<img width="965" height="543" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221114101136/63720c839c7e80680e0b7873jpeg.jpg" alt=""/>For the past weeks, there is one news item that has overshadowed news of the <a href="https://www.nepalitimes.com/here-now/mcc-gets-green-light-in-nepal/">MCC</a> or <a href="https://www.nepalitimes.com/latest/trapped-in-ukraine/">Ukraine</a>: allegations that Nepali actor and model Paul Shah raped a minor colleague. Shah, 32, is in police custody in Tanahau since 27 February after a 17-year old singer with whom he had done numerous music videos filed a complaint at the police accusing the actor of raping her under false pretenses of marriage. Shah was on the run after he failed to appear before law enforcement following the charge filed against him. Before news of his arrest on 27 February, the actor said via social media that he would turn himself in.  Prior to his arrest, as details emerged about his alleged serial abuse of the teenager singer, Shah released audio recordings on social media in an attempt to explain to the public what he called “conspiracies” and “attacks” against him. Read more: <a href="https://www.nepalitimes.com/latest/plot-thickens-in-nepal-speaker-rape-case/">Plot thickens in Nepal Speaker rape case</a>, Nepali Times Even as a significant number of Nepalis have called for Shah to be tried under the full extent of the law, his arrest has followed protests in front of the police station as well as on social media in his support, including by insiders within Nepal’s entertainment industry.  Meanwhile, the minor has come under intense public scrutiny as she continues to be the subject of various media content with the case involving a popular celebrity. She has broken down in tv interviews, complaining of <a href="https://www.nepalitimes.com/here-now/mcc-gets-green-light-in-nepal/">mental torture</a>.  <a style="font-size: 15px; letter-spacing: 0.01em;" href="https://www.lawcommission.gov.np/en/wp-content/uploads/2019/07/The-Act-Relating-to-Children-2075-2018.pdf?fbclid=IwAR3lb4WLeIpFHBZSsd7F9LLXUdK5nUyHguVt58ZLEcEPF1rGp5JITUaOmjg" target="_blank" rel="noopener noreferrer">Nepal’s Act Relating to Children 2018</a> defines those below the age of 18 as minors, and the case has drawn attention to the rape and abuse of minors. The case has also highlighted the fact that men, boys and gender minorities are not specified as victim of case of rape under the Criminal Code. Some 45% of reported rape cases in 2020-21 were of girls below 16 years of age, according to Women Rehabilitation Centre (WOREC). There has been a steady rise in the number of rape cases in recent years in Nepal, although it is unclear if this is because there are more incidents or more women are reporting them. <img width="800" height="406" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221114101136/63720c869c7e80680e0b7874jpeg.jpg" alt="">The Nepal Police in 2021 reported that up to seven women and girls are raped everyday in the country, most of them by neighbours, relatives and acquaintances.  One point that has come under intense scrutiny is that law in Nepal specifies women and girls as the victim in case of rape. Men, boys, and gender minorities are not included in the definition Criminal Code ma. Following intense media scrutiny, Nepal’s Cyber Bureau directed ‘individuals and groups to refrain from influencing investigations into serious crimes by uploading videos and photos with misleading and false captions on social media that are intended to disturb social harmony and violate the privacy and mental health of the victim’. Anyone involved in such activities would be prosecuted in accordance with prevailing laws under Nepal’s Electronic Transactions Act 2063. Earlier, Nepal’s National Human Rights Commission (NHRC) also said it was monitoring the investigation process as well as the online outrage following Shah’s arrest, urging people to assist in the independent investigation. The NHRC urged people to refrain from recording and disseminating videos without the permission of the concerned parties, and to hand over any relevant information to the authorities as evidence. "Investigation of serious crimes should be conducted in a confidential, impartial, independent manner in accordance with the principles of criminal justice,” the NHRC’s statement read.  The case has become another landmark in Nepali society debating violence against women, rise in rape cases, Nepal’s entrenched patriarchy, as well as trial by media and the investigative and judicial agencies being influenced by the powerful. Photos: BIRENDRA SINGH JOHARI</figcaption></figure>Growing up in a Darchula village near the Tibetan border, a young <a href="https://archive.nepalitimes.com/article/nation/sting-operator-birendra-singh-johari,2638?fbclid=IwAR3aHqHPZlgmT-9NWNNhfahHDr8tsWBTU9mnAzG-u6PMhKch3EIu0esq3Wo" target="_blank" rel="noopener noreferrer">Birendra Singh Johari</a> was no stranger to <a href="https://www.nepalitimes.com/latest/what-drives-wildlife-poaching/" target="_blank" rel="noopener noreferrer">wildlife crimes</a>. At teashops and community gatherings, neighbours openly talked about transporting tiger pelts and elephant ivory to traders across the border to China.“They called it दुइ नम्बरी धन्दा, but it was also how people in Darchula could make a living. Since then, I had always wanted to grow up to be a cop and arrest the real bad guys,” recalls Johari, now 40, and Sub-Inspector at the Central Investigation Bureau (CIB) Wildlife Pillar 4 of the Nepal Police.Now, Johari and his colleague Inspector Sudarshan Panthee are proud recipients of the the UN’s <a href="https://www.unep.org/regions/asia-and-pacific/2020-asia-environmental-enforcement-awards" target="_blank" rel="noopener noreferrer">Asia Environmental Enforcement Awards</a> for arresting the notorious ringleader of a smuggling network accused of transporting pelts and bones of tigers from India via Nepal to China.<a style="font-size: 15px; letter-spacing: 0.01em;" href="https://www.nepalitimes.com/latest/wildlife-smuggler-caught-in-kathmandu-after-15-years/" target="_blank" rel="noopener noreferrer">Kunjok Lama</a> (real name Kunjok Tsering Tamang) had been in the crosshairs of police in India and Nepal as well as Interpol for two decades. His name appeared in every major seizure of wildlife parts in the region before his arrest by the CIB in June last year. <img width="606" height="580" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/2022111011114/636ccd239c7e80680e08bc5cjpeg.jpg" alt="">In 2005, in one of the biggest hauls of wildlife contraband in South Asia, a Nepal Army patrol in the Langtang National Park in Rasuwa caught four people with 5 tiger pelts, 36 leopard skins and 113kg of tiger bones on their way to <a href="https://www.nepalitimes.com/latest/better-nepal-china-connectivity-helps-wildlife-smugglers/" target="_blank" rel="noopener noreferrer">the Chinese border</a>. Every one of them mentioned Kunjok during the investigation, but it was not until his real identity was verified that the case came to its climax.“We led this investigation for years, we analysed his property, companies, citizenship and passports, and we found a clue: the personal number he was using at the time was in one of the documents,” explains Panthee. “We then found that Kunjok Lama and Kunjok Tsering Tamang was the same person.” <figure><img width="1500" height="717" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/2022111011114/636ccd259c7e80680e08bc5djpeg.jpg" alt=""><figcaption> </figcaption></figure>Tamang is now in custody at the Rasuwa Prison, after his failed attempt to challenge the Rasuwa District Court’s order at the Patan High Court and a writ of habeas corpus petition in the Supreme Court.Nepal Police has been often criticised for catching only the small fry in organised crime operations, but with the prosecution of Tamang, the officers say they are closing in on other ring leaders involved in the case in Tibet and New York, aided by new technology to analyse digital footprints and paper trails.However, a reliable central data system and proper coordination between the police and the forestry and national park officials will further assist in wildlife crime investigation, they say.But even then, smugglers caught by investigators use <a href="https://www.nepalitimes.com/banner/lax-laws-make-nepal-haven-for-tiger-poachers/" target="_blank" rel="noopener noreferrer">legal loopholes, political connections and judicial corruption</a> to get light sentences, jump nominal bail or altogether escape.“It happens more often than we can count, we dedicate all our time and effort in these investigations but they find one loophole or the other to escape, it is frustrating,” admits Johari. “But we don’t let that dishearten us, we learn from each case, we build more evidence and a stronger case for the next time.”Wildlife crime investigators also face personal security threats. Recently, some men who are believed to be involved in wildlife contraband trade visited the school where Johari’s young daughter is enrolled. They claimed that the parents were out of town for work and were sent to pick up the girl. Luckily, Johari’s daughter was back from school half an hour earlier that day.With the global coronavirus crisis, there has been a sharp rise in wildlife poaching. In April, <a href="https://www.nepalitimes.com/latest/7-musk-deer-killed-by-poachers-during-lockdown/" target="_blank" rel="noopener noreferrer">six musk deer were found dead</a> in traps laid by poachers during Covid-19 lockdown in Sagarmatha National Park. <img width="1002" height="1500" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/2022111011114/636ccd289c7e80680e08bc5ejpeg.jpg" alt="">For the first time in over half a decade, Nepal wasn’t able to celebrate zero rhino poaching this year when four adult rhinos were found dead in Chitwan National Park—shot dead for their horns. Recently, the CIB has seized two tiger pelts in Dang. So far, 14 people involved in the crimes have been arrested, 12 individuals are on the run. <figure><img width="640" height="856" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/2022111011114/636ccd2a9c7e80680e08bc5fjpeg.jpg" alt=""><figcaption> </figcaption></figure>Police investigations reveal that the big fish are using social media networks to recruit locals who have lost their jobs during the pandemic for killing rhinos, tigers and other wildlife in return for quick cash.Despite Nepal’s successes in wildlife protection, law enforcement agencies cannot afford to be complacent. And conservationists say recognitions like the <a href="https://www.unep.org/regions/asia-and-pacific/2020-asia-environmental-enforcement-awards?fbclid=IwAR3-6e7vOWwJw5ZPKJgd4eqhlHO7ceBIwNrDkzEPhOe0AVz0No3aWcNU1WE" target="_blank" rel="noopener noreferrer">Asia Environmental Enforcement Award</a> provide a morale boost for these hard-working officers.“This award is an international acknowledgment of the Central Investigation Bureau’s role in controlling wildlife crime in Nepal,” says Sahakul Bahadur Thapa, chief of the CIB of the Nepal Police.Johari, who was also the recipient of the Abraham Conservation Award in 2015: “This award is a reminder that hard work pays off,  and for me personally it is a fulfilment of my childhood dream in Darchula. Our job is to catch the culprits, but it is much better if wildlife is so well protected by local people themselves that they are not killed and smuggled in the first place.”

