But even when they file a complaint, it is rarely that they get justice because of loopholes in the system.Dipendra Chaudhary, 29, of Kailari was accused of raping an 11-year-old girl last year. After the girl’s family lodged a complaint against Chaudhary five days later, the police arrested him the next day.During interrogation, Chaudhary confessed to raping the minor, and based on this the court ordered him into judicial custody for further investigation. But a month later, the bench headed by Jayananda Paneru, the senior-most judge at the district court, acquitted him citing that there was not enough evidence in the charge sheet.Read also: <a href="https://www.nepalitimes.com/opinion/rape-rulings-in-nepal-follow-letter-not-spirit-of-the-law/" target="_blank" rel="noopener noreferrer">Rape rulings in Nepal follow letter, not spirit of the law</a>, Sewa BhattaraiSix months later, Paneru heard another rape related case against Dharma Rokaya, in which he was  alleged to have raped a girl in Dhangadi. The bench again ruled in favour of the defendant citing insufficient evidence.On the same day, another bench headed by Khemraj Bhatta heard six Dhangadi rape cases. Of those that received a final verdict that day, the judges ruled that one of the cases did not have sufficient claim, acquitting Akash Chaudhary and his friend who were accused of raping a girl.Another judge Baburam Baniya’s courtroom also heard four rape-related cases on the very day. In one of the two cases that received the final verdict, the judge Baniya ruled insufficient evidence.Figures from the Kailali District Court show that more than half the rape cases that were closed between 16 July-5 September 2021 had verdicts in favour of the accused. All in all, 198 <a href="https://www.nepalitimes.com/editorial/republic-of-rape/" target="_blank" rel="noopener noreferrer">rape cases</a> were registered at the Kailali District Court last year alone, of which 120 were closed, and 60% (72 cases) acquitted the alleged perpetrators.Read also: <a href="https://www.nepalitimes.com/opinion/theytoo/" target="_blank" rel="noopener noreferrer">#TheyToo</a>, Sewa BhattaraiCases related to rape are initiated and prosecuted by the government. Based on a police investigation, the public prosecutor’s office files a case in the district court on behalf of the victim. If the decision is not satisfactory, the prosecutor can appeal to the high court. According to Jagdish Shah, IT Officer at the High Court in Dipayal, the government has appealed the 72 cases from Kailali District Court.Bishwa Adhikari, Superintendent of Police in Kailali says there could be many reasons why the decisions are often given in favour of the defendant: “The delay in filing the cases makes it difficult to gather evidence, it also gives the other party more time to gather evidence in their favour.”Survivors of rape, already traumatised, are often forced by family members to keep quiet for fear of shame or reprisal. Even when they do press charges, there have been cases where the victim’s families have been pressured to step down. <a href="https://www.nepalitimes.com/opinion/the-roots-of-rape/" target="_blank" rel="noopener noreferrer">A misogynistic society</a> that often blames the victims and questions the choice of clothes and lifestyle adds to the victims hesitating to report the crime on time or at all.But when complaints are lodged late, it becomes harder to trace the physical evidence, witnesses can change their statement and even the victims may be coerced to take back their case, making it difficult to ensure a fair trial.Lawyers and activists say that the police and public prosecutors should change how they handle rape cases. Most victims choose not to pursue cases because they do not know how to work the system, and often do not have the resources to fight the case. The line of questioning by male officers is also often offensive, implying that victims were somehow responsible for the crime.“In many cases, the police refuse to register the cases which delays the process and in the meantime the evidence disappear or are destroyed,” says Chief Attorney for Far Western region Kulananda Upadhyay. “There are also lapses in the investigation and prosecution from the public prosecutor’s side. Justice eludes many rape survivors

