Oxygen</h2> To save lives, Nepal’s most urgent need now is oxygen. Not just cylinders, but oxygen generators, concentrators and liquid oxygen. Most infected people are not succumbing to Covid-19, they are <a href="https://www.nepalitimes.com/here-now/helping-nepalis-breathe-again/" target="_blank" rel="noopener noreferrer">dying because of low oxygen saturation</a> in the blood, and lack of hospital beds -- patients who need not have died of coronavirus. Dire as the situation is in the cities, Nepal’s pandemic has now <a href="https://www.nepalitimes.com/editorial/nepals-humanitarian-emergency/" target="_blank" rel="noopener noreferrer">infiltrated the remotest villages</a> where there is no hospital care and no oxygen. The virus is preying on people already suffering malnutrition, previous ailments, and decades of structural state neglect. In Rolpa, Humla and other remote districts, between 80-90% of PCR tests are coming back positive, and it takes a week to get results. Patients are either not isolating, or not following precautions.Kathmandu's doctor-to-patient ratio is 1:850, but in rural Nepal it is one doctor for every 15,000 people, and hospitals and medical staff there <a href="https://www.nepalitimes.com/here-now/at-the-covid-19-frontlines-in-rural-nepal/" target="_blank" rel="noopener noreferrer">are already overstretched</a>.Close to 60% of all swabs collected nationwide are from Bagmati Province, with nearly half of them in Kathmandu Valley, says epidemiologist Lhamu Yangchen Sherpa. She adds: “There just aren’t enough tests and contact tracing is minimal, official total cases and fatalities are grossly underestimated.” <figure><img width="1497" height="746" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109111148/636b85a39c7e80680e067805jpeg.jpg" alt=""><figcaption> </figcaption></figure><figure><img width="984" height="519" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109111148/636b85a69c7e80680e067806jpeg.jpg" alt=""><figcaption> </figcaption></figure>Hospitals in Kathmandu Valley with roof helipads have multiple daily rescue flights, but even these facilities are <a href="https://www.nepalitimes.com/banner/we-knew-the-tsunami-was-approaching/" target="_blank" rel="noopener noreferrer">at breaking point</a> with patients being turned away. Understaffed and under-equipped hospitals in the districts do not stand a chance. Even where hospitals exist, many families avoid them for fear of being infected and take wrong medication from pharmacies.Case in point are recent deaths due to misdiagnosis across the country. <a href="https://www.nepalitimes.com/banner/a-shot-in-the-arm-for-vaccines-in-nepal/" target="_blank" rel="noopener noreferrer">Typhoid disease</a> simulates Covid-19 with similar symptoms, and the widespread Widal test is known to give false positives.“Covid patients are being prescribed antibiotics to fight typhoid, only to turn critically ill in a few days’ time,” says Buddha Basnyat of Patan Academy of Health Sciences. “This is the reason behind some of the latest Covid fatalities.” <figure><img width="1280" height="720" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109111148/636b85a89c7e80680e067807jpeg.jpg" alt=""><figcaption> </figcaption></figure>As in India, Nepal is beginning to see a slight bending of the curve for new infections, but health experts expect the fatality rate to remain high for some more time.  There were 190 Covid deaths in the past 24 hours and 6,543 recoveries. Of the total 8,305 new cases on Thursday, Kathmandu Valley accounts for 3,232 infections. 7,814 people are undergoing treatment in hospitals with 1,748 in ICU and 492 in ventilator support. “After the relentless patient pressure of the past month, we have seen a decline in those requiring admissions,” says virologist at Teku hospital Sher Bahadur Pun. “The virus has now infected a majority of people in the cities, and this combined with the lockdown means we may be getting to the halfway mark of the second wave.” <h2>2. Vaccines</h2> A prolonged lockdown is not the answer. If it was, the <a href="https://www.nepalitimes.com/latest/covid-19-numbers-slightly-down-in-nepal/" target="_blank" rel="noopener noreferrer">reduction in the number of cases and the positivity rate</a> this week would have been steeper. Even while the government tries to increase oxygen supply to hospitals, the only long-term strategy is to vaccinate at least 70% of Nepal’s eligible population.Doctors report a marked difference between the recovery of people who are vaccinated against those who are not. Says virologist Pun at Teku Hospital: “Except for a few rare cases, all patients in critical condition and those dying are the ones who for one reason or another had not been vaccinated.”But Nepal has run out of its vaccine stock, leaving 1.4 million people still waiting for their second dose of AstraZeneca Covishield in a lurch, after India banned its export, and the COVAX Facility could not supply its remaining 1.8 million vaccines to Nepal because of the global supply bottleneck.  <figure><img width="1440" height="1080" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109111148/636b85ac9c7e80680e067808jpeg.jpg" alt=""><figcaption> </figcaption></figure>The Nepal government and pressure groups in Nepal and the United States <a href="https://www.nepalitimes.com/here-now/nepal-needs-urgent-american-vaccine-support/" target="_blank" rel="noopener noreferrer">have strongly urged the Biden administration</a> to immediately rush some of its AstraZeneca doses to Nepal.Meanwhile, the UK, the US and Canada have authorised vaccines for use in children and adolescents, sparking outrage in the global public health community for prioritising an age group that is rarely critically affected by Covid-19. The World Health Organisation’s director-general Tedros Adhanom Ghebreyesus has urged rich countries to instead donate doses to the <a href="https://www.nepalitimes.com/latest/unicef-urges-g7-to-dispatch-vaccines/" target="_blank" rel="noopener noreferrer">COVAX Facility</a> for poorer states that have barely covered health workers and the most vulnerable groups. Speaking at the British Parliament last week, noted vaccinologist and the principal researcher of Oxford University’s AstraZeneca vaccine, Andrew Pollard, called the decision to inoculate children in wealthy nations ahead of high-risk groups in poorer countries “morally wrong.” Pollard has worked extensively in the region, leading research into the burden and transmission of typhoid in Nepal, Bangladesh and Malawi, and the impact of typhoid vaccine in these areas. He also runs surveillance for invasive bacterial diseases, and studies the impact of pneumococcal vaccines in children in Nepal.In Nepal, vaccination will grind to a halt this week after the current campaign to inoculate 300,000 people in the 18-59 age group with their second dose of the Chinese VeroCell ends.  <figure><img width="960" height="640" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109111148/636b85af9c7e80680e067809jpeg.jpg" alt=""><figcaption> </figcaption></figure><img width="960" height="640" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109111148/636b85b29c7e80680e06780ajpeg.jpg" alt=""><img width="960" height="639" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109111148/636b85b49c7e80680e06780bjpeg.jpg" alt="">Although <a href="https://www.nepalitimes.com/here-now/nepal-is-a-priority-for-vaccine-shipments/" target="_blank" rel="noopener noreferrer">Foreign Minister Pradeep Gyawali says</a> the government is in “final negotiations” for 2 million doses of Sinopharm VeroCell vaccines by June, there is no movement at the Ministry of Health. Ongoing talks to procure 8 million doses of <a href="https://www.nepalitimes.com/opinion/vaccine-geo-politics-and-sputnik-v/" target="_blank" rel="noopener noreferrer">the Sputnik V</a> have hit a production capacity snag in Russia. “We can implement lockdowns only for so long, the only exit strategy is vaccines. Science delivered, now our politicians must do the same,” says Buddha Basnyat, a physical at the Patan Academy of Health Sciences. “The Nepal government must procure vaccines using every diplomatic channel possible, and rich countries must realise that they are not safe until countries like Nepal are also vaccinated.” Activists have been trying to convince <a href="https://www.nepalitimes.com/latest/leading-public-figures-call-on-uk-government-for-oxygen-for-nepal/" target="_blank" rel="noopener noreferrer">the US government and Europeans</a> that Nepal has a lot of experience in successful vaccination campaigns against polio, smallpox, measles. It has over 50,000 female community health volunteers (FCHVs) reaching children with vaccines every year.  <figure><img width="1024" height="768" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109111148/636b85b79c7e80680e06780cjpeg.jpg" alt=""><figcaption> </figcaption></figure><img width="2048" height="943" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109111148/636b85ba9c7e80680e06780djpeg.jpg" alt=""><img width="1920" height="864" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221109111148/636b85bd9c7e80680e06780ejpeg.jpg" alt="">Similarly, Nepal’s health system has amassed vast experience in maintaining the vaccine cold chain even in the remote mountains. It also has trained human resource overseeing DOTS (Directly Observed Therapy, Short-course) for tuberculosis management all over the country who can lend a hand in equitable distribution of vaccines in <a href="https://www.nepalitimes.com/latest/rural-nepal-fights-back-covid-19/" target="_blank" rel="noopener noreferrer">rural Nepal</a>.Says epidemiologist Lhamo Yangchen Sherpa: “It’s not too late, we can still use existing resources like FCHVs to better mobilise vaccination, conduct contact tracing, dispel any remaining vaccine hesitancy, and use public health professionals in prevention.”