Nepal’s wildlife watchdogs honoured

<a href="https://www.nepalitimes.com/here-now/hunger-for-justice/">Ganga Maya Adhikari</a> started her latest hunger strike on 21 December 2020 on the 7th floor ward of the Trauma Centre, and has not taken any food or water since. She is receiving intravenous fluids, and her condition has deteriorated.
Her son, Krishna Adhikari was kidnapped, tortured and killed in June 2004 by the Maoists in Chitwan who accused him of being a spy. Those allegedly behind the murder have been set free by the courts.
“Ganga Maya is on strike because she has abandoned any hope for justice from this government, which has insulted her struggle,” said human rights activist Charan Prasai, who was among artists, lawyers, and rights activists at a sit-in outside the hospital on Thursday.
Doctors at the Trauma Centre said Ganga Maya’s health was deteriorating fast, and she needed intensive care because it was now a question of life-or-death.    
After the Comprehensive Peace Accord, <a href="https://www.nepalitimes.com/latest/ganga-mayas-endless-road-to-justice/">repeated attempts by Ganga Maya and her husband</a> Nanda Prasad to get justice failed, and <a href="http://archive.nepalitimes.com/regular-columns/The-deadline/sad-saga-of-adhikari-family,367">the couple came to Kathmandu</a> to protest when former Maoist ideologue <a href="http://nepalitimes.com/regular-columns/The-deadline/sad-saga-of-adhikari-family,367">Baburam Bhattarai</a> was prime minister in 2012.
<a href="https://www.nepalitimes.com/latest/ganga-mayas-endless-road-to-justice/">Nanda Prasad died seven years ago</a> in Bir Hospital after a year-long fast, and his <a href="http://archive.nepalitimes.com/article/nation/dead-and-dying,3955">body is still in the morgue</a> at the Teaching Hospital since Ganga Maya has refused to cremate him until the guilty are punished.
Krishna Adhikari had just finished his SLC exam when a group of Maoists put him in a sack and dragged him behind a motorcycle in Chitwan. After the conflict, the couple lodged a complaint with Chitwan police, naming 13 people who they said were involved.
The 13 were charged, but the Chitwan District Court ordered their release on bail. A year later, the appellate court in Hetauda upheld the bail decision. The Supreme Court then ruled on an appeal by Ganga Maya in 2015 to put Chhabilal Poudel, the main accused, in judicial custody, but when he did not surrender the couple went on another hunger strike until he was re-arrested. 
But in 2019, the Chitwan District Court acquitted all the accused except one. Ganga Maya appealed again, but no further hearings have been held.
Doctors attending to Ganga Maya said she had told them that she had no reason to live anymore because she had no hope left for justice, her husband was dead, and her elder son had been jailed on trumped up charges.