Even though the incident occurred so long ago, it has been stuck inside me all this time—the way you feel when you swallow something you do not like the taste of and the distaste clings to your throat long after.I am about to re-tell you something I had told a local newspaper some 17 years ago.It was October. It was nearly time for Dasain-Tihar break. Before we closed, the students hung out in empty classes. We talked about bhogatey. I said grapefruits were important items for Kija puja and Mhaa puja.Katuwal, who had just finished his lecture, had lingered for a while, listening to our conversation, smiled and left after wishing us all a happy Dasain.In this all-girls’ institution at the heart of Kathmandu, teachers would sometimes hang out with students in the canteen and drink tea. They would exchange numbers in case students had questions and conduct open-air lectures on the lawn or in the canteen, and sometimes at the teacher’s home. Teachers were our deities.It was just ahead of Tihar when I received a call from Katuwal, saying he had some bhogatey for me and that I should come with a big bag to Bhatbhateni. In those days, Bhatbhateni was a place known for its temple and not a department store.I asked my mother if I should go collect the fruits. She gave me big sling bag to put the fruits in. This was a time when I still had not learned to ‘dress like a girl’. I would always wear jeans, t-shirts, sneakers and wore my hair really short. Some friends called me ‘tom boy’, an expression which I now consider a slur.As instructed, I waited outside the temple. Katuwal showed up and said I should follow him to his house to collect the fruits. Some five minutes’ walk from the temple and we were in a yard with some trees and a house. I followed him up the staircase into a room with pale yellow walls, with a small bed by the window. There was a stack of books in one corner. He offered me black tea with sugar. I still had not seen the grapefruits yet. I sat on a chair near the door.When I was done drinking my tea, I started getting fidgety. I wanted to ask him where the bhotageys were. But he was sitting on his bed reading a weekly Nepali magazine. He asked me if I liked photography. I said I liked photos. He motioned me to go over and look at what he was reading. I knelt down on the floor, looking at the photos. There were old photos of Kathmandu. But their preciseness blurs from my memory because he leaned down and put his mouth on mine as I looked at them. “Ke garnu bhako!” I shouted, pushing him away, my palms applying force on his chest. What was he doing!I stood by the chair for a few seconds, fuming. Risako? He asked me. As though anger was not the response he had hoped to elicit. I said nothing. I picked my back and left, walking all the way home. The only thing I can recall from that walk were my ears--they felt like they were on fire.My mother asked me what had happened to the fruits. I lied. I told her I could not find his house.I did not know what I should have done after that. If I reported him to the Principal, they would also ask me why I had gone to his place to begin with. It occurred to me that I could write about it.So, I wrote about it. As honestly as I could. Then I called up a reporter I had met at some poetry reading event and asked her if their newspaper would publish my experience. I also briefly told her what had happened.I remember my voice breaking as I confided in her. She was the first person I was talking to it about. This was in the time of landlines and I had to lock myself up in my parents’ room to call her up.The day my piece was published, however, I felt like my humiliation had been taken to a different level. An illustration, showing a man in a Nepali cap seated on the floor wearing a smirk, poking his girl student with a pen, had been used.The size of the illustration was generous, and so was the degree of humiliation it inflicted on me. It mocked my experience, because it made it look like a joke, completely eclipsing the gravity of my experience.I suppose, when people picture harassment or assault, they imagine serious crime scenes and not subtle events leading up to them. I suppose the mention of bhogatey made my experience sound like a joke. What kind of an idiot goes to her teacher to up grapefruit? Perhaps my experience had become just an article that filled the columns on a weekend supplement.When classes resumed, some students who had read the article said: nice story. They thought it was a fabricated tale. For me, the rest of the year was woven tightly around bunking Katuwal’s classes. Fortunately for me (or so I thought then) Katuwal received a scholarship and soon left for the US.My rage and discomfort spilled over to the newspaper reporter. I complained about how insensitively the publication had been handled. I told her the illustration had made fun of my experience instead of raising an issue. I asked if there would be a corrigendum. She said it did not qualify for one, and that it was the cartoonist I should talk to. I let it go.I hated myself for sending the article for publication. I hated myself for writing it. And I hated myself for showing up greedily for bhogatey. I felt stupid and decided it was my fault. I had gone there on my own two feet and had knelt by the bed and then gave Katuwal a chance to stick his mouth on mine. It filled me with self-loathing and I wanted to scrape the feeling off of me.It took me years to realise it was not my fault.I’ve tried to write about Katuwal many times. I try to rewrite my experience to undo the self-flagellation I put myself through. And in all of those rewrites, my humiliation stares back at me in the form of the cartoon in the newspaper.I cannot rewrite it enough to undo the sickening feeling of Katuwal’s mouth on mine. Five days into the nationwide lockdown, Nepal has not been spared.Many women now find themselves forced to be confined and isolated with domestic abusers. China, which has enforced the most prolonged quarantines so far, saw official figures for domestic violence cases triple in February. The integral idea of social distancing, which is one of the best strategies to combat the virus, direct exposes women to domestic violence. Although there may not be a big increase in number of new cases of abuse because of COVID-19, the existing cases can turn more extreme since the abuser and the victim cannot avoid anymore being in the same space by going to work or staying at a friend’s place. It becomes more difficult because victims are not able to receive proper resources and support. Health care professionals are focused on aiding the coronavirus patients and catering to the overload in hospitals, so those facing violence in the home are unable to reach out and seek medical help or therapy. Even non-profits are finding it difficult to receive the call for help as the world is engulfed in the pandemic. Non-profits will also find it difficult to fundraise and sustain themselves because of the economic recession.  COVID-19 has also brought job uncertainty for many women as the unemployment rate rises in Nepal and elsewhere. Many women, who had to struggle to get the jobs they had are now going to lose themFinding a job is much tougher for women than it is for men and many women are more vulnerable to losing these jobs, and will find it hard to get back into the workforce. Once her movement is restricted, a woman finds herself more dependent and obliged to stay in an abusive relationship to sustain her family. Abusive relationships are a form of control and power which is gained by keeping the victim in the relationship because of the children, or economic status. In Nepal, there was already a <a href="https://www.nepalitimes.com/from-the-nepali-press/alarming-rise-in-violence-against-women/" data-saferedirecturl="https://www.google.com/url?q=https://www.nepalitimes.com/from-the-nepali-press/alarming-rise-in-violence-against-women/&amp;source=gmail&amp;ust=1585386126146000&amp;usg=AFQjCNEBqzUwMOysJQ97H5b24RT5c48mig">growing epidemic of violence against women</a> before the coronavirus scare. In fact, domestic violence is the biggest source of injury for women in Nepal with half the women <a href="https://www.breakthecycle.org/blog/overview-domestic-violence-nepal" data-saferedirecturl="https://www.google.com/url?q=https://www.breakthecycle.org/blog/overview-domestic-violence-nepal&amp;source=gmail&amp;ust=1585386126146000&amp;usg=AFQjCNFmpRvKhU2eu6JFVYRxcOjRnaGkxQ">in a recent survey</a> saying they had experience some form of violence.In Nepal, where women have just started to become independent and entered a male-dominated workforce with jobs like driving or foreign employment, the  COVID-19 scare could take away these new opportunities and force them back into the home arena.  Nepal’s weeklong nationwide lockdown that is to end on 31 March is likely to be extended by at least another two weeks. It is therefore vital for victims of domestic abuse to seek help now when the systems have not been overwhelmed. Public health experts say there are more infected people than the three diagnosed in Nepal so far, and the number may well increase in the coming week forcing officials to enforce the lockdown even more strictly.This could increase the number of domestic violence cases as well. There are 24/7 helplines like the Khabar Garaun 1145 and online support networks, but more are needed in the provinces. <a href="https://saathi.org.np/" data-saferedirecturl="https://www.google.com/url?q=https://saathi.org.np/&amp;source=gmail&amp;ust=1585386126146000&amp;usg=AFQjCNHKTMiRYijL7nTbKZEhICrQKqKDuA">online support networks</a>. Organisations like <a href="https://ruwonnepal.org.np/" data-saferedirecturl="https://www.google.com/url?q=https://ruwonnepal.org.np/&amp;source=gmail&amp;ust=1585386126146000&amp;usg=AFQjCNGxDVylTYw9ZxlR8AMxfo-kk9EsZg">RUWON (Rural Women’s Network Nepal)</a> need support. But perhaps the most immediate help can be from people who can support and check up on neighbours. If there is a known case of domestic violence in the neighborhood, the witness is advised to visit the family and provide support by talking, or giving information about the helplines. Lockdown and the surge in domestic violence

Mahara had been in Dilli Bazar Jail during the investigation and court proceedings since 3 November 2019. The state prosecutor office had used evidence provided by Police and asked for a seven year sentence on the charge of attempted rape.However, even though the court had asked for a polygraph test and DNA report on Mahara the police had been unable to provide them after <a href="https://www.nepalitimes.com/banner/the-rise-and-fall-of-comrade-mahara/" target="_blank" rel="noopener">the former Speaker</a> refused to comply. She complained verbally to the police at 8:45pm that Mahara had tried to rape her and beat her. added that he had beaten her up when she resisted. <figure><img width="1500" height="1000" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109101136/636b74e69c7e80680e0623bbjpeg.jpg" alt=""><figcaption>Photo: RSS</figcaption></figure>Maharajganj police DSP Durga Raj Regmi arrived at the alleged victim’s room at 9:10, shot a video of the room, and asked the woman to accompany him for a medical exam. She refused, saying she would first wait for her husband to return.DSP Regmi returned to the alleged crime scene the next morning and retrieved a half-finished bottle of alcohol, a glass, and snacks. He also found a broken pair of glasses and the sole of a shoe. But there is evidence that she called the Nepali Congress MP Uma Regmi at 11pm to help her.The police report adds that Mahara’s bodyguard and driver said they had waited below the woman’s room while Mahara went up. Mahara himself denied ever going up, even though police presented a CCTV clip showing him leaving the room at 8:32:45pm that night. Mahara also refuted claims that he had a bottle of whiskey with him, and said he only drank red wine on doctor’s advice.  Police said that the grade on the spectacles retrieved from the room matched that of Mahara’s prescription.   Police presented an SMS message from Mahara to the woman which said: ‘Forget about yesterday. Forgive me.’ The medical report of the woman also detailed evidence of beatings. In a curious turn of events, the woman herself said she was “very happy” about the verdict and thanked the district court. In a phone interview with Himal Khabarpatrika on Monday, she said: “I am happy because Mahara Sir suffered an injustice, and so did I. I have been denying the incident since that day itself, but everyone including the media and police out pressure on me. Today we got justice.”She also accused the police of detaining her for nine hours and forcing her to file the complaint. She added: “It looks like our society talks about women’s rights, but perpetrated injustices against women.”Meanwhile, the deputy state prosecutor Num Raj Khanal said: “We think we have enough evidence against Mahara. WE are going to appeal this case.”Mahara has been released from jail, and can now assume his MP position the House, and avail himself of all his perks and salaries. However, if the higher court declares him guilty he could lose that post again.

