes they want, own property, vote, and even chhaupadi has been abolished by the government."The play is based on true events, but you may not believe any of it," says one character sardonically at the end of the play. <img width="800" height="924" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/2022110811114/636a29d09c7e80680e0458e9jpeg.jpg" alt=""/>After being lampooned for extravagant, but empty, promises and criticised for having nothing concrete to show for his first year as prime minister, <a href="https://www.nepalitimes.com/banner/olis-1st-year/" target="_blank" rel="noopener">K P Oli</a> has moved quickly to address two lingering legacies of the conflict and the constitution-writing process: <a href="https://www.nepalitimes.com/opinion/only-genuine-devolution-will-douse-separatism/" target="_blank" rel="noopener">sign a deal with C K Raut</a> to get him to abandon secessionism, and outlaw the hardline <a href="https://www.nepalitimes.com/here-now/its-a-crime-not-to-call-it-terrorism/" target="_blank" rel="noopener">Netra Bikram Chand (Biplav)</a> faction of the Maoists. Despite misgivings and cynical comments on social platforms, the Oli administration has also won applause for its new assertiveness and a renewed sense of purpose. Read also: '<a href="https://www.nepalitimes.com/?p=23156&amp;preview=true" target="_blank" rel="noopener">No closure</a>'In the 11-point agreement signed with Home Minister Ram Bahadur Thapa on 24 March, Raut has committed to accept Nepal’s sovereignty and unity as well as enter the democratic mainstream. That declaration has removed the threat of ethno-separatism from plains politics, meaning that moderate Madhesi parties can now no longer fall back on Raut’s secessionist rhetoric as a bargaining chip with Kathmandu.With his Cambridge education and work in IT, Raut brings with him international exposure and perhaps a cleaner, meaner brand of politics. Anger in <a href="https://www.nepalitimes.com/banner/from-rebels-to-rulers/" target="_blank" rel="noopener">Province 2</a> runs deep, and the mistrust of K P Oli may have grown among Madhesi parties because of last Sunday’s deal. But the most vocal critic of the 11-point agreement were Oli's rivals within the NCP itself: <a href="https://www.nepalitimes.com/here-now/the-ship-of-state/" target="_blank" rel="noopener">party co-chair Pushpa Kamal Dahal</a> did not show it but was privately miffed that Oli had not kept him apprised, and Bhim Rawal’s main gripe was also that he was not consulted.However, we give Oli a thumbs up on this even if it is only for keeping the sensitive negotiations under wraps in the leaky corridors of Singha Darbar. Oli has shown that he likes to surprise people by pulling rabbits out of hats. For example, the <a href="https://archive.nepalitimes.com/article/nation/a-two-party-state,3968" target="_blank" rel="noopener">pre-electoral alliance in 2017</a> between the Maoists and the UML was also a bolt from the blue when announced.The agreement with Raut followed close on the heels of the Kailali District Court sentencing Resham Chaudhary to life imprisonment for the <a href="http://archive.nepalitimes.com/article/nation/ground-zero-in-Kailai,2538" target="_blank" rel="noopener">massacre of policemen in Tikapur</a> in August 2015, and his party the RJP-N subsequently pulling out from the governing coalition in protest. There also seems to have been some behind-the-scenes winks and nods between Baluwatar and the Supreme Court for Raut to be released from jail a day prior to the agreement.The wily Oli seems to have killed several birds with one stone with the agreement: he countered his public image of being <a href="https://www.nepalitimes.com/editorial/communist-capital/" target="_blank" rel="noopener">only talk and no walk</a>, neutralised the fallout of RJP-N leaving his government, and depending Raut’s future role, laid the groundwork for the next general election which will be won or lost in the Madhes.Read also: <a href="https://www.nepalitimes.com/here-now/its-a-crime-not-to-call-it-terrorism/" target="_blank" rel="noopener">It's a crime not to call it terrorism</a>, Kunda DixitOn Biplav, although the government split hairs by saying it was not a ban on the party, only on its criminal activities, the action essentially drives the Maoist faction underground. There could be two reasons for this: the ruling NCP wants to keep the door open for negotiations, or ex-Maoists in the ruling party used to be buddies of Biplav and just want to pretend to go after him. After all, Biplav is now using the same tactics of extortion and violence they used at the beginning of the insurgency in 1996. Even so, by publicly calling the Biplav party a “gang of looters” Prime Minsiter Oli has thrown the gauntlet.The Maoists were already semi-underground, and owned up to three bomb attacks in the capital last month that <a href="https://www.nepalitimes.com/banner/innocent-life-lost/" target="_blank" rel="noopener">killed one person</a>, and set fire to more than a dozen Ncell towers across the country. The government was challenged, and there was no other way for it to respond but warn that criminal activities will no longer be tolerated.With both the Raut deal and the warning to Biplav, the government now needs to show that it means business. A ruling party that can bring a separatist force to the negotiating table should easily be able to convince former comrades-at-arms to give up violence. While doing that, the government should also try to win the hearts and minds of the people of Province 2, expedite political devolution and remove grievances that feed extremism.As far as the Maoists are concerned, they are cashing in on disillusionment among the people with the NCP’s poor governance and corruption. The root cause of extremism is <a href="https://www.nepalitimes.com/banner/nepals-great-income-divide/" target="_blank" rel="noopener">extreme inequality</a>, and unless there are moves towards social justice, Nepal will continue to be unstable. <h2>10 years ago this week</h2> The week that the NCP government made up of ex-Maoists signed an agreement with Madhesi activist CK Raut to renounce separatism, is as good a time as any to look back at <a href="http://archive.nepalitimes.com/issue/442" target="_blank" rel="noopener">issue #442 of 13-20 March 2019</a> which dealt the beginnings of unrest in the Madhes for more autonomy. Excerpt from <a href="http://archive.nepalitimes.com/news.php?id=15746#.XJSGlCIzaUk" target="_blank" rel="noopener">Editorial</a>:‘The continuing Tarai unrest, brewing discontent among groups demanding self-determination, intractable tension within the party leading the coalition, the inability of the state to protect its citizens and improve their lives -- these are just some of the crises Prime Minister Pushpa Kamal Dahal faces. And all the time, he has to prevent the peace process from being derailed and keep to the timetable on the constitution. The job would have been difficult even if there was a consensus government, the coalition partners loved each other, the bureaucracy was clean and efficient and there was no looming global depression. Two  extremities