Mother on 25th day of hunger strike

<figure><img width="1404" height="952" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109181120/636be1a69c7e80680e083e5ejpeg.jpg" alt=""/><figcaption>The Dum Dum Central Correctional Home in Kolkata where Dipak Jays has spent the last 15 years of his 40 year incarceration without trial.</figcaption></figure>The mother of a Nepali man who has been languishing in a Kolkata jail without trial for the past 40 years has finally found out his whereabouts after efforts by journalists, lawyers and even amateur ham radio enthusiasts in India and Nepal. Dipak Jaisi had been arrested in 1981 in Darjeeling and was moved to Dumdum Central Correctional Home near Kolkata 15 years ago, where a fire destroyed all records of inmates. <a href="https://www.himalkhabar.com/news/120334" target="_blank" rel="noopener noreferrer" data-saferedirecturl="https://www.google.com/url?q=https://www.himalkhabar.com/news/120334&amp;source=gmail&amp;ust=1605795110624000&amp;usg=AFQjCNH_CM6fwmKzvItT60S-NZ4ns43VSQ">Himal Khabarpatrika reported Jaisi’s story</a> on 10 November, said that there were no records of whether he had family in Nepal, and whether they knew what had become of him. Within a week of the story appearing online, Jaisi’s family in Mai Municipality of Ilam district in eastern Nepal read it and came forward.Family members contacted the magazine on Tuesday and said that Dipak’s real name was Dupta Prasad Timsina, and he had gone to Darjeeling in 1981 and had not been heard from since. It is now known that Dipak has a 81-year-old mother Dhanmaya, two younger brothers and two sisters. His father Champakhar Timsina is dead. His nephew Dilnath Phuyal is principal of Mahendra Ratna Campus in Ilam. Dilnath was doing his PhD in Kolkata in 2008 when he heard that his uncle was in a jail there, but although he looked for him there were no leads. Last year, a Darjeeling based lawyer Gunjan Sherpa had found out about Dipak’s whereabouts and told the family about him.“We are happy that he has been found, and now we will try to get him released and bring my uncle home,” said Dilnath Phuyal. <figure><img width="898" height="1052" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109181120/636be1a99c7e80680e083e5fjpeg.jpg" alt=""><figcaption>Dipak Jaisi’s 81-year-old mother Dhanmaya Timsina was finally traced to a town in Ilam this week.</figcaption></figure>Dipak Jaisi, who is now about 62, left his home in Ilam to find work in Darjeeling, but was arrested for an unknown crime. No one bothered to take the court process forward, he was left in jail in Darjeeling and later for some reason was transferred to Kolkata. Meanwhile, Dipak’s family had moved to another town in Ilam, and his efforts to reach them failed.The story only came out when Dipak’s fellow inmate Radheshyam Das was released from the same detention facility in Dum Dum, and he told lawyers in Kolkata about a Nepali man in jail without trial. Singh is now trying to get jail records from Darjeeling.Ilam-based writer Kedar Sharma played a major role in finally tracing Dipak’s family in Mai Municipality after tracking them from their earlier domicile. In Kolkata, Consul General Ishwar Raj Poudel said: “The mission is moving to meet Dipak in jail and get him released and send him home.”Hirak Singh says years of incarceration have affected Dipak mentally, and he speculates that the reason he was not brought to trial could be because he was deemed to be of unsound mind. Nepali jailed 40 years without trial in Kolkata

Photo: Himal Khabarpatrika</figcaption></figure>Teenage survivors of acid attacks, nearly all of them young women, say regulating the over-the-counter sale of acid and life imprisonment for perpetrators are the only ways to stop the kind of attacks that disfigured them for life.Some of these women attended a hearing convened by Parliament’s Women and Social Committee in Singha Durbar last week, just after news came in of another horrific attack on a young woman in Kathmandu by an employer who reportedly sought revenge for having his advances spurned.Among those at the hearing was <a href="https://www.nepalitimes.com/opinion/using-numbers-to-fight-gender-based-violence/">Muskaan Khatun</a>, 14, who survived an acid attack last year in the street while on her way to school, scarring her right ear, cheek and neck. Two suspects were detained by the police.Images of Muskaan Khatun went viral on social media, and coincided with the release of the  Bollywood film Chhapaak on acid attacks on women in India. Khatun went on to use her high media profile to raise awareness about acid attacks.Khatun came for the hearing wearing a black scarf last week with her parents, which she took off once inside the room, revealing the scarred right side of her face. She burst into tears while recalling the attack and the pain and suffering afterwards during the many operations at a hospital in Kirtipur that treats burn victims.“Doctors recommend that I apply medicine on my wounds five times a day, but I can only afford to do it once a day because it is so expensive,” Khatun said as the masked committee members listened. “I have another nine years of treatment, how am I going to complete it? My parents have no work.”Also at the hearing were other survivors like Jenny Khadka and <a href="https://www.nepalitimes.com/banner/sangita-magar-from-survivor-to-champion/">Sangita Thapa Magar</a> who shared their pain from acid attacks.Khadka used to be beaten often by her husband, and one day she had enough and went to a police station in her torn clothes to report an assault. The police sent her away and told her to sort out her domestic problems herself.Her husband then poured acid on her, burning her hand, neck and body. Now, a year later, she has to be careful while dressing, her skin is often dry and painful.“Throughout my life, I was never sick. Now I need life-long medication, and I am deeply in debt,” says Khadka. “People take pity on me, and that makes me feel even more helpless.”Khadka is livid that while her life has been ruined, she has lost her job, and her mother became ill with stress her husband is not suffering much. The hospital where she was treated refused to discharge her because she did not have the money to clear her bills, and she was only allowed to leave after her friends raised money through Facebook.“Those who attacked us are clothed and fed in jail and are looking forward to the day that they will be released, while we suffer endless pain,” Khadka says. “I am against the death penalty because that would end it all in a second for them. They should have to bear prolonged suffering like us.”Sangita Thapa Magar was 16 in 2015 when she was attacked by a young Dalit man who had been trying to have a relationship with her. Magar’s parents had told him to stop pursuing their daughter, and in revenge he bought Rs125 worth of acid in a shop in New Road and splashed it across her face while she was taking tuition.She has since had 17 surgical procedures on her face, her hopes of one day making it to Nepal’s national karate team now dashed. Magar is now determined to be an activist against acid attacks, and to help other victims like her cope with the physical and mental scars. Magar is now afraid because her attacker has been released from jail."It may be a feeling of revenge, but we would like our attackers to also suffer like us, maybe that will reduce the number of attacks,” she told the Parliament committee. “If stricter laws had been enacted as soon as I was attacked, maybe Jenny and Muskaan would not have to suffer.”Khatun, Khadka and Magar were attacked by different men, but they have been joined by fate and vow to continue their work to help other like them, including Pabitra Karki the latest victim whom they all went to see in hospital last month.Karki, 22, was attacked in Kathmandu by her by a man hired by her employer who had taken fancy to her, and has severe burns in her face and hands. Police have arrested both men, while Karki is getting help from charities and good Samaritans like Ujjwal Bikram Thapa who also helped Khatun.According to a police study, nearly all acid attacks are perpetrated by men who act in revenge because the young women rejected their advances. But this is the first time lawmakers have called acid attack survivors for a hearing to understand their struggles and discuss the existing laws that allow the crime to happen.The committee has directed the Office of the Prime Minister and Council of Ministers. the Ministry of Women, Children and Senior Citizens, and the National Commission for Women to provide education, health treatment, employment, and social rehabilitation to the victims of acid attacks.It also says that the punishment in the existing law is not enough of a deterrence and has instructed the Ministry of Home Affairs to start the process of amending the law to make way for stricter sentencing. The Office of the Attorney General under Agni Kharel on 2 August formed a committee headed by Deputy Attorney General Bishwaraj Koirala to look into the laws and submit a report within a month.<a href="http://archive.nepalitimes.com/news.php?id=13549#.XyoPTBMzbRY">Many cases</a> of women suffering acid attacks have surfaced over the past two decades, every time there is yet another horrific crime there are calls for stricter laws and control in acid sales. This time, the survivors want their voices heard and action taken to deter future attacks.