Since my father was poor, I did not get to go to school. So I followed a relative to Kathmandu from Nuwakot, and started washing dishes at a restaurant in the city. After about a year, my aunt came to see me, and told me she would educate me back in the village. Happy, I followed her.Since I have motion sickness, my aunt gave me some medicines on the bus and I fell asleep. In the middle of a jungle, in a remote location with only a couple of small tea shops, I was woken up to eat. The next time I woke up, I found out I was in Delhi. I was 14 years old. When I tried to follow her, a Nepali woman called Laxmi Tamang beat me up. I was kept under lock and key, but one day when I got a severe headache they took me to a hospital where they put me on medication for two days and jabbed me with injections.That made me feel very hungry all the time, and I started eating a lot. For a month, they gave me whatever I wanted to eat. Later, I learnt that those medicines and injections were meant to spur my growth and make me appear more curvaceous and feminine.Hema then sent me to Brothel Number 511 at Kashmiri Building in New Delhi with Laxmi Tamang. There, a manager called Simran told me to go with a man. When I balked, Laxmi again beat me up. Eventually, they sent three customers to be with me on the very first day.After that I had to take up to seven men every night. Later, it sometimes went up to 25 clients a day. Sometimes I did not get to sleep all night. And if someone lingered too long, I was the one yelled at.After about two years, everyone from Kashmiri Building was transferred to Brothel 64 so that the girls would appear to be ‘new’ to a different set of customers. Thus, they took us from one brothel to  another for seven years.When I was in Brothel 64, I fell seriously ill. I had stomach ache and fever for days. But they gave me no medical attention, and did not take me to hospital. Every month when I menstruated, I bled a lot and it was very painful. But I did not get to rest. Often, I wished I was dead, or that someone would come and kill me.Once, a truck driver from Gorkha called Arjun came to me. Then he started coming every month. When I was sick, he would secretly bring me medicines. Since I was an old employee by then, I was allowed to use a mobile. I used to talk to him secretly. I begged him to take me away from there.Arjun asked me to elope with him, but it was not so easy with CCTV cameras everywhere. Sometimes us old employees were allowed to go out. One day, when I was sick, I called Arjun and he took me away. He cooked for me and got me medical treatment as well.One day, a friend named Puja came to see me and said she was going home to Surkhet. Last year, I joined her and came to Surkhet to celebrate Tij. Arjun had told me that after I returned from Surkhet, he would marry me and we would go to Nepal. On the way back from Surkhet, he came to receive me in Nepalganj.When the <a href="https://maitinepal.org/" target="_blank" rel="noopener">Maiti Nepal</a> people at Nepalgunj border asked me about myself, I could not lie. The police even brought Arjun over for questioning. They kept me at Maiti Nepal, but they let him go when they learnt the truth. I did not know where he went.When I was in India, I never thought I would come back home alive. But seven years later, I celebrated Dasain at home. I have begun taking informal classes called School for Life. But my mind does not grasp what I am reading. I keep getting stomach aches, my blood pressure is high. Images of the brothel and the terrifying experiences there flash in my mind, making me cry.I think of Arjun a lot. Maybe he would not have married me, but had he not rescued me I would still be in Brothel 64 in Delhi.  With help from Maiti Nepal I have now filed a case against the uncle and aunt who sold me. The police have arrested them. But now I am scared they will be set free. I hope they do not come out of jail to torment me again.  As told to Laxmi Basnet

Trafficked Nepali woman’s testimony

The 14-year-old was attacked with acid on her way to school. Images of a recovering Muskan went viral on social media. Messages of support poured in from strangers, celebrities visited her bedside, popular Indian actors called her on video.Muskan, which means smile, might be one of the luckier survivors. Her family supports her wish to get an education, the Nepali public has praised her for staying positive and despite her harsh scars, she remains hopeful for the future.Between 2010 and 2017, Burn Violence Survivors (BVS-Nepal), a Kathmandu-based NGO, has recorded about 40 cases of acid attacks annually. On several occasions, these attacks have led women to develop depression. Half of the suicide cases in Nepali women aged 15-49 follow burn violence.Read also: <a style="background-color: #ffffff; font-size: 15px; letter-spacing: 0.01em;" href="https://www.nepalitimes.com/from-the-nepali-press/alarming-rise-in-violence-against-women/" target="_blank" rel="noopener">Alarming rise in violence against women</a>On 25 November, as we mark the International Day for the Elimination of Violence against Women and Girls, we must remember Muskan’s plight and think about what more we can do to help end all forms of <a style="background-color: #ffffff; letter-spacing: 0.01em;" href="https://www.nepalitimes.com/editorial/corrosive-conduct/" target="_blank" rel="noopener">gender-based violence</a>.I am encouraged that the Government of Nepal has declared Nepali year 2076 as the year for ending gender-based violence. The federal government, along with provincial and local authorities, is working hard to ensure that the campaign’s messages trickle down to the local level.Gender-based violence has many different forms and varies in magnitude. To make sense of it all and support the government’s initiatives, having good data is crucial. I am convinced that the Government of Nepal has taken ending gender-based violence seriously.The UK is happy to be supporting this work in Nepal, along with several other donors, multilateral agencies and civil society actors. Our global strategic vision for gender work has five main components, all of which need to be underpinned by good data if we are to be successful in eliminating gender-based violence.Data shows us that education plays a critical role in helping reduce the instances of gender-based violence. While 49% of Nepali women who experienced gender-based violence at home were illiterate, only 13% who had higher than secondary level education had similar experiences. The UK’s Girls’ Education Challenge focuses on communities that have fallen behind in educating the girl child.Read also: <a href="https://www.nepalitimes.com/editorial/republic-of-rape/">Republic of rape</a>There is lots of room for progress, but data shows that overall, only 53% of currently married women use a method of family planning, with 10% using a traditional method. Three out of every 5 women who began using a contraceptive method in the 5 years before the survey discontinued the method within 12 months.Because there are more new stories around gender-based violence, it tends to give the impression that people’s awareness has also improved. However, data has helped us identify that we need to do more work around building awareness of violence against women and girls: 78% of Nepali women and girl survivors of gender-based violence have never sought any help, including from the police or even getting checked by a doctor. 66% of survivors remained completely silent about the violence.In Nepal, women spend more hours doing paid work and shoulder more than three times the amount of unpaid labour as their male counterparts. Despite this, women earn less money and own but a small percentage of the country’s wealth. Although Nepal has one of the highest rates of economic participation by women in Asia, most women do lower skilled, insecure jobs that pay less than men. Only 11% of women own their own piece of land, while only 8% of women own a house.Read also: <a href="http://archive.nepalitimes.com/news.php?id=15584#.XdZzKdUzbIU">The invisible</a>, Mallika AryalNepal’s new Constitution has put more women in decision-making roles than at any point in Nepal’s history. One way for these decision-makers to be effective at their roles is by being able to understand and use data to make evidence-based decisions. Our Evidence for Development program (E4D) aims to improve the quality of such data, including better data disaggregation, to provide better information to policy and decision-makers on specific groups of people, including women. It also trained civil servants to understand and use data better.Working with data helps us to continually assess our work to tackle gender-based violence, better understand the current challenges and empower women and girls to take control of their lives. This is why DFID is supporting the upcoming 16 days of activism, with a social media campaign focusing on how data can help us address gender-based violence.Publishing this data helps us work in an open and transparent manner. Using numbers to fight gender-based violence