Born in Khandbari in eastern Nepal, Parashuram Pathak helped his family around the farm, sold what they grew in the market and lent a hand in the kitchen.&nbsp; After working as a chef in Dubai, San Francisco, Denmark, Australia, and on cruise ships, Pathak has now brought back what he has learnt to the Tusa Restaurant in Bhaktapur that opened on Nepali New Year on 13 April. Tusa uses fresh indigenous ingredients from various parts of Nepal, and fuses them with international methods to produce unique dishes. Pathak is a global Nepali, and is introducing global Nepali cuisine to his homeland. Pathak left an executive chef job to intern at three-Michelin-starred Noma in Denmark, named the best restaurant in the world five times. Noma runs on a philosophy of foraging to rediscover wild local ingredients, and Tusa’s mission is similarly noble: preparing dishes with Nepali ingredients using modern techniques and equipment. “We are taking Nepali food beyond dal-bhat and momo, we are taking it international,” Pathak said on the phone from Sydney. The three realised they shared the same dream, and over the past five years have travelled across Nepal to research their menu, collecting ingredients and ideas from homestays, food carts, and nature. The team then scouted for Nepal’s best architect, and zeroed in on Bhaktapur-based heritage conservationist Rabindra Puri who designed the Malla-era house for Tusa in the Nag Pokhari neighbourhood. Tusa can seat 28, and dining here is a sensory experience with a live kitchen. The chefs cook and place dishes on a large granite countertop with induction sections built in. Behind the counter is a grill on an indoor fire with pulley control to adjust the fire. Everything that can be made in Nepal — chairs and tables, ceramic dishes, the grill — is locally sourced. The executive kitchen/laboratory is downstairs. It is spacious, spotless, and contains appliances rarely seen in restaurants here: a sous vide machine that cooks vacuum-sealed packets at consistent temperatures, and a dehydrator for sisnu nettles. A fresh batch of deep purple kimbu (mulberry) muffins has just come out of the oven. Fridges have dry-aged fish and marigold kombucha. The restaurant serves a tasting menu with six courses, plus surprises. It starts with a fermented potato and millet roti with charred green garlic and tomato chutney. The bread tastes like a mix of alu paratha and kodoko roti with a satisfying, mild flavour. The chefs do not show off, and overdo it. Dishes are tastefully simple and faithful, a theme that runs through the meal. The second course is a filet of fish charred on one side and placed in a broth. It is delicate and smokey, and does not mask the character of the fish.&nbsp; The next is Batuk Chukauni, a Magar dish with a lentil snack and a yoghurt-based potato achar. The batuk, made of lentil batter, is light and the chukauni has potatoes and peas. Photo: VISHAD ONTA</figcaption> </figure>  Next is a skewer of jackfruit with a tamarind and mustard glaze that has the texture of a slice of sausage and melts in the mouth. Then comes the first off-menu item: a steak of watermelon, glazed and grilled, tasting sweet, sour and smokey. After that a palate cleanser sorbet made with laligurans syrup adorned with a frozen candied rhododendron petal. Finally the main course: barbeque chicken and chyakla coarse corn grits. The chicken has been brined, marinated, cooked sous-vide and seared on the grill. The delicate consistency of the chicken stands out. Desert is a smooth, creamy cheesecake that uses the local juju-dhau yoghurt. And the last course is a moist, moss-green sisnu cake laced with mulberry jam and cream.&nbsp; There is nothing gimmicky about Tusa. It is the coming together of skilled Nepalis with international exposure who have mixed what they have learnt abroad with the flavours of home.&nbsp; The tasting menu is Rs3,500, and it may take some time before Nepalis develop a predilection for some of its items. The chefs are excited, vindicated, and relieved. Coming back to Nepal, uprooting successful careers abroad to take a chance on Nepal must not have been easy.&nbsp; Tusa had a soft launch on New Year’s day with Kathmandu-based diplomats. Australian Ambassador Felicity Volk was one of them, and wrote on a Facebook post: ‘Chefs who honed their skills in Australia and returned to Nepal to give back. The return of the natives