What does his killing tell us?This is a grave crime. Dilip had been mobilising the villagers and talking about Chure conservation. The people were responding to it positively. Those who were earning millions from illegal mining of the river beds were alarmed. Businessmen, mafia dons, police, local administration, and elected representatives are all complicit. One river is contracted out for Rs50-70 million. Malpractice increased after the practice of allocating money for Chure development shifted to the local administration.The crusher industry is also influential in politics: many have parliamentarians on their pay roll, and some owners are even MPs themselves. They do not care what the exploitation of rivers will do to the environment, or what kind of earth we are leaving behind for future generations. Dilip was fighting to protect our future, and he paid for it with his life.What environmental impact does this river extraction have on the Tarai? More than half of the Chure’s forests have been destroyed in my lifetime. <a href="https://www.nepalitimes.com/editorial/flood-of-recrimination/" target="_blank" rel="noopener">Rivers and wetlands are drying</a> in the Tarai, and the groundwater table has receded. Water scarcity is increasing in the eastern and central Tarai. In summer, people come to the highways carrying drums on bullock carts to fetch water. Fewer migratory birds winter here now. Human-wildlife conflict is increasing. The Tarai used to be our breadbasket, and we used to export grain till 40 years ago. But the present government has not heeded the reports.The 20-year Chure Conservation Master Plan outlines activities to conserve the Chure. The government has included it in its National Pride Projects, but Parliament has not made any laws pertaining to it. That shows that the government is not serious about it.All the construction projects in the Chure negatively impact its natural resources, for example the East-West Highway that was built right across the jungles. An east-west railway is being constructed at a distance of 20-30 km from the highway. The proposed mid-hill highway runs parallel to it, and the postal highway is under construction too. Another proposed highway, the Madan Bhandari Road, is being built from Jhapa to Dadeldhura. The impact of these 4-lane highways on the environment was not considered. That shows the government is not serious about the environment.What do you say about the proposed Nijgad airport? The government just wants to destroy our last remaining jungles. It wants to chop down the forest to build a new capital in Kailali. <a href="https://www.nepalitimes.com/banner/does-nepal-need-a-4th-international-airport/" target="_blank" rel="noopener">Do we need a fourth international airport</a> when international airports are already under construction in <a href="https://www.nepalitimes.com/from-the-nepali-press/sick-airport/">Bhairawa</a> and <a href="https://www.nepalitimes.com/banner/pokhara-nepals-new-aviation-gateway/">Pokhara</a>? This is just immature. If we don’t listen to conservationists, the Tarai will become a desert in a few decades.Laws should be made to implement the Chure Master Plan, and an environment-friendly policy drawn up. But this subject is never raised in the federal Parliament. The arrests come four months after five Chinese men were arrested for stealing millions of rupees from ATMs across Kathmandu.The accused were arrested simultaneously in coordinated police raids on private rented apartments in Manamaiju, Bansbari and Buddhanilkantha neighbourhoods of Kathmandu. China gets Nepal to detain its citizens in Kathmandu

<img width="712" height="520" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221108181144/636a962a9c7e80680e05dc50jpeg.jpg" alt=""/>Nepal has made progress in most areas related to children, like health, education, street children welfare, but challenges remain in nutrition, child marriage, and sexual violence, according to a report released on 20 November.The report was released on the occasion of International Children's Day and the 30th anniversary of the adoption of the Convention on the Rights of the Child by UNICEF Country Director Elke Wisch, Women's Commission Secretary Dipendra Kafle, Ministry of Women, Children &amp; Social Welfare Secretary Chandra Ghimire, and Child Rights Activist Gauri Pradhan."Nepal has improved access to education, sanitation, and was the first country to explicitly ban corporeal punishment for children. It is time to celebrate these achievements, but also remember there is much to do. This report is a call for action to ensure the rights of all children," said Wisch of UNICEF.Nepal's progress on <a href="https://www.nepalitimes.com/banner/nearly-half-of-nepali-children-still-malnourished/" target="_blank" rel="noopener">children's health and  nutrition</a> has stalled since the last census, and the problem of sexual violence has  grown worse. "The tradition of educating only the son has now all but disappeared, as we see that girls have an equal presence in schools. "Nations develop fastest when there is a large youthful population, which means now for Nepal.”Nepal passed a separate Act for children in 2018 which ensures 13 rights of children. Children below 18 form 42% of the population, and <a href="https://www.nepalitimes.com/banner/child-marriage-in-nepal-eloped-at-13-mother-by-17/" target="_blank" rel="noopener">27% of children between 10-18 years are already married</a>.The mortality rate for children below 5 is 39 per 1,000, infant mortality rate is 32 and neonatal mortality rate is 21. More than one-third of children under five are stunted, 10% have wasting, and 27% are underweight.Nearly 40% of children between 5-17 years of age are involved in child labour, and there were 1,420 reported cases of <a href="https://www.nepalitimes.com/banner/four-fold-increase-in-reported-rape-in-10-years/" target="_blank" rel="noopener">children becoming victims of sexual abuse</a>, up 995 last year. There are 82 children living in jails with a parent, and 821 children living in eight child rehabilitation centres across the country.There were 3,730,602 children joining primary school this year, with 39,820 of them with some form of disability. Mixed picture for Nepal’s children