The one thing they have in common is mental trauma.For Colombian painter Dairo Vargas (pictured with students of Kitini College) who is coaching these and other Nepali children, the situation is very familiar to that of his own country. Vargas himself suffered depression as a teenager, and believes art can be a great healer in a country wracked by war.“When I was depressed, I could not focus on anything. But when I start painting, I am able to concentrate on what I am creating. That gives me a sense of calm, and slowly helped me overcome depression,” says Vargas, who now helps others like him around the world.Read also: <a href="https://www.nepalitimes.com/review/365-is-not-just-a-number/" target="_blank" rel="noopener">365 is not just a number</a>, Sewa BhattaraiNepal and Colombia share the common <a href="https://www.nepalitimes.com/here-now/its-all-in-the-mind/" target="_blank" rel="noopener">burden of war trauma</a> — people in both countries today struggle with the violence of their past, and seek closure. Nepal signed a peace accord with the Maoists in 2006, and Colombia made peace with the FARC rebel group 10 years later, ending a conflict that killed over 220,000 people and displaced 7 million.While many victims and their families have received compensation for physical wounds or loss in Nepal, mental trauma has been largely ignored. Likewise, various studies indicate that up to 40% of the population in Colombia suffer from mental illness at some point, and lifetime prevalence may be up to 20%. There too, the Ministry of Health has recognised that the issue is under-reported and inadequately addressed.Vargas works with former FARC guerrillas and others in Colombia who suffer post-traumatic stress, but finds it hard.“Of course the guerrillas have many mental health issues, but they are not happy to do anything about it at the moment. His mission is to spread awareness about mental illness, and make painting more accessible to traumatised people through his movement #TheArtListens. He is using the technique with children at a shelter for rescued children in Godavari, where they paint, sketch and draw.As in Colombia, mental health is <a href="https://archive.nepalitimes.com/article/nation/stigma-and-silence-mental-health-nepal,3486" target="_blank" rel="noopener">still a stigma in Nepal</a>, especially for families of the disappeared, children who witnessed violence and victims of war rape.These survivors rarely seek help, even though a 2012 study showed 80% of conflict-affected people suffer anxiety and depression, 50% have <a href="http://archive.nepalitimes.com/article/nation/psychological-scars-of-maoist-conflict-on-young-survivors-take-longer-to-heal,1519" target="_blank" rel="noopener">PTSD (post-traumatic stress disorder</a>), and former child soldiers are far more likely (45-50%) to suffer from these symptoms than children never conscripted (20-37%). Social reintegration continues to be a challenge, and many former combatants and relatives suffer stigma.Suraj Koirala of TPO (Transcultural Psychosocial Organisation) has surveyed and counselled many <a href="http://archive.nepalitimes.com/news.php?id=16930#.Xa_KL-Yza70" target="_blank" rel="noopener">conflict-affected Nepalis</a>, and says the most common problems are depression, anxiety and PTSD.“Children and women have suffered the most, and it is prolonged for victims of sexual abuse and family members of the disappeared,” says Koirala.Read also: <a href="https://archive.nepalitimes.com/article/nation/Neglect-of-the-neglected,3157" target="_blank" rel="noopener">Neglect of the neglected</a>, Bibhav Acharya And Soniya HirachanOne of them is Bhagiram Chaudhary of the Conflict Victims’ Common Platform, whose brother and sister-in-law were disappeared during the conflict but who has never sought counselling or therapy.“If I see anyone who looks like my brother, I still take a second look, wondering if it is him,” he says. “We are unable to perform his last rites, because we don’t know if he is still out there. Not having closure means that we are still undecided about how to take our life forward.”Gita Rasaili of the Conflict Victims’ National Network was 13 when she saw soldiers taking away her sister. Her family later found the decomposed remains of her body. After that, Rasaili’s mother used to faint often and was unable to perform household chores. After years of therapy, she did get better.“There are many war victims like me who suffer from mental health crises, but we do not recognise it and never seek help,” says Rasaili. “If you go to a mental hospital people think you are mad. The bigger concern is that these problems could transcend generations.“If parents are unable to deal with trauma and express their mental state in unhealthy ways, their children could be impacted as well,” says Koirala of TPO. “Social reintegration is already difficult for combatants, and this could create another generation of outcasts.”As in Colombia, some victims of the conflict and <a href="https://www.nepalitimes.com/here-now/its-all-in-the-mind/" target="_blank" rel="noopener">the 2015 earthquake in Nepal</a> have found ways to express themselves through art. Rasaili keeps a journal, saying it helps her find relief from stress, and she knows others who paint and sketch. But they all found these outlets through personal effort — there is no systematic approach to artistic therapy in Nepal. <img width="750" height="563" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/2022110815110/636a61009c7e80680e056eabjpeg.jpg" alt="">Says Vargas: “Traumatised people often cannot express their suffering to other people, and art is a space where they can free themselves. The mental scars of violence