Photo: BIKRAM RAI</figcaption>												Families of the <a href="http://archive.nepalitimes.com/blogs/thebrief/2016/06/23/lives-of-our-brothers/" data-saferedirecturl="https://www.google.com/url?q=http://archive.nepalitimes.com/blogs/thebrief/2016/06/23/lives-of-our-brothers/&amp;source=gmail&amp;ust=1601896207881000&amp;usg=AFQjCNFN7I5wvC7gnbdfZyt5m3-uYxaQVA">13 Nepali security guards</a> killed in a Taliban attack on the Canadian Embassy in Kabul in 2016 and the Canadian government which <a href="https://www.nepalitimes.com/latest/nepali-guards-sue-canada-government/" data-saferedirecturl="https://www.google.com/url?q=https://www.nepalitimes.com/latest/nepali-guards-sue-canada-government/&amp;source=gmail&amp;ust=1601896207881000&amp;usg=AFQjCNH6kEYoleH4UbvpmvfHfm_7jjcGdg">they had sued</a>, have come to a court settlement on compensation.  The case was filed in 2018 at the Ontario Superior Court of Justice in Toronto by five Nepali soldiers wounded in the attack and 13 widows of those killed for $20.4 million in compensation.They alleged that Sabre International, the security company that had been hired by the Canadian government to guard the embassy, had provided an <a href="https://archive.nepalitimes.com/regular-columns/GUEST-COLUMN/nepali-guards-kabul-bombing,748" data-saferedirecturl="https://www.google.com/url?q=https://archive.nepalitimes.com/regular-columns/GUEST-COLUMN/nepali-guards-kabul-bombing,748&amp;source=gmail&amp;ust=1601896207881000&amp;usg=AFQjCNGvNP__8VoLQFFywVBL8AjGAQ4oIg">unacceptably low compensation</a> to some of the families before closing the shop.After the attack, Sabre International terminated its contract with the Canadian embassy, and shut down all its contact offices in Afghanistan and in Nepal. Sabre is no longer operating, and a legal notice is yet to be served to it.The lawsuit was filed on the eve of the second anniversary of the Kabul attack. On 20 June 2016, 13 Nepali guards were killed and five injured when they were travelling to the Canadian embassy on an unarmored bus. A lone suicide bomber blew the bus.The Vancouver-based Canadian lawyer for the plaintiffs, Joe Fiorente confirmed to Canadian Broadcasting that a settlement had been reached, but he refused to provide further details because of possible implications for the families in Nepal.     "I can tell you the families were satisfied with the settlement and that they are confident the Government of Canada <a href="http://archive.nepalitimes.com/blogs/thebrief/2016/07/08/10405/" data-saferedirecturl="https://www.google.com/url?q=http://archive.nepalitimes.com/blogs/thebrief/2016/07/08/10405/&amp;source=gmail&amp;ust=1601896207881000&amp;usg=AFQjCNGSvAqPLPbFO4emkfgBmi5lRXSpIw">has recognised the sacrifice</a> and service of those gentlemen who were protecting our embassy in Kabul at the time of the bombing," Fiorante told CBC News.The families had first filed a case against Ottawa and Sabre International, and were promised $300,000 which never materialised.The slain Nepali guards lived in dorms away from the embassy, and used to make a risky journey by bus to their duty station every day following the same route. The plaintiffs have asked the Canada government what measures it had taken to protect the Nepalis guarding its people and property in Kabul.There are still about 9,000 Nepali security guards employed in Afghanistan according to official records, but the number is said to be much higher. The deaths of the Nepalis also exposed how <a href="http://archive.nepalitimes.com/blogs/thebrief/2016/06/21/nepal-mp-slams-canada/" data-saferedirecturl="https://www.google.com/url?q=http://archive.nepalitimes.com/blogs/thebrief/2016/06/21/nepal-mp-slams-canada/&amp;source=gmail&amp;ust=1601896207881000&amp;usg=AFQjCNFG6mo_owRrLe6KzzO-LV4ycZk1jw">desperate Nepalis</a> sought employment in some of the <a href="https://www.nepalitimes.com/here-now/canada-and-nepal-want-to-up-trade-tourism-and-investment/" data-saferedirecturl="https://www.google.com/url?q=https://www.nepalitimes.com/here-now/canada-and-nepal-want-to-up-trade-tourism-and-investment/&amp;source=gmail&amp;ust=1601896207881000&amp;usg=AFQjCNFruYiC0kjAkXUPo6z8lrunZqCpYg">riskiest war zones in the world</a>, and were not sufficiently protected with insurance and compensation.