Her face is taut, her wrinkles deeper, but there is the fire of determination in her eyes.As protests over the crime escalated last year, Durga Devi’s estranged husband Yagya Raj, his second wife and their son have also joined the campaign for justice, raising some eyebrows. Yagya Raj has shown signs of  psychological instability, and Durga Devi said he nearly strangled her recently.Laxmi and Yagya Raj, ostensibly under pressure from the opposition Nepali Congress, do not want Durga Devi to accept the compensation of Rs1 million from the Central Government and Rs500,000 from Province 7. Durga Devi herself does not want to be tangled in the politics, and says the compensation money would at least help her take care of her two daughters.Laxmi and Yagya Raj say they do not want Durga Devi to take the compensation for Nirmala’s death since they do not want it to affect the fast-unto-death by Govinda KC, since one of his demands is justice for Nirmala. Women’s groups and homemakers from all class and backgrounds campaigning for the case in Dhangadi, Kailali and Mahendranagar last week shared their frustration with the police's inability to solve the crime. After her husband left her for another woman 12 years ago, the four lived in a simple house amidst fields on the outskirts of Mahendranagar in Kanchanpur.The crime has become a national issue because of Police bungling the investigation, and not being able to find the guilty. It has become the focus of country-wide protests by human rights activists, was featured in the international media and has now even got a Wikipedia entry.   “My daughter is gone, but I want justice for her, and also my remaining two daughters to have a safe and good life,” says Durga Devi with a faraway look.Nirmala Panta had joined a study group in the house of her class mate Roshani Bam after school on 26 July last year. When Nirmala did not return home, Durga Devi had become frantic, and went to Roshani’s house to look for her daughter. Her body was found the next day 500m from Roshani Bam’s house in a sugarcane field owned by police inspector Jagdish Bhatta, who has now been suspended for tampering with evidence.Read also<a style="background-color: #ffffff; letter-spacing: 0.15px;" href="https://www.nepalitimes.com/opinion/justice-delayed-and-denied/">: Justice delayed and denied</a>, Sewa Bhattarai Province 7 Chief Minister Trilochan Bhatta denied that Police had destroyed evidence. He told Nepali Times: “All the evidence, including the vaginal swab of the victim, are safe with us. It will take time but we will crack this case soon in coordination with the Centre.”Meanwhile, the Women Human Right Defenders of Kanchanpur and Kailali districts with other activists and independent women’s groups are continuing with their relay hunger strike at the Chief District Office in Kanchanpur.  Sitting under the tent last week was Nirmala’s step-mother Laxmi Panta with activists from Kathmandu, including Sabitri Subedi, who staged the ‘petticoat campaign’ in Kathmandu. There is much mutual suspicion even among the activists groups and muttering about each others’ motivations. “Nirmala’s case is now so muddled that we do not know what will happen to the investigation,” says Nirmala Bagchan of the Women Human Right Defenders. Sabitri Ghimire of the Dalit Women’s Right Forum in Kailali accuses the Police of deliberately destroying all evidence to protect powerful interests.The rights groups appeared to be fatigued by infighting and frustrated by the lack of progress in the investigation. Conspiracy theories swirled about a cover-up by senior officials of the provincial government and Police officers allegedly involved in the crime. Why else would the Police destroy evidence, delay the investigation, frame an innocent man, detain the Bam sisters then take them to Kathmandu, and now ask the father and mother to provide DNA samples?Read also: <a href="https://www.nepalitimes.com/banner/four-fold-increase-in-reported-rape-in-10-years/">Four-fold increase in reported rape in 10 years</a>, Sewa BhattaraiSuperintendent of Police Kuber Khadayat claimed there had been eight cases of rape and five of attempted rape since the Nirmala case, and all have been solved. He said Nirmala’s case happened before he assumed office, and exuded confidence that it would be solved “soon”.The infighting among activists and the politicisation of the human rights groups helps the government, which can now blame “politics” for its failure to find the culprit. The police were notified, and after a two-week long investigation, they found Shobhan being nursed by Leela Devi Shah in the adjoining district of Siraha.Leela Devi was desperate to have a son after delivering four daughters, and decided to “buy” a son from kidnappers. She and her accomplices are now in police custody. Nepal Police reported 77 cases of kidnappings across the country in the past year. Most cases were for ransom, and young children were prime targets.In all forms of heinous crimes, including rapes, sexual assault, human trafficking or murder, the number of child victims is disproportionately high in Nepal. The figures of rape are particularly staggering. Missing children are often assumed to have been trafficked, or sold for their organs. Hemanta Malla Thakuri, who was previously the chief of the investigation unit CBI, says: “The majority of lost children are from poor families. Parents report once, but are not capable of consistently following up. It is easier to convince innocent children not just through fear, but also attracting them with gifts. After the crime, subduing their voice using threats is less challenging than for adults. Anthropologist Suresh Dhakal says children are more distanced from their families these days, and the education system also does not teach children to protect themselves in risky situations. Crimes against children are common in war-torn states, and where the social and state structures need to be rebuilt after conflict. Nepal’s own insurgency institutionalised impunity, which is directly reflected in the increased crime rates. The Nirmala Panta rape and murder case is a case study in the ineffectiveness of law enforcement.With poverty and extreme physical pressures, there have been instances of mothers killing their own children. Taplejung’s Kamala BK drowned her one-year old twin daughters in a toilet in July. In July, a 13-year-old was found with prohibited drugs in Tanahun. In Rupandehi, a 14-year old boy lured a 7-year old girl into his room with chocolates and raped her. Born in Khandbari in eastern Nepal, Parashuram Pathak helped his family around the farm, sold what they grew in the market and lent a hand in the kitchen.&nbsp; After working as a chef in Dubai, San Francisco, Denmark, Australia, and on cruise ships, Pathak has now brought back what he has learnt to the Tusa Restaurant in Bhaktapur that opened on Nepali New Year on 13 April. Tusa uses fresh indigenous ingredients from various parts of Nepal, and fuses them with international methods to produce unique dishes. Pathak is a global Nepali, and is introducing global Nepali cuisine to his homeland. Pathak left an executive chef job to intern at three-Michelin-starred Noma in Denmark, named the best restaurant in the world five times. Noma runs on a philosophy of foraging to rediscover wild local ingredients, and Tusa’s mission is similarly noble: preparing dishes with Nepali ingredients using modern techniques and equipment. “We are taking Nepali food beyond dal-bhat and momo, we are taking it international,” Pathak said on the phone from Sydney. The three realised they shared the same dream, and over the past five years have travelled across Nepal to research their menu, collecting ingredients and ideas from homestays, food carts, and nature. The team then scouted for Nepal’s best architect, and zeroed in on Bhaktapur-based heritage conservationist Rabindra Puri who designed the Malla-era house for Tusa in the Nag Pokhari neighbourhood. Tusa can seat 28, and dining here is a sensory experience with a live kitchen. The chefs cook and place dishes on a large granite countertop with induction sections built in. Behind the counter is a grill on an indoor fire with pulley control to adjust the fire. Everything that can be made in Nepal — chairs and tables, ceramic dishes, the grill — is locally sourced. The executive kitchen/laboratory is downstairs. It is spacious, spotless, and contains appliances rarely seen in restaurants here: a sous vide machine that cooks vacuum-sealed packets at consistent temperatures, and a dehydrator for sisnu nettles. A fresh batch of deep purple kimbu (mulberry) muffins has just come out of the oven. Fridges have dry-aged fish and marigold kombucha. The restaurant serves a tasting menu with six courses, plus surprises. It starts with a fermented potato and millet roti with charred green garlic and tomato chutney. The bread tastes like a mix of alu paratha and kodoko roti with a satisfying, mild flavour. The chefs do not show off, and overdo it. Dishes are tastefully simple and faithful, a theme that runs through the meal. The second course is a filet of fish charred on one side and placed in a broth. It is delicate and smokey, and does not mask the character of the fish.&nbsp; The next is Batuk Chukauni, a Magar dish with a lentil snack and a yoghurt-based potato achar. The batuk, made of lentil batter, is light and the chukauni has potatoes and peas. Photo: VISHAD ONTA</figcaption> </figure>  Next is a skewer of jackfruit with a tamarind and mustard glaze that has the texture of a slice of sausage and melts in the mouth. Then comes the first off-menu item: a steak of watermelon, glazed and grilled, tasting sweet, sour and smokey. After that a palate cleanser sorbet made with laligurans syrup adorned with a frozen candied rhododendron petal. Finally the main course: barbeque chicken and chyakla coarse corn grits. The chicken has been brined, marinated, cooked sous-vide and seared on the grill. The delicate consistency of the chicken stands out. Desert is a smooth, creamy cheesecake that uses the local juju-dhau yoghurt. And the last course is a moist, moss-green sisnu cake laced with mulberry jam and cream.&nbsp; There is nothing gimmicky about Tusa. It is the coming together of skilled Nepalis with international exposure who have mixed what they have learnt abroad with the flavours of home.&nbsp; The tasting menu is Rs3,500, and it may take some time before Nepalis develop a predilection for some of its items. The chefs are excited, vindicated, and relieved. Coming back to Nepal, uprooting successful careers abroad to take a chance on Nepal must not have been easy.&nbsp; Tusa had a soft launch on New Year’s day with Kathmandu-based diplomats. Australian Ambassador Felicity Volk was one of them, and wrote on a Facebook post: ‘Chefs who honed their skills in Australia and returned to Nepal to give back. The return of the natives