He was whisked away to the district government attorney's office at Babarmahal.Mahara <a href="https://www.nepalitimes.com/latest/mahara-arrested/">is accused of attempted rape</a> of a female colleague in Parliament, Roshani Shahi, on 29 September. When the news hit headlines, and the ruling Nepal Communist Party (NCP) reacted with uncharacteristic decisiveness, advising Mahara to resign. For watchdogs who have been criticising the government for impunity, including in war crimes and last year's highly publicised case of <a href="https://www.nepalitimes.com/opinion/justice-delayed-and-denied/">Nirmala Panta,</a> this came as a complete surprise.Was the government finally buckling under national and international pressure to clean up its track record on impunity? Was Mahara the last straw? Could the party be reacting to sagging public support?Read Also: <a style="background-color: #ffffff; letter-spacing: 0.01em;" href="https://www.nepalitimes.com/latest/mahara-arrested/">Mahara arrested,</a> Nepali TimesSenior politicians have been falling like nine pins. This week it was the turn of MP Mohammad Aftab Alam from Rautahat, accused of burning a dozen people alive in a brick kiln after they were injured while making explosives to be used in the first Constituent Assembly elections in 2012. With unprecedented swiftness, police on Tuesday arrested another MP, Pramod Sah from Sarlahi, after he was accused of vandalising an airline counter and roughing up airline staff in Janakpur. There is also an arrest warrant out for Parbat Gurung, MP from Dolakha accused of attempted murder.Initially, Mahara's response fit the pattern of powerful men who know they can get away with any crime. His press adviser said he had never gone to Shahi's apartment, but after CCTV footage emerged of him arriving on the street outside, Mahara agreed to cooperate with the investigation. When his health reportedly worsened in custody, he was taken to an expensive private hospital.Mahara’s first resignation letter was conditional: he said he was stepping down only for the duration of the investigation, hoping to get right back to his speaker job. In fact, that is still a possibility since he has not resigned as member of parliament.“An MP is suspended if accused of grave crimes, so Mahara is not receiving any government facilities or salary at the moment,” explains Rojnath Pande, spokesperson of the Parliament secretariat. "However, he is not dismissed from his position. NCP Spokesperson Narayan Kaji Shrestha told Nepali Times: “His resignation automatically includes resigning from the party. We had advised him to resign as MP as well, but since he is suspended at the moment the point is moot. We cannot say anything now about his eventual return to politics.”Shrestha claims Mahara’s resignation was meant to aid the investigation and not necessarily because of his guilt, and that he is innocent until proven guilty. However, top NCP leaders have been briefed by police that there is enough evidence against Mahara to make the rape claim credible. The party is therefore in damage-control mode.Even a year ago, the NCP might have tried to hush up the case, especially because the evidence is murky. Shahi has changed her statement many times, calling police to say she was raped, withdrawing the complaint, then filing a first information report (FIR) for attempted rape, and again accusing the police of pressurising her. There are screenshots of Shahi’s SMS conversation with a mysterious ‘M Sir’, which hint at long-standing intimacy.Journalists have dug up Facebook posts showing Shahi has known Mahara for decades, and implying that he has been abusing her, and that she may even have carried his child once. However, the account has now been deactivated.Shahi has been subjected to the same kind of backlash that #metoo accusers have faced: a section of the public thinks she had a consensual relationship with Mahara and outed him when he ceased to serve her purposes. Use of force is rare but manipulation, including threats, bribes, shame and humiliation, are common. If Shahi faced threats and shame during a supposedly consensual relationship, it is difficult to see where the consent ends and abuse begins.Shahi herself has complicated her case by her on-off accusation, but more people in Nepal now seem aware that even if the relationship is consensual, violence or non-consensual intimacy makes it abusive. Many believe Shahi was intimidated into changing her statements. Yet for a government famous for impunity, the very fact that a powerful politician is being investigated is a step forward for gender justice.But there are also many losers. Mental health was made an easy scapegoat after Shahi blamed depression and medication for her inconsistent statements. The reputation of women leaders, including MPs, has taken a hit since most of them have remained conspicuously silent. Chitra Jung Shahi later posted a handwritten statement of separation on Facebook.While the case is tangled, it has certainly shaken Nepal’s powerful men, many of whom have, until now, behaved as if they are above the law. The pressure for justice in this case is increasing. On 3 October, 15 human rights organisations issued a joint statement, urging the government to treat Mahara as an ordinary citizen and investigate the case. The UN and embassies of five countries in Nepal issued another joint statement, urging Nepal to establish a ‘zero-tolerance message to combat gender-based violence’.The NCP appears to be trying to turn the Mahara case into proof that it abides by the rule of law, and deflect attention away from larger cases of impunity for war crimes.Read Also: <a href="https://www.nepalitimes.com/editorial/a-klepto-republic/">Klepto Republic</a>, Editorial

The rise and fall of Comrade Mahara

<img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221108141152/636a5f6b9c7e80680e056e2ajpeg.jpg" alt="" width="1029" height="493"/>The on-again, off-again saga of the <a href="https://www.nepalitimes.com/editorial/dasain-once-more/" target="_blank" rel="noopener">rape allegation against the Speaker of Nepal’s Parliament</a> took on a new twist after the victim lodged a formal complaint with the Police on Friday, a move that could have far-reaching political consequences.The complaint at Baneswor Police Station now paves the way for Speaker Krishna Bahadur Mahara to be formally arrested for the alleged rape on the night of 29 September in the rented room of a member of the Parliament staff with whom he is said to have close relations.That night the victim called Police, senior female member of the ruling Nepal Communist Party (NCP) as well as reporters saying she had been roughed up and raped. After the news broke, Prime Minister K P Oli and NCP co-chair Pushpa Kamal Dahal met hurriedly and advised Mahara to resign from his post as Speaker.He did tender his resignation, but said it was ‘until the investigation is complete’, and he also did not resign from his parliamentary seat. Although the Police inspected the room and collected evidence last Sunday, it did not ask the victim to carry out a medical test with fluid samples to confirm rape. Police did not arrest Mahara saying no formal complaint had been filed, and did not provide the victim with any security.However, the next day, the alleged victim withdrew her accusation, contradicting her earlier statement saying Mahara never came to her room. Her posts on Facebook accused the opposition of trying to smear ‘Mahara Sir’. There was widespread speculation that the 40-year-old victim had either been threatened or paid to withdraw the complaint.But in a dramatic about turn on Friday, she filed a formal complaint -– six days after the alleged incident. The ball is now in the Police’s court, and ultimately it will be a test of the political leadership of the NCP if it will allow Mahara to be taken into custody and allow the Police to take the investigation forward without interference.With Dasain having started, there could be excuses for delays, but legal experts say that holidays should not stop Police from taking Mahara into custody. If convicted, Mahara can face up to ten years in jail. According to Nepal’s criminal law, <a href="https://www.nepalitimes.com/editorial/republic-of-rape/" target="_blank" rel="noopener">rape</a> of someone above 18 carries a jail sentence of 7-10 years for the perpetrator, and the sentence is half that if it is attempted rape.Mahara, 61, has been a committed communist and in politics for the past four decades, starting out as a member of the radical Mashal group and was elected to Parliament from Rolpa at age 32. When a faction of the Communist Party launched an armed struggle, he joined Pushpa Kamal Dahal and Baburam Bhattarai as a senior leader.Known for being close to Dahal, Mahara was dragged into controversy in 2009 after a recording of a phone call he made with a Chinese contact asking for Rs500 million to buy MPs. No investigation was launched, and Mahara was never punished.He played an important role in peace talks to end the war, and served as Finance Minister and Home Minister in successive Maoist-led governments after 2008. As Communication Minister he was once more tied to a scam related to telecom contracts, and even Maoist cadre accused him of siphoning off money meant for ex-guerrillas in Maoist cantonments. Again, there was no probe, and it was well established that he had Dahal’s protection.This time, it looks like Dahal and other comrades cannot save Mahara. Public outrage was already growing over <a href="https://www.nepalitimes.com/editorial/four-year-itch/" target="_blank" rel="noopener">non-performance </a>and <a href="https://www.nepalitimes.com/editorial/a-klepto-republic/" target="_blank" rel="noopener">corruption</a> in the NCP government. The government has been ridiculed in social media for <a href="https://www.nepalitimes.com/opinion/justice-delayed-and-denied/" target="_blank" rel="noopener">not being able to resolve the rape-murder of Nirmala Panta</a> two years ago.For many the Mahara rape rape allegation is emblematic of the impunity enjoyed by senior politicians in Nepal. The NCP may have no choice this time, but to cut and cut cleanly.