Canada settlement with families of Nepali guards

The couple talked regularly over the internet, exchanging sexually suggestive messages and intimate pictures. Rama was blindsided when she found out months later that those pictures and conversations had been sent to her relatives’ phones from fake accounts on <a href="https://www.nepalitimes.com/banner/facebook-nation/" target="_blank" rel="noopener">Facebook</a> and as links to pornographic websites.Asmita, a 12-grader from Lalitpur, had been talking to Facebook user Sanjiv. The two had never met face to face. At Sanjiv’s request, she had sent him a nude picture of herself, but one picture did not suffice. He began blackmailing Asmita for videos, threatening to leak her picture unless she complied. Her picture ended up on porn sites, which put her under extreme mental stress.Thirteen-year-old Rabina from Dhankuta was sent a nude picture with her face morphed onto it by someone she had been talking to on Facebook. She was then coerced into sending back similar pictures of herself. She was asked also to show her genitals to the camera. Later, she was told that nude pictures of her would be made public if she did not pay $5,000.All four women went to the Nepal Police, who tracked down Raju’s address in Sydney, and in Asmita's, Rabina’s and Rekha's cases traced the Internet Protocol (IP) addresses of the offending Facebook users to Bangladesh, India and Canada respectively. In all four cases the police contacted law enforcement and perpetrators, but failed to get a response. The suspects were never caught.<a href="https://archive.nepalitimes.com/article/Nepali-Times-Buzz/swipe-right-for-extortion-online-safety,4133" target="_blank" rel="noopener">Extortion,</a> blackmail and illegal sharing of private images and videos on social media as well as the sale of such visual content to porn sites have become more prevalent as the number of Facebook users in Nepal approaches 9 million. The lack of media literacy in the population means most young people are unfamiliar with privacy settings, and naive about sharing personal images. This leaves them vulnerable to sexual predators not just from their immediate environments but from all over the world.Experts say Nepal’s cybersecurity policies and laws like the <a href="http://archive.nepalitimes.com/blogs/thebrief/page/99/" target="_blank" rel="noopener">Electronic Transaction Act 2007</a> are not applicable in the context of cyberspace at present. However, Rishiram Tiwari, joint secretary at the Ministry of Information, claims that the draft Information and Technology Bill addresses cyber-related concerns that the Electronic Transaction Act failed to.For its part, the National Cyber Security Policy 2007 does not clearly define laws or have set guidelines for investigating transnational crimes. According to the Metropolitan Crime Division, almost 20% of cybercrime complaints are transnational, and countries like Nepal are hotbeds for extortion, blackmail and breach of privacy.“Social Media Operators and Internet Service Providers who are not based in Nepal are not legally obliged to provide the police with any information,’’ says cyberlaw expert Baburam Aryal. “Because the authorities cannot access important details about the crime, they cannot build an ironclad case.”Police spokesperson DIG Sailesh Thapa Chhetri points out the difficulty of investigating cybercrimes that occur beyond our borders: “The challenge is that we have not been able to coordinate with Interpol due to time constraints and lack of personnel.”Through such coordination, parties involved in transnational crimes are usually brought under investigation through an international letter of request. But the success of this exercise depends on the diplomatic relationship between countries involved. It is possible to seek the extradition of criminals who operate across borders, but this requires bilateral extradition agreements.Advocate Aryal says developed countries use international diplomatic networks to address cross-border cybercrime. In response to the transnational nature of crimes involving cyberspace, the Council of Europe agreed on the Budapest Convention in 2001. The treaty aims to combat cyber-related crime through cooperation while recognising the different legal and technological landscapes across countries. The treaty has been ratified by 64 countries, but Japan and Sri Lanka are the only two countries from Asia to have done so.Advocate Sanjiv Ghimire states that treaties like these will make <a href="http://archive.nepalitimes.com/news.php?id=4937#.XkUZcjIzbIU" target="_blank" rel="noopener">cyber laws</a> less complex and help the international community follow a common legal policy regarding cybercrime. He says: “It is time for Nepal to take the initiative to either make treaties like these or ratify ones that already exist to protect our citizens.”(Some names have been changed.)