For a year or two after the 25 April 2015 earthquake, the residents of Kathmandu were too terrified to return to their high-rise apartments. None of them collapsed in the 7.8 disaster, but many sustained serious structural damage. &nbsp;
Fast forward nine years, and they have all but forgotten that frightful day. Kathmandu is back to building substandard structures, even as land prices drive developers to build taller.&nbsp;
With no more space to spread horizontally, Kathmandu is going vertical. But structural engineers say most of the high rises do not take into account seismicity, soil condition, construction methods, quality of raw materials, fire hazard, and search and rescue in collapsed concrete structures.
“Much of our focus since the 2015 earthquake has been on building and construction, but not as much on where we are building,” warns Sangeeta Singh, Professor of Urban Planning and Deputy Director of Centre for Disaster Studies at the Institute of Engineering.

She adds: “Kathmandu is not really suited for high-rises. We have to first test the condition of the soil, but building permits are being issued without this fundamental step.”
Kathmandu Valley is a former lakebed with soft topsoil prone to liquefaction and excessive shaking, as seen during the 1934 megaquake. Many ruptures tore up the surface in 2015. &nbsp;
During an earthquake, the rock layers below Kathmandu ring like a bell and the vibrations on the surface take between 0.5 to 2 seconds for one oscillation. Buildings also vibrate, but at different frequencies depending on their height, construction material, and arrangement of their structural components.
At five floors, the vibration period of a building is 0.5 seconds, which is the same as that for Kathmandu Valley, and this could cause more damage, says structural engineer Surya Narayan Shrestha at the National Society for Earthquake Technology - Nepal (NSET).
“Building anything that is five storeys or higher in Kathmandu needs special design and structural considerations,” says Shrestha.

Technologies exist to reduce seismic risk in high-rises, and these are used in earthquake-prone cities like Tokyo, Los Angeles, Jakarta or Mexico City.&nbsp;
Base isolation, for example, separates the vibration of the land and the building, reducing damage from soil-building resonance. Base isolators move and stretch under pressure, absorbing much of an earthquake's impact by reducing swaying and shaking. &nbsp;
Seismic dampers change the pattern of vibration altogether, dissipating energy as vibrations move across a structure. But these are all expensive technologies, and none of the high-rises in Kathmandu use them.
However, Nepali engineers who can help with technology transfer are working in the field in Nepal and overseas. Kathmandu’s high-rises are already very expensive, and making them seismic-resistant would be an incremental cost.

The shape of high-rises also matters. Reinforced concrete buildings with asymmetric designs of the kind that are seen in newer structures in Kathmandu experience more torsion and shear during quakes. High-rises with regular geometry are stronger. &nbsp;&nbsp;
An even bigger concern is that of emergency evacuation and rescue in case of fire or earthquake. Kathmandu fire services do not have ladders that reach the higher floors of most new structures.
“High-rises mean more people and potentially higher casualties,” explains Shrestha. “We need immediate evacuation routes, fire escapes, emergency ladders, and fire trucks that can reach higher. Right now, safety features are voluntary and not mandatory.”
The street access, shelters, open spaces, and evacuation routes are integral to disaster preparedness and the safety of neighbourhoods and not just buildings. Most new high-rises in Kathmandu have narrow access roads.