Plot thickens in Nepal Speaker rape case

Her face is taut, her wrinkles deeper, but there is the fire of determination in her eyes.As protests over the crime escalated last year, Durga Devi’s estranged husband Yagya Raj, his second wife and their son have also joined the campaign for justice, raising some eyebrows. Yagya Raj has shown signs of  psychological instability, and Durga Devi said he nearly strangled her recently.Laxmi and Yagya Raj, ostensibly under pressure from the opposition Nepali Congress, do not want Durga Devi to accept the compensation of Rs1 million from the Central Government and Rs500,000 from Province 7. Durga Devi herself does not want to be tangled in the politics, and says the compensation money would at least help her take care of her two daughters.Laxmi and Yagya Raj say they do not want Durga Devi to take the compensation for Nirmala’s death since they do not want it to affect the fast-unto-death by Govinda KC, since one of his demands is justice for Nirmala. Women’s groups and homemakers from all class and backgrounds campaigning for the case in Dhangadi, Kailali and Mahendranagar last week shared their frustration with the police's inability to solve the crime. After her husband left her for another woman 12 years ago, the four lived in a simple house amidst fields on the outskirts of Mahendranagar in Kanchanpur.The crime has become a national issue because of Police bungling the investigation, and not being able to find the guilty. It has become the focus of country-wide protests by human rights activists, was featured in the international media and has now even got a Wikipedia entry.   “My daughter is gone, but I want justice for her, and also my remaining two daughters to have a safe and good life,” says Durga Devi with a faraway look.Nirmala Panta had joined a study group in the house of her class mate Roshani Bam after school on 26 July last year. When Nirmala did not return home, Durga Devi had become frantic, and went to Roshani’s house to look for her daughter. There is much mutual suspicion even among the activists groups and muttering about each others’ motivations. “Nirmala’s case is now so muddled that we do not know what will happen to the investigation,” says Nirmala Bagchan of the Women Human Right Defenders. Sabitri Ghimire of the Dalit Women’s Right Forum in Kailali accuses the Police of deliberately destroying all evidence to protect powerful interests.The rights groups appeared to be fatigued by infighting and frustrated by the lack of progress in the investigation. Conspiracy theories swirled about a cover-up by senior officials of the provincial government and Police officers allegedly involved in the crime. Crime and politics

Born in Khandbari in eastern Nepal, Parashuram Pathak helped his family around the farm, sold what they grew in the market and lent a hand in the kitchen.&nbsp; After working as a chef in Dubai, San Francisco, Denmark, Australia, and on cruise ships, Pathak has now brought back what he has learnt to the Tusa Restaurant in Bhaktapur that opened on Nepali New Year on 13 April. Tusa uses fresh indigenous ingredients from various parts of Nepal, and fuses them with international methods to produce unique dishes. Pathak is a global Nepali, and is introducing global Nepali cuisine to his homeland. Pathak left an executive chef job to intern at three-Michelin-starred Noma in Denmark, named the best restaurant in the world five times. Noma runs on a philosophy of foraging to rediscover wild local ingredients, and Tusa’s mission is similarly noble: preparing dishes with Nepali ingredients using modern techniques and equipment. “We are taking Nepali food beyond dal-bhat and momo, we are taking it international,” Pathak said on the phone from Sydney. The three realised they shared the same dream, and over the past five years have travelled across Nepal to research their menu, collecting ingredients and ideas from homestays, food carts, and nature. The team then scouted for Nepal’s best architect, and zeroed in on Bhaktapur-based heritage conservationist Rabindra Puri who designed the Malla-era house for Tusa in the Nag Pokhari neighbourhood. Tusa can seat 28, and dining here is a sensory experience with a live kitchen. The chefs cook and place dishes on a large granite countertop with induction sections built in. Behind the counter is a grill on an indoor fire with pulley control to adjust the fire. Everything that can be made in Nepal — chairs and tables, ceramic dishes, the grill — is locally sourced. The executive kitchen/laboratory is downstairs. It is spacious, spotless, and contains appliances rarely seen in restaurants here: a sous vide machine that cooks vacuum-sealed packets at consistent temperatures, and a dehydrator for sisnu nettles. A fresh batch of deep purple kimbu (mulberry) muffins has just come out of the oven. Fridges have dry-aged fish and marigold kombucha. The restaurant serves a tasting menu with six courses, plus surprises. It starts with a fermented potato and millet roti with charred green garlic and tomato chutney. The bread tastes like a mix of alu paratha and kodoko roti with a satisfying, mild flavour. The chefs do not show off, and overdo it. Dishes are tastefully simple and faithful, a theme that runs through the meal. The second course is a filet of fish charred on one side and placed in a broth. It is delicate and smokey, and does not mask the character of the fish.&nbsp; The next is Batuk Chukauni, a Magar dish with a lentil snack and a yoghurt-based potato achar. The batuk, made of lentil batter, is light and the chukauni has potatoes and peas. Photo: VISHAD ONTA</figcaption> </figure>  Next is a skewer of jackfruit with a tamarind and mustard glaze that has the texture of a slice of sausage and melts in the mouth. Then comes the first off-menu item: a steak of watermelon, glazed and grilled, tasting sweet, sour and smokey. After that a palate cleanser sorbet made with laligurans syrup adorned with a frozen candied rhododendron petal. Finally the main course: barbeque chicken and chyakla coarse corn grits. The chicken has been brined, marinated, cooked sous-vide and seared on the grill. The delicate consistency of the chicken stands out. Desert is a smooth, creamy cheesecake that uses the local juju-dhau yoghurt. And the last course is a moist, moss-green sisnu cake laced with mulberry jam and cream.&nbsp; There is nothing gimmicky about Tusa. It is the coming together of skilled Nepalis with international exposure who have mixed what they have learnt abroad with the flavours of home.&nbsp; The tasting menu is Rs3,500, and it may take some time before Nepalis develop a predilection for some of its items. The chefs are excited, vindicated, and relieved. Coming back to Nepal, uprooting successful careers abroad to take a chance on Nepal must not have been easy.&nbsp; Tusa had a soft launch on New Year’s day with Kathmandu-based diplomats. Australian Ambassador Felicity Volk was one of them, and wrote on a Facebook post: ‘Chefs who honed their skills in Australia and returned to Nepal to give back. The return of the natives

For a year or two after the 25 April 2015 earthquake, the residents of Kathmandu were too terrified to return to their high-rise apartments. None of them collapsed in the 7.8 disaster, but many sustained serious structural damage. &nbsp;
Fast forward nine years, and they have all but forgotten that frightful day. Kathmandu is back to building substandard structures, even as land prices drive developers to build taller.&nbsp;
With no more space to spread horizontally, Kathmandu is going vertical. But structural engineers say most of the high rises do not take into account seismicity, soil condition, construction methods, quality of raw materials, fire hazard, and search and rescue in collapsed concrete structures.
“Much of our focus since the 2015 earthquake has been on building and construction, but not as much on where we are building,” warns Sangeeta Singh, Professor of Urban Planning and Deputy Director of Centre for Disaster Studies at the Institute of Engineering.

She adds: “Kathmandu is not really suited for high-rises. We have to first test the condition of the soil, but building permits are being issued without this fundamental step.”
Kathmandu Valley is a former lakebed with soft topsoil prone to liquefaction and excessive shaking, as seen during the 1934 megaquake. Many ruptures tore up the surface in 2015. &nbsp;
During an earthquake, the rock layers below Kathmandu ring like a bell and the vibrations on the surface take between 0.5 to 2 seconds for one oscillation. Buildings also vibrate, but at different frequencies depending on their height, construction material, and arrangement of their structural components.
At five floors, the vibration period of a building is 0.5 seconds, which is the same as that for Kathmandu Valley, and this could cause more damage, says structural engineer Surya Narayan Shrestha at the National Society for Earthquake Technology - Nepal (NSET).
“Building anything that is five storeys or higher in Kathmandu needs special design and structural considerations,” says Shrestha.