For a year or two after the 25 April 2015 earthquake, the residents of Kathmandu were too terrified to return to their high-rise apartments. None of them collapsed in the 7.8 disaster, but many sustained serious structural damage. &nbsp;
Fast forward nine years, and they have all but forgotten that frightful day. Kathmandu is back to building substandard structures, even as land prices drive developers to build taller.&nbsp;
With no more space to spread horizontally, Kathmandu is going vertical. But structural engineers say most of the high rises do not take into account seismicity, soil condition, construction methods, quality of raw materials, fire hazard, and search and rescue in collapsed concrete structures.
“Much of our focus since the 2015 earthquake has been on building and construction, but not as much on where we are building,” warns Sangeeta Singh, Professor of Urban Planning and Deputy Director of Centre for Disaster Studies at the Institute of Engineering.

She adds: “Kathmandu is not really suited for high-rises. We have to first test the condition of the soil, but building permits are being issued without this fundamental step.”
Kathmandu Valley is a former lakebed with soft topsoil prone to liquefaction and excessive shaking, as seen during the 1934 megaquake. Many ruptures tore up the surface in 2015. &nbsp;
During an earthquake, the rock layers below Kathmandu ring like a bell and the vibrations on the surface take between 0.5 to 2 seconds for one oscillation. Buildings also vibrate, but at different frequencies depending on their height, construction material, and arrangement of their structural components.
At five floors, the vibration period of a building is 0.5 seconds, which is the same as that for Kathmandu Valley, and this could cause more damage, says structural engineer Surya Narayan Shrestha at the National Society for Earthquake Technology - Nepal (NSET).
“Building anything that is five storeys or higher in Kathmandu needs special design and structural considerations,” says Shrestha.

Technologies exist to reduce seismic risk in high-rises, and these are used in earthquake-prone cities like Tokyo, Los Angeles, Jakarta or Mexico City.&nbsp;
Base isolation, for example, separates the vibration of the land and the building, reducing damage from soil-building resonance. Base isolators move and stretch under pressure, absorbing much of an earthquake's impact by reducing swaying and shaking. &nbsp;
Seismic dampers change the pattern of vibration altogether, dissipating energy as vibrations move across a structure. But these are all expensive technologies, and none of the high-rises in Kathmandu use them.
However, Nepali engineers who can help with technology transfer are working in the field in Nepal and overseas. Kathmandu’s high-rises are already very expensive, and making them seismic-resistant would be an incremental cost.