Since most of the buildings that survived the 2015 disaster were reinforced concrete structures, it fed the misconception that they are safer. But Himalayan seismologists say that if the intensity and duration of the shaking had been just a little higher, many substandard concrete structures would have collapsed.&nbsp;
And that is the final gap: Nepal’s limited expertise and equipment for search and rescue inside collapsed concrete structures. Kathmandu’s high-rises need to be better prepared for the next Big One.
“Structural safety and design were at the front and the centre after the 2015 earthquake, we also revised some building codes but we are back to square one with contractor-driven construction, especially in peri-urban areas,” says Sangeeta Singh, who is also with the National Planning Commission. “We need to monitor construction as much as design.”&nbsp;
Shrestha at NSET agrees there have been improvements in building practices in the past nine years, but adds, “We have both learnt and unlearnt lessons from 2015. The awareness hasn’t yet translated into action on safety.”

The rise of high-rises

Midway along the stretch of the ancient trade route between Tibet and India lies the Kel Tol neighbourhood. The name is derived from the original Koligrām, and it is believed the Koli people, who were originally from Rāmagrām in present-day southern Nepal near the Indian border, settled here. The Koli were the maternal ancestors of none other than the Buddha. Kel Tol is famous for the Buddhist monastic complex of Kanak Chaitya Mahāvihar, featuring the majestic two-tiered gilded temple of the white god Karunāmaya.&nbsp; This elaborately decorated courtyard is a bustling centre of the Vajrayāna sect of Buddhism, practised widely by the indigenous Newā people of Kathmandu Valley. Karunāmaya, also known as Ārya Avalokiteshwor, is defined in great detail in the 1st century CE Buddhist text Sadharmapundarikā where he liberates all sentient beings from suffering. He helps rid the eight external fears metaphorically equated with their equivalent internal states of mind: lions (pride), wild elephants (ignorance), fire (anger), snakes (jealousy), floods (attachment), imprisonment (miserliness), thieves (wrong views) and cannibals (doubt).  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20240418130432_fe370cbee75003cd3eb5dccc7c3b2671630da193b0744db2aeac1bab3ff4a85c.jpg" data-media-id="editor_0" data-image-id="20240418130432_fe370cbee75003cd3eb5dccc7c3b2671630da193b0744db2aeac1bab3ff4a85c" data-rendition-name="original" width="1338" height="2000" loading="lazy" alt="Seto Machhindranath"> </figure>  In the Pancha Rakshyā Sutra, a Buddhist scripture from 200 CE, Ārya Avalokiteshwor was counted among the eight major deities. Followers of the Brāhminical god Shiva worship Ārya Avalokiteshwor as Seto Machhindranāth. For Shaivites, Machhindranāth is the Indian saint who founded the Nāth cult in the 10th century CE. He is the guru of saint Gorakhnāth. During the reign of Yakshya Malla (1428–1482 CE), a beautiful image of Ārya Avalokiteshwor was dug up by a farmer in present-day Jamal, which was then a cultivated area outside the city. The farmer, known as a Jamami (meaning the one from Jamal) took the image home for safekeeping. That night, Ārya Avalokiteshwor appeared in the farmer’s dream and told him that the proper place for him to reside is at the confluence of two rivers. The nearest confluence was at present-day Wongha (Indrachok) and the image was installed in the Kanak Chaitya Mahāvihar complex in Kel Tol near Wongha. This made it easier for city residents to pay homage to Ārya Avalokiteshwor and spread compassion. Soon, the deity came to be revered highly as Jamaleshwor, the one found in Jamal. Eventually, the name got corrupted, as happens often in Nepāl Bhāsā, to Janabahā Dyo. The courtyard where his temple is located is now popularly known as Janabahā.  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20240418130432_5c9b219530e400445ef4e7f64856b43e7cdb756be26d9ed4565c84044c178a7e.jpg" data-media-id="editor_1" data-image-id="20240418130432_5c9b219530e400445ef4e7f64856b43e7cdb756be26d9ed4565c84044c178a7e" data-rendition-name="original" width="2500" height="1668" loading="lazy" alt="Seto Machhindranath"> </figure>  The gilded temple of Janabahā Dyo, first built in the early 16th century CE, is adorned with wooden and metal artefacts that symbolise 108 forms of Ārya Avalokiteshwor. It stands out as the most decorated temple of its kind in Kathmandu. Today, Janabahā is a living heritage site where many ancient customs and rituals are widely practised as per Vajrayāna Buddhist tradition. Devotees throng the Janabahā Dyo shrine for daily worship and to receive Karunāmaya’s blessings. Being the compassionate one, Ārya Avalokiteshwor goes around town every year in his tall wooden chariot to allow sick and physically disabled devotees to pay homage to him from the comfort of their homes. One could say it is a door-to-door visit by the Compassionate One.&nbsp; For the pragmatic minded, the chariot festival is an annual renewal of communal harmony, validation of our ancient mathematical supremacy and demonstration of the need to keep practical skills alive, including the craft of building earthquake resilient houses.  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20240418130432_fc8b234ceca87dee4b99e897a485cef121fb953857fb61492a413fbfcc48360c.jpg" data-media-id="editor_2" data-image-id="20240418130432_fc8b234ceca87dee4b99e897a485cef121fb953857fb61492a413fbfcc48360c" data-rendition-name="original" width="2500" height="1667" loading="lazy" alt="Seto Machhindranath"> </figure>  The Janabahā Dyo chariot is pulled from Jamal, where his image was found by the farmer, through the historic heart of Kathmandu in a gala parade every year. The procession, accompanied by folk music ensembles and revellers, starts on the eighth day of the bright half of the month of Chaitra, and lasts up to a week (ending on Saturday this year). Hundreds of devotees pull the chariot along the streets as a way of expressing their gratitude to lord Karunāmaya for blessing them with compassion and well-being. Purna Ratna Vajrāchārya is an ordained priest who belongs to the clan responsible for taking care of Janabahā Dyo. He has been studying the design and architecture of the chariot for the past 40 years, and overseeing its construction for the past 15. He has learnt that the engineering principles of building the chariot are based on the mathematical system in which Buddhism is taught. For example, 365 pieces of wood are used in the chariot, each representing a day of the year. Each of the four wheels consist of 25 pieces of wood, totalling 100, representing completeness or fulfilment. The height and length of the chariot is 32 arm’s length (hāt in Sanskrit), 14.8m. The number 32 represents the maximum number of auspicious and physical qualities one could possess to be considered an outstanding human being.&nbsp; Says Vajrācharya, “Observing how the chariot is built helps one learn the fundamental pillars of the Buddha’s teachings, and find an easier path to Nirvana.” The structural design of the nearly 15m wooden chariot is not only awe-inspiring but also gravity-defying. It leverages the pliancy of the materials used in its construction -- flexible joints tied with cane soaked in water for several days. But this has been achieved year after year, despite the fact that the devotees who tug wildly at the ropes lassoed to the two front wheels, are most likely in high-spirits (pun intended). Sanjay Manandhar, a US-based technology entrepreneur, recounts how his high school physics teacher from Canada asked his students to go observe the locals build the chariots of Karunāmaya if they were interested in becoming engineers in the future.&nbsp; “That made no sense to me then, but, after all these decades, I now see clearly how the structural design of the chariot, adopted early on by our ancestors is full of earthquake-resilient properties that need to be applied in building houses in an earthquake-prone zone like Nepal,” says Manandhar. A highlight of the chariot festival is that human goddess Kumari makes an appearance at the final destination in Lagan, usually on the third day. For close to four centuries, the construction of the chariot and its operation has proven to be a phenomenal engineering feat, and the people’s faith in divinity means the tradition is alive.&nbsp; The essence of the colourful rituals and the religious beliefs of this ancient chariot festival is now all but lost. The logic, technology and practicality must be brought back to light, as they reflect the high civilisation and wisdom of our ancestors that we can leverage in modern times and into the future. &nbsp; Alok Tuladhar is a culture and heritage documentarian.