Crossborder cybercrime and punishment

They piled them high in the courtyard, and set them alight.A few days later, the boy decided to escape the army’s dragnet and without even returning home he went down to the border, where the Indian security forces were packing other Bhutanese like him into trucks and dumping them in eastern Nepal.Thousands of refugees from Bhutan lived under plastic sheets by the side of the Kankai River in Jhapa. Many fainted from trauma, culture shock and homesickness. He is among the nearly 95,000 refugees from Bhutan who have been resettled in the United States. Others have gone to New Zealand, Norway, UK, Australia, the Netherlands and Canada.Rai opted for resettlement after seeing no possibility of returning to Bhutan, and tried to convince as many of his compatriots as possible to take up the offer. Some were resolutely refusing to move, but he tried to convince them that being a citizen of a foreign country, rather than a refugee, could help them return to Bhutan one day. Many third-generation Bhutanese are now studying in the world’s top universities.Rai has always been interested in music, often taking his small band house-to-house during Dasain and Tihar in Nepal, performing songs of longing for home in Bhutan. Villagers used to give them rice, gundruk and vegetables, which the refugees cooked in the camps by the dusty river banks.“We were always hungry, but we had to eat to live. We missed home, and slept in jute sacks on the sand,” remembers Manoj, who could not even go back to Bhutan when his mother died there. “That is my biggest regret -- that I was not there for my mother. There are many Bhutanese like me.”Manoj came to the US 8 years ago and recorded over 70 songs since then. Ex-refugee takes refuge in music

<img src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/20221108151120/636a65e79c7e80680e059950jpeg.jpg" alt="" width="557" height="438"/>On the morning of 31 October 1954, 29-year-old William J Burke stepped on a red-gold carpet of fallen maple leaves outside his home as he made his way to the nearest port where his family and friends had gathered to bid him farewell on his journey to faraway India.None of them, not even the young easy-going Burke waving from the ship's deck would have guess that he would never return to his native Canada. Or, that he would go on to devote his life to a language few then had heard about – Nepali.Born in 1925, Burke decided to become a Jesuit when he was just 15. Eight years later, he set off to Montreal to study philosophy, graduated and set off for North Bengal, a mission first started by Belgian Christians in 1888.After sailing for seven weeks to Calcutta, and travelling overland, Burke reached Saint Joseph School in Northpoint, Darjeeling a day before Christmas. Within a week he was enrolled for Nepali language classes at St Mary's in Kurseong, and within few months he was teaching Nepali to other students. He also continued his theology lessons and attained priesthood in 1959.Between 1960-61, Burke worked with renowned Hindi language scholar and lexicographer Fr Kamil Bulke, who seems to have inspired in the Canadian priest his passion for Nepali language.Under Bulke’s tutelage, Burke quickly learned Hindi and was able to tutor in Hindi-medium schools. But he felt he lacked the basic knowledge of pedagogy and at the age of 38 went back to school for BEd in Kolkata. By the time he was 55, Burke had also mastered Bengali, and became the principal of Saint Roberts School.In 1990 Burke's desire to work on a Nepali corpus finally took shape, culminating in Sahi Sabda (The Right Word) which later won him the prestigious Madan Puraskar. "We have to address the young generation with the right words so that Nepali culture and language thrive,” said Burke during his acceptance speech in Kathmandu in 2014.In 2006 he published English-Nepali book Ukhaanharu Ajaka ka Nimti (Idioms for Today) in collaboration with P K Chettri. "Even if Burke was not Nepali, he never considered the Nepali language not his own, which is why his work primarily focused bringing life to a language by documenting its usage,” recalls Kamal Regmi, a teacher at St Joseph.Burke is also credited with completing what is now known as the ‘Red Bible’ when Fr Francis Farell died while working on a Nepali catholic bible. The book was published in 1999.Back in the day when the principal of Darjeeling's St Roberts High School Father John Pindergast went to Canada to give talks, the young Burke was responsible for setting up the projector during the lectures. When he was late Pindergast would ask him to set up the slides quickly. "Chito chito" was the first Nepali world Burke learned while still in Canada.The word pretty much sums up his life as well. He learnt languages quickly, and undertook many projects. On 29 November, after a full life, William J Burke has a stroke in Darjeeling and died a few days later at age 94.The Canadian Jesuit was as much a campaigner for the Nepali language as he was a missionary. A true tribute to him would be for the Nepali-speaking world to be inspired by his life.