The shape of high-rises also matters. Reinforced concrete buildings with asymmetric designs of the kind that are seen in newer structures in Kathmandu experience more torsion and shear during quakes. High-rises with regular geometry are stronger. &nbsp;&nbsp;
An even bigger concern is that of emergency evacuation and rescue in case of fire or earthquake. Kathmandu fire services do not have ladders that reach the higher floors of most new structures.
“High-rises mean more people and potentially higher casualties,” explains Shrestha. “We need immediate evacuation routes, fire escapes, emergency ladders, and fire trucks that can reach higher. Right now, safety features are voluntary and not mandatory.”
The street access, shelters, open spaces, and evacuation routes are integral to disaster preparedness and the safety of neighbourhoods and not just buildings. Most new high-rises in Kathmandu have narrow access roads.

Since most of the buildings that survived the 2015 disaster were reinforced concrete structures, it fed the misconception that they are safer. But Himalayan seismologists say that if the intensity and duration of the shaking had been just a little higher, many substandard concrete structures would have collapsed.&nbsp;
And that is the final gap: Nepal’s limited expertise and equipment for search and rescue inside collapsed concrete structures. Kathmandu’s high-rises need to be better prepared for the next Big One.
“Structural safety and design were at the front and the centre after the 2015 earthquake, we also revised some building codes but we are back to square one with contractor-driven construction, especially in peri-urban areas,” says Sangeeta Singh, who is also with the National Planning Commission. “We need to monitor construction as much as design.”&nbsp;
Shrestha at NSET agrees there have been improvements in building practices in the past nine years, but adds, “We have both learnt and unlearnt lessons from 2015. The awareness hasn’t yet translated into action on safety.”