Kathmandu’s gravity-defying chariot festival

In the run-up to the third Nepal Investment Summit this weekend, there have been seminars, conferences and workshops where the discourse has revolved around the economy and the investment climate.
The consensus that Nepal needs foreign direct investments (FDI) to grow was repeated, and the familiar litany of reasons about why it has not been able to was discussed.&nbsp;
Policy advocates and regulators have understood that the lack of urgency is compounded by procedural inconsistencies, on top of the already deficient investment environment in the country.
It is a welcome change from what used to be flippantly accepting matters as given. There now seems to be a sense of urgency, with procedural inconsistencies and lack of harmonisation between various Acts and regulations openly discussed.&nbsp;
Government stakeholders also appear more willing to learn and attempt to be part of the solution. Whatever policy changes have been introduced in the past have been piecemeal and address the few rather than the entire industry. This left dual regulatory approaches aimed at similar players.&nbsp;

This time, unlike in the past two Summits, the government seems to be committed to amending 9 Acts, a positive step towards showing commitment to change. However, the deadline to do so during the winter session of Parliament is over. The option mooted has been to have it passed through ordinance, a lesser appealing step; albeit, a positive one moving forward.&nbsp;
To attract FDI in a competitive global market means that Nepal has to demonstrate that it is serious about bringing in investments with a more consultative and collaborative approach with investors. A departure from procedural to a result-oriented focus is needed.&nbsp;
To put issues in perspective, Nepal needs US$20 billion in investments to meet the UN’s Sustainable Development Goals (SDG) targets by 2030. If net-zero decarbonisation targets are to be met by 2045, another US$7 billion will be required annually.&nbsp;
Looking at our investment history and poor government capital expenditure, the gap is long and wide. In fiscal year 2022-23 Nepal booked a lamentable ~$59 million in FDI (equity). Nepal is in fact the lowest market in South Asia for FDI with 0.3% of the regional average.&nbsp;
What is it that we can do to fill the gap?&nbsp;
First, we need to move away from the notion that Nepal only needs large investments. This has proven to be a mistake, and time series data have proven that smaller investments, in aggregate, make a larger impact on economies.&nbsp;

We talk about an ‘enabling environment’ but without the right tools. We place restrictions on interest on debt ceiling (SOFR +5.5), without risk premium adjustments, we do not have an active secondary market for bond trading, nor do we have a yield curve, an integral part of the bond market, which is inhibiting us from tapping into the trillion dollar green bond market.&nbsp;
In order to attract green financing, Nepal needs to develop its bond market. Sovereign risk rating has been mooted and was expected to be operationalised before the Investment Summit.&nbsp;
However, to be rated in an adverse economic environment could further deteriorate investment potential due to a lesser-than-expected rating.&nbsp;
Hedging is another instrument that needs further research on. A commercial bank last year showcased the first risk-hedging mechanism for an investment of $8 million. This can be the beginning to expand on its modality. &nbsp;
Subordinated debt instruments have been introduced, but on a special nod basis, this now needs to be institutionalised as it is the most applicable form of investment after equity in a market that has volatile forex reserves.&nbsp;

Viability Gap Funding has been introduced by multilateral development agencies implemented in solar installations. It is a tool to incentivise the private sector to invest in projects that are not financially lucrative initially, but have potential for profitability in the long run. This needs to be scaled up and replicated in sectors like infrastructure, where returns may not be immediate.
Moving forward, to attract FDI, Nepal needs to tap into the funds that are available for the growth of small and medium enterprises (SMEs) and climate change. Alternative investments such as Private Equity Venture Capital (PEVC) have been around in a structured manner in Nepal for nearly a decade now.
These funds have blended finance components and have attracted climate funding as well. PEVC is a new asset class and can address the issues of penetrating into SME financing by incorporating environment, social and governance issues into their investment process.&nbsp;
SMEs are the backbone of any economy, PEVC comes with the ability not only to scale up the enterprise with risk capital, but with the ability to bring technical knowhow to enhance not only the enterprise but also the entrepreneur.&nbsp;

A differentiator from all other forms of financing available till date in Nepal. Blended finance is a way of de-risking investments, especially in frontier markets. Business Oxygen (BO2) is an example of blended finance with subordinated debt investments of IFC (World Bank Group) taking the lead and Climate Investment Funds along with FCDO as co-investors.&nbsp;
On a larger scale, the 216MW Upper Trisuli 1 is another example of blended finance with IFC, a Korean consortium and local investments. So far, we see that development finance Institutions have been taking the lead in Nepal as their risk appetite is greater than commercial investors and they are eager to help develop the financial markets.&nbsp;
In order to be sustainable, we need to step on this and attract commercial capital from all over the world. To do this there has to be political will to make that pivot.&nbsp;
Instead of being a means to an end, the two previous Investment Summits turned out to be intermittent and cosmetic, providing hardly any results. The third one’s success will depend on how the event will be implemented as a platform for continuous marketing for the country and facilitation for investors in future.&nbsp;
Nepal has outdone many countries in its macro-economic indicators, with sound forex reserves and a stellar history of debt payments to its creditors. This story needs to be propagated along with the drive for change to attract potential investors.