Technologies exist to reduce seismic risk in high-rises, and these are used in earthquake-prone cities like Tokyo, Los Angeles, Jakarta or Mexico City.&nbsp;
Base isolation, for example, separates the vibration of the land and the building, reducing damage from soil-building resonance. Base isolators move and stretch under pressure, absorbing much of an earthquake's impact by reducing swaying and shaking. &nbsp;
Seismic dampers change the pattern of vibration altogether, dissipating energy as vibrations move across a structure. But these are all expensive technologies, and none of the high-rises in Kathmandu use them.
However, Nepali engineers who can help with technology transfer are working in the field in Nepal and overseas. Kathmandu’s high-rises are already very expensive, and making them seismic-resistant would be an incremental cost.

The shape of high-rises also matters. Reinforced concrete buildings with asymmetric designs of the kind that are seen in newer structures in Kathmandu experience more torsion and shear during quakes. High-rises with regular geometry are stronger. &nbsp;&nbsp;
An even bigger concern is that of emergency evacuation and rescue in case of fire or earthquake. Kathmandu fire services do not have ladders that reach the higher floors of most new structures.
“High-rises mean more people and potentially higher casualties,” explains Shrestha. “We need immediate evacuation routes, fire escapes, emergency ladders, and fire trucks that can reach higher. Right now, safety features are voluntary and not mandatory.”
The street access, shelters, open spaces, and evacuation routes are integral to disaster preparedness and the safety of neighbourhoods and not just buildings. Most new high-rises in Kathmandu have narrow access roads.

Since most of the buildings that survived the 2015 disaster were reinforced concrete structures, it fed the misconception that they are safer. But Himalayan seismologists say that if the intensity and duration of the shaking had been just a little higher, many substandard concrete structures would have collapsed.&nbsp;
And that is the final gap: Nepal’s limited expertise and equipment for search and rescue inside collapsed concrete structures. Kathmandu’s high-rises need to be better prepared for the next Big One.
“Structural safety and design were at the front and the centre after the 2015 earthquake, we also revised some building codes but we are back to square one with contractor-driven construction, especially in peri-urban areas,” says Sangeeta Singh, who is also with the National Planning Commission. “We need to monitor construction as much as design.”&nbsp;
Shrestha at NSET agrees there have been improvements in building practices in the past nine years, but adds, “We have both learnt and unlearnt lessons from 2015. The awareness hasn’t yet translated into action on safety.”

The rise of high-rises

Midway along the stretch of the ancient trade route between Tibet and India lies the Kel Tol neighbourhood. The name is derived from the original Koligrām, and it is believed the Koli people, who were originally from Rāmagrām in present-day southern Nepal near the Indian border, settled here. The Koli were the maternal ancestors of none other than the Buddha. Kel Tol is famous for the Buddhist monastic complex of Kanak Chaitya Mahāvihar, featuring the majestic two-tiered gilded temple of the white god Karunāmaya.&nbsp; This elaborately decorated courtyard is a bustling centre of the Vajrayāna sect of Buddhism, practised widely by the indigenous Newā people of Kathmandu Valley. Karunāmaya, also known as Ārya Avalokiteshwor, is defined in great detail in the 1st century CE Buddhist text Sadharmapundarikā where he liberates all sentient beings from suffering. He helps rid the eight external fears metaphorically equated with their equivalent internal states of mind: lions (pride), wild elephants (ignorance), fire (anger), snakes (jealousy), floods (attachment), imprisonment (miserliness), thieves (wrong views) and cannibals (doubt).  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20240418130432_fe370cbee75003cd3eb5dccc7c3b2671630da193b0744db2aeac1bab3ff4a85c.jpg" data-media-id="editor_0" data-image-id="20240418130432_fe370cbee75003cd3eb5dccc7c3b2671630da193b0744db2aeac1bab3ff4a85c" data-rendition-name="original" width="1338" height="2000" loading="lazy" alt="Seto Machhindranath"> </figure>  In the Pancha Rakshyā Sutra, a Buddhist scripture from 200 CE, Ārya Avalokiteshwor was counted among the eight major deities. Followers of the Brāhminical god Shiva worship Ārya Avalokiteshwor as Seto Machhindranāth. For Shaivites, Machhindranāth is the Indian saint who founded the Nāth cult in the 10th century CE. He is the guru of saint Gorakhnāth. During the reign of Yakshya Malla (1428–1482 CE), a beautiful image of Ārya Avalokiteshwor was dug up by a farmer in present-day Jamal, which was then a cultivated area outside the city. The farmer, known as a Jamami (meaning the one from Jamal) took the image home for safekeeping. That night, Ārya Avalokiteshwor appeared in the farmer’s dream and told him that the proper place for him to reside is at the confluence of two rivers. The nearest confluence was at present-day Wongha (Indrachok) and the image was installed in the Kanak Chaitya Mahāvihar complex in Kel Tol near Wongha. This made it easier for city residents to pay homage to Ārya Avalokiteshwor and spread compassion. Soon, the deity came to be revered highly as Jamaleshwor, the one found in Jamal. Eventually, the name got corrupted, as happens often in Nepāl Bhāsā, to Janabahā Dyo. The courtyard where his temple is located is now popularly known as Janabahā.  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20240418130432_5c9b219530e400445ef4e7f64856b43e7cdb756be26d9ed4565c84044c178a7e.jpg" data-media-id="editor_1" data-image-id="20240418130432_5c9b219530e400445ef4e7f64856b43e7cdb756be26d9ed4565c84044c178a7e" data-rendition-name="original" width="2500" height="1668" loading="lazy" alt="Seto Machhindranath"> </figure>  The gilded temple of Janabahā Dyo, first built in the early 16th century CE, is adorned with wooden and metal artefacts that symbolise 108 forms of Ārya Avalokiteshwor. It stands out as the most decorated temple of its kind in Kathmandu. Today, Janabahā is a living heritage site where many ancient customs and rituals are widely practised as per Vajrayāna Buddhist tradition. Devotees throng the Janabahā Dyo shrine for daily worship and to receive Karunāmaya’s blessings. Being the compassionate one, Ārya Avalokiteshwor goes around town every year in his tall wooden chariot to allow sick and physically disabled devotees to pay homage to him from the comfort of their homes. One could say it is a door-to-door visit by the Compassionate One.&nbsp; For the pragmatic minded, the chariot festival is an annual renewal of communal harmony, validation of our ancient mathematical supremacy and demonstration of the need to keep practical skills alive, including the craft of building earthquake resilient houses.  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20240418130432_fc8b234ceca87dee4b99e897a485cef121fb953857fb61492a413fbfcc48360c.jpg" data-media-id="editor_2" data-image-id="20240418130432_fc8b234ceca87dee4b99e897a485cef121fb953857fb61492a413fbfcc48360c" data-rendition-name="original" width="2500" height="1667" loading="lazy" alt="Seto Machhindranath"> </figure>  The Janabahā Dyo chariot is pulled from Jamal, where his image was found by the farmer, through the historic heart of Kathmandu in a gala parade every year. The procession, accompanied by folk music ensembles and revellers, starts on the eighth day of the bright half of the month of Chaitra, and lasts up to a week (ending on Saturday this year). Hundreds of devotees pull the chariot along the streets as a way of expressing their gratitude to lord Karunāmaya for blessing them with compassion and well-being. Purna Ratna Vajrāchārya is an ordained priest who belongs to the clan responsible for taking care of Janabahā Dyo. He has been studying the design and architecture of the chariot for the past 40 years, and overseeing its construction for the past 15. He has learnt that the engineering principles of building the chariot are based on the mathematical system in which Buddhism is taught. For example, 365 pieces of wood are used in the chariot, each representing a day of the year. Each of the four wheels consist of 25 pieces of wood, totalling 100, representing completeness or fulfilment. The height and length of the chariot is 32 arm’s length (hāt in Sanskrit), 14.8m. The number 32 represents the maximum number of auspicious and physical qualities one could possess to be considered an outstanding human being.&nbsp; Says Vajrācharya, “Observing how the chariot is built helps one learn the fundamental pillars of the Buddha’s teachings, and find an easier path to Nirvana.” The structural design of the nearly 15m wooden chariot is not only awe-inspiring but also gravity-defying. It leverages the pliancy of the materials used in its construction -- flexible joints tied with cane soaked in water for several days. But this has been achieved year after year, despite the fact that the devotees who tug wildly at the ropes lassoed to the two front wheels, are most likely in high-spirits (pun intended). Sanjay Manandhar, a US-based technology entrepreneur, recounts how his high school physics teacher from Canada asked his students to go observe the locals build the chariots of Karunāmaya if they were interested in becoming engineers in the future.&nbsp; “That made no sense to me then, but, after all these decades, I now see clearly how the structural design of the chariot, adopted early on by our ancestors is full of earthquake-resilient properties that need to be applied in building houses in an earthquake-prone zone like Nepal,” says Manandhar. A highlight of the chariot festival is that human goddess Kumari makes an appearance at the final destination in Lagan, usually on the third day. For close to four centuries, the construction of the chariot and its operation has proven to be a phenomenal engineering feat, and the people’s faith in divinity means the tradition is alive.&nbsp; The essence of the colourful rituals and the religious beliefs of this ancient chariot festival is now all but lost. The logic, technology and practicality must be brought back to light, as they reflect the high civilisation and wisdom of our ancestors that we can leverage in modern times and into the future. &nbsp; Alok Tuladhar is a culture and heritage documentarian.