The rise of high-rises

Midway along the stretch of the ancient trade route between Tibet and India lies the Kel Tol neighbourhood. The name is derived from the original Koligrām, and it is believed the Koli people, who were originally from Rāmagrām in present-day southern Nepal near the Indian border, settled here. The Koli were the maternal ancestors of none other than the Buddha. Kel Tol is famous for the Buddhist monastic complex of Kanak Chaitya Mahāvihar, featuring the majestic two-tiered gilded temple of the white god Karunāmaya.&nbsp; This elaborately decorated courtyard is a bustling centre of the Vajrayāna sect of Buddhism, practised widely by the indigenous Newā people of Kathmandu Valley. Karunāmaya, also known as Ārya Avalokiteshwor, is defined in great detail in the 1st century CE Buddhist text Sadharmapundarikā where he liberates all sentient beings from suffering. He helps rid the eight external fears metaphorically equated with their equivalent internal states of mind: lions (pride), wild elephants (ignorance), fire (anger), snakes (jealousy), floods (attachment), imprisonment (miserliness), thieves (wrong views) and cannibals (doubt).  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20240418130432_fe370cbee75003cd3eb5dccc7c3b2671630da193b0744db2aeac1bab3ff4a85c.jpg" data-media-id="editor_0" data-image-id="20240418130432_fe370cbee75003cd3eb5dccc7c3b2671630da193b0744db2aeac1bab3ff4a85c" data-rendition-name="original" width="1338" height="2000" loading="lazy" alt="Seto Machhindranath"> </figure>  In the Pancha Rakshyā Sutra, a Buddhist scripture from 200 CE, Ārya Avalokiteshwor was counted among the eight major deities. Followers of the Brāhminical god Shiva worship Ārya Avalokiteshwor as Seto Machhindranāth. For Shaivites, Machhindranāth is the Indian saint who founded the Nāth cult in the 10th century CE. He is the guru of saint Gorakhnāth. During the reign of Yakshya Malla (1428–1482 CE), a beautiful image of Ārya Avalokiteshwor was dug up by a farmer in present-day Jamal, which was then a cultivated area outside the city. The farmer, known as a Jamami (meaning the one from Jamal) took the image home for safekeeping. That night, Ārya Avalokiteshwor appeared in the farmer’s dream and told him that the proper place for him to reside is at the confluence of two rivers. The nearest confluence was at present-day Wongha (Indrachok) and the image was installed in the Kanak Chaitya Mahāvihar complex in Kel Tol near Wongha. This made it easier for city residents to pay homage to Ārya Avalokiteshwor and spread compassion. Soon, the deity came to be revered highly as Jamaleshwor, the one found in Jamal. Eventually, the name got corrupted, as happens often in Nepāl Bhāsā, to Janabahā Dyo. It stands out as the most decorated temple of its kind in Kathmandu. Today, Janabahā is a living heritage site where many ancient customs and rituals are widely practised as per Vajrayāna Buddhist tradition. Devotees throng the Janabahā Dyo shrine for daily worship and to receive Karunāmaya’s blessings. Being the compassionate one, Ārya Avalokiteshwor goes around town every year in his tall wooden chariot to allow sick and physically disabled devotees to pay homage to him from the comfort of their homes. One could say it is a door-to-door visit by the Compassionate One.&nbsp; For the pragmatic minded, the chariot festival is an annual renewal of communal harmony, validation of our ancient mathematical supremacy and demonstration of the need to keep practical skills alive, including the craft of building earthquake resilient houses.  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20240418130432_fc8b234ceca87dee4b99e897a485cef121fb953857fb61492a413fbfcc48360c.jpg" data-media-id="editor_2" data-image-id="20240418130432_fc8b234ceca87dee4b99e897a485cef121fb953857fb61492a413fbfcc48360c" data-rendition-name="original" width="2500" height="1667" loading="lazy" alt="Seto Machhindranath"> </figure>  The Janabahā Dyo chariot is pulled from Jamal, where his image was found by the farmer, through the historic heart of Kathmandu in a gala parade every year. The procession, accompanied by folk music ensembles and revellers, starts on the eighth day of the bright half of the month of Chaitra, and lasts up to a week (ending on Saturday this year). Hundreds of devotees pull the chariot along the streets as a way of expressing their gratitude to lord Karunāmaya for blessing them with compassion and well-being. Purna Ratna Vajrāchārya is an ordained priest who belongs to the clan responsible for taking care of Janabahā Dyo. He has been studying the design and architecture of the chariot for the past 40 years, and overseeing its construction for the past 15. He has learnt that the engineering principles of building the chariot are based on the mathematical system in which Buddhism is taught. For example, 365 pieces of wood are used in the chariot, each representing a day of the year. Each of the four wheels consist of 25 pieces of wood, totalling 100, representing completeness or fulfilment. The height and length of the chariot is 32 arm’s length (hāt in Sanskrit), 14.8m. The number 32 represents the maximum number of auspicious and physical qualities one could possess to be considered an outstanding human being.&nbsp; Says Vajrācharya, “Observing how the chariot is built helps one learn the fundamental pillars of the Buddha’s teachings, and find an easier path to Nirvana.” The structural design of the nearly 15m wooden chariot is not only awe-inspiring but also gravity-defying. It leverages the pliancy of the materials used in its construction -- flexible joints tied with cane soaked in water for several days. But this has been achieved year after year, despite the fact that the devotees who tug wildly at the ropes lassoed to the two front wheels, are most likely in high-spirits (pun intended). Sanjay Manandhar, a US-based technology entrepreneur, recounts how his high school physics teacher from Canada asked his students to go observe the locals build the chariots of Karunāmaya if they were interested in becoming engineers in the future.&nbsp; “That made no sense to me then, but, after all these decades, I now see clearly how the structural design of the chariot, adopted early on by our ancestors is full of earthquake-resilient properties that need to be applied in building houses in an earthquake-prone zone like Nepal,” says Manandhar. A highlight of the chariot festival is that human goddess Kumari makes an appearance at the final destination in Lagan, usually on the third day. For close to four centuries, the construction of the chariot and its operation has proven to be a phenomenal engineering feat, and the people’s faith in divinity means the tradition is alive.&nbsp; The essence of the colourful rituals and the religious beliefs of this ancient chariot festival is now all but lost. The logic, technology and practicality must be brought back to light, as they reflect the high civilisation and wisdom of our ancestors that we can leverage in modern times and into the future. &nbsp; Alok Tuladhar is a culture and heritage documentarian.

Kathmandu’s gravity-defying chariot festival

In the run-up to the third Nepal Investment Summit this weekend, there have been seminars, conferences and workshops where the discourse has revolved around the economy and the investment climate.
The consensus that Nepal needs foreign direct investments (FDI) to grow was repeated, and the familiar litany of reasons about why it has not been able to was discussed.&nbsp;
Policy advocates and regulators have understood that the lack of urgency is compounded by procedural inconsistencies, on top of the already deficient investment environment in the country.
It is a welcome change from what used to be flippantly accepting matters as given. There now seems to be a sense of urgency, with procedural inconsistencies and lack of harmonisation between various Acts and regulations openly discussed.&nbsp;
Government stakeholders also appear more willing to learn and attempt to be part of the solution. Whatever policy changes have been introduced in the past have been piecemeal and address the few rather than the entire industry. This left dual regulatory approaches aimed at similar players.&nbsp;

This time, unlike in the past two Summits, the government seems to be committed to amending 9 Acts, a positive step towards showing commitment to change. However, the deadline to do so during the winter session of Parliament is over. The option mooted has been to have it passed through ordinance, a lesser appealing step; albeit, a positive one moving forward.&nbsp;
To attract FDI in a competitive global market means that Nepal has to demonstrate that it is serious about bringing in investments with a more consultative and collaborative approach with investors. A departure from procedural to a result-oriented focus is needed.&nbsp;
To put issues in perspective, Nepal needs US$20 billion in investments to meet the UN’s Sustainable Development Goals (SDG) targets by 2030. If net-zero decarbonisation targets are to be met by 2045, another US$7 billion will be required annually.&nbsp;
Looking at our investment history and poor government capital expenditure, the gap is long and wide. In fiscal year 2022-23 Nepal booked a lamentable ~$59 million in FDI (equity). Nepal is in fact the lowest market in South Asia for FDI with 0.3% of the regional average.&nbsp;
What is it that we can do to fill the gap?&nbsp;
First, we need to move away from the notion that Nepal only needs large investments. This has proven to be a mistake, and time series data have proven that smaller investments, in aggregate, make a larger impact on economies.&nbsp;

We talk about an ‘enabling environment’ but without the right tools. We place restrictions on interest on debt ceiling (SOFR +5.5), without risk premium adjustments, we do not have an active secondary market for bond trading, nor do we have a yield curve, an integral part of the bond market, which is inhibiting us from tapping into the trillion dollar green bond market.&nbsp;
In order to attract green financing, Nepal needs to develop its bond market. Sovereign risk rating has been mooted and was expected to be operationalised before the Investment Summit.&nbsp;
However, to be rated in an adverse economic environment could further deteriorate investment potential due to a lesser-than-expected rating.&nbsp;
Hedging is another instrument that needs further research on. A commercial bank last year showcased the first risk-hedging mechanism for an investment of $8 million. This can be the beginning to expand on its modality. &nbsp;
Subordinated debt instruments have been introduced, but on a special nod basis, this now needs to be institutionalised as it is the most applicable form of investment after equity in a market that has volatile forex reserves.&nbsp;

Viability Gap Funding has been introduced by multilateral development agencies implemented in solar installations. It is a tool to incentivise the private sector to invest in projects that are not financially lucrative initially, but have potential for profitability in the long run. This needs to be scaled up and replicated in sectors like infrastructure, where returns may not be immediate.
Moving forward, to attract FDI, Nepal needs to tap into the funds that are available for the growth of small and medium enterprises (SMEs) and climate change. Alternative investments such as Private Equity Venture Capital (PEVC) have been around in a structured manner in Nepal for nearly a decade now.
These funds have blended finance components and have attracted climate funding as well. PEVC is a new asset class and can address the issues of penetrating into SME financing by incorporating environment, social and governance issues into their investment process.&nbsp;
SMEs are the backbone of any economy, PEVC comes with the ability not only to scale up the enterprise with risk capital, but with the ability to bring technical knowhow to enhance not only the enterprise but also the entrepreneur.&nbsp;

A differentiator from all other forms of financing available till date in Nepal. Blended finance is a way of de-risking investments, especially in frontier markets. Business Oxygen (BO2) is an example of blended finance with subordinated debt investments of IFC (World Bank Group) taking the lead and Climate Investment Funds along with FCDO as co-investors.&nbsp;
On a larger scale, the 216MW Upper Trisuli 1 is another example of blended finance with IFC, a Korean consortium and local investments. So far, we see that development finance Institutions have been taking the lead in Nepal as their risk appetite is greater than commercial investors and they are eager to help develop the financial markets.&nbsp;
In order to be sustainable, we need to step on this and attract commercial capital from all over the world. To do this there has to be political will to make that pivot.&nbsp;
Instead of being a means to an end, the two previous Investment Summits turned out to be intermittent and cosmetic, providing hardly any results. The third one’s success will depend on how the event will be implemented as a platform for continuous marketing for the country and facilitation for investors in future.&nbsp;
Nepal has outdone many countries in its macro-economic indicators, with sound forex reserves and a stellar history of debt payments to its creditors. This story needs to be propagated along with the drive for change to attract potential investors.