In the run-up to the third Nepal Investment Summit this weekend, there have been seminars, conferences and workshops where the discourse has revolved around the economy and the investment climate.
The consensus that Nepal needs foreign direct investments (FDI) to grow was repeated, and the familiar litany of reasons about why it has not been able to was discussed.&nbsp;
Policy advocates and regulators have understood that the lack of urgency is compounded by procedural inconsistencies, on top of the already deficient investment environment in the country.
It is a welcome change from what used to be flippantly accepting matters as given. There now seems to be a sense of urgency, with procedural inconsistencies and lack of harmonisation between various Acts and regulations openly discussed.&nbsp;
Government stakeholders also appear more willing to learn and attempt to be part of the solution. Whatever policy changes have been introduced in the past have been piecemeal and address the few rather than the entire industry. This left dual regulatory approaches aimed at similar players.&nbsp;

This time, unlike in the past two Summits, the government seems to be committed to amending 9 Acts, a positive step towards showing commitment to change. However, the deadline to do so during the winter session of Parliament is over. The option mooted has been to have it passed through ordinance, a lesser appealing step; albeit, a positive one moving forward.&nbsp;
To attract FDI in a competitive global market means that Nepal has to demonstrate that it is serious about bringing in investments with a more consultative and collaborative approach with investors. A departure from procedural to a result-oriented focus is needed.&nbsp;
To put issues in perspective, Nepal needs US$20 billion in investments to meet the UN’s Sustainable Development Goals (SDG) targets by 2030. If net-zero decarbonisation targets are to be met by 2045, another US$7 billion will be required annually.&nbsp;
Looking at our investment history and poor government capital expenditure, the gap is long and wide. In fiscal year 2022-23 Nepal booked a lamentable ~$59 million in FDI (equity). Nepal is in fact the lowest market in South Asia for FDI with 0.3% of the regional average.&nbsp;
What is it that we can do to fill the gap?&nbsp;
First, we need to move away from the notion that Nepal only needs large investments. This has proven to be a mistake, and time series data have proven that smaller investments, in aggregate, make a larger impact on economies.&nbsp;

We talk about an ‘enabling environment’ but without the right tools. We place restrictions on interest on debt ceiling (SOFR +5.5), without risk premium adjustments, we do not have an active secondary market for bond trading, nor do we have a yield curve, an integral part of the bond market, which is inhibiting us from tapping into the trillion dollar green bond market.&nbsp;
In order to attract green financing, Nepal needs to develop its bond market. Sovereign risk rating has been mooted and was expected to be operationalised before the Investment Summit.&nbsp;
However, to be rated in an adverse economic environment could further deteriorate investment potential due to a lesser-than-expected rating.&nbsp;
Hedging is another instrument that needs further research on. A commercial bank last year showcased the first risk-hedging mechanism for an investment of $8 million. This can be the beginning to expand on its modality. &nbsp;
Subordinated debt instruments have been introduced, but on a special nod basis, this now needs to be institutionalised as it is the most applicable form of investment after equity in a market that has volatile forex reserves.&nbsp;

Viability Gap Funding has been introduced by multilateral development agencies implemented in solar installations. It is a tool to incentivise the private sector to invest in projects that are not financially lucrative initially, but have potential for profitability in the long run. This needs to be scaled up and replicated in sectors like infrastructure, where returns may not be immediate.
Moving forward, to attract FDI, Nepal needs to tap into the funds that are available for the growth of small and medium enterprises (SMEs) and climate change. Alternative investments such as Private Equity Venture Capital (PEVC) have been around in a structured manner in Nepal for nearly a decade now.
These funds have blended finance components and have attracted climate funding as well. PEVC is a new asset class and can address the issues of penetrating into SME financing by incorporating environment, social and governance issues into their investment process.&nbsp;
SMEs are the backbone of any economy, PEVC comes with the ability not only to scale up the enterprise with risk capital, but with the ability to bring technical knowhow to enhance not only the enterprise but also the entrepreneur.&nbsp;

A differentiator from all other forms of financing available till date in Nepal. Blended finance is a way of de-risking investments, especially in frontier markets. Business Oxygen (BO2) is an example of blended finance with subordinated debt investments of IFC (World Bank Group) taking the lead and Climate Investment Funds along with FCDO as co-investors.&nbsp;
On a larger scale, the 216MW Upper Trisuli 1 is another example of blended finance with IFC, a Korean consortium and local investments. So far, we see that development finance Institutions have been taking the lead in Nepal as their risk appetite is greater than commercial investors and they are eager to help develop the financial markets.&nbsp;
In order to be sustainable, we need to step on this and attract commercial capital from all over the world. To do this there has to be political will to make that pivot.&nbsp;
Instead of being a means to an end, the two previous Investment Summits turned out to be intermittent and cosmetic, providing hardly any results. The third one’s success will depend on how the event will be implemented as a platform for continuous marketing for the country and facilitation for investors in future.&nbsp;
Nepal has outdone many countries in its macro-economic indicators, with sound forex reserves and a stellar history of debt payments to its creditors. This story needs to be propagated along with the drive for change to attract potential investors.