https://www.youtube.com/watch?v=MZl2VlYpWgI&amp;feature=youtu.beGenerally, it is the nature of Canada and the Canadians to be low-key, and that is how the North American nation’s approach has been to development assistance in Nepal.The first time many Nepalis heard about Nepal and Canada working together was when the <a href="http://archive.nepalitimes.com/article/nation/guarding-guards-afghanitan,3370">Taliban massacred 13 Nepali security personnel</a> guarding the Canadian Embassy in Kabul in 2016.Although Canada has been involved in development assistance in Nepal for the last 50 years through its aid arm, CIDA, or agencies like CECI and IDRC, most Nepalis do not know much about their work. Even though some of the projects have been <a href="https://archive.nepalitimes.com/article/business/critiquing-canadian-aided-projects-in-nepal,1948">criticised for being unsustainable</a>, they have left their mark.For example, it was Canadian assistance that allowed Nepal’s civil aviation sector to graduate from piston-engined DC-3s to STOL turbo-props, which in turned opened up remote area airfields to air travel even before the roads got there.Canada provided the assistance for Royal Nepal Airlines to buy de Havilland Twin Otters and train Nepali pilots. However, much of the cooperation was below the radar, and that concerns Canada’s ambassador to Nepal Nadir Patel. Besides bilateral programs, he says Canada also helps Nepal through the Asian Development Bank, World Bank, or the UN system. “It’s not just about direct bilateral projects, it is about the sum of all initiatives, and Canada’s overall footprint in Nepal which in fact is quite significant,” Patel told Nepali Times in an interview.Canada’s involvement in Nepal has grown since Prime Minsiter K P Oli met his Canadian counterpart Justin Trudeau at the sidelines of the UN General Assembly last year. Canada sent a delegation to the Nepal Investment Summit last month, and one the biggest projects signed was the joint venture between the Chaudhary Group and Toronto-based SkyPower for a 600MW utility scale solar energy farm in Nepal.There are now 70,000 Nepalis settled in Canada, and about 2,000 students are enrolled in Canadian universities. More than 6,500 refugees from Bhutan have been resettled in Canada since 2007. In 2017, 15,000 Canadian tourists visited Nepal, and Deepak Raj Joshi of Nepal Tourism Board says there is a huge untapped potential to promote Nepal as a destination for the Visit Nepal 2020 campaign.Ambassador Patel is also concerned that trade between Canada and Nepal is very low, and points out that since there has not been political and regulatory predictability in Nepal for some time, Canadian companies need to be reassured about investment guarantees.“There is reason to be cautiously optimistic about the business climate with the economic reforms the Nepal government is undertaking,” he said, “but much more work needs to be done to ensure rule of law, governance issues, investment protection.”Patel is on a 10-day trek to Everest Base Camp this week to see for himself the impact of global warming in the Himalaya. Lebel said that although IDRC had been pushing for climate adaptation, its Kathmandu meeting discussed how even developing countries now needed to move towards a low carbon economy. He added: “Carbon mitigation is going to take a lot of amplitude in the coming years, for IDCR this is the next frontier.”

Canada and Nepal want to up trade, tourism and investment

Canada’s federal and provincial governments institutionalised racist legislation that dispossessed indigenous peoples from their lands, tearing children away from their parents, lodging them with white foster parents or shipping them off to assimilationist Indian residential schools where many students died and all were prohibited from speaking their ancestral languages.Until 1952, Canadian legislation prevented indigenous people from turning to the courts for help with government injustices. Only in 1960 did the government grant indigenous people the right to vote in federal elections without losing their treaty rights and ‘Indian’ status. The story of the resilience of indigenous communities across Canada over the last 150 years is one of local endurance and immense perseverance against the very objectives of the nation itself.Yet, over the last few years, Canada has been experiencing an ‘indigenous moment’. Across the country, programs that honour indigenous history and understandings are being rolled out at elementary, secondary and university levels.Overall, Canada’s indigenous communities are in the limelight, albeit in sometimes uncomfortably instrumentalised ways. The bitter irony of the current context is inescapable: colonial governments have for centuries marshalled their economic, military and administrative might to extinguish indigenous peoples. Now, in the eleventh hour, they are looking to strengthen and celebrate the very diversity that they set out to destroy.Why is this happening? The simple answer is that much land and many resources are still legally owned and controlled by indigenous peoples in Canada -- land and resources that the Canadian state is eagerly eyeing to exploit, expropriate and monetise. If Nepal has never been colonised, can it ever be, or does it need to be, de-colonised? This discussion is gathering momentum in the scholarly community. A well-attended panel entitled ‘Decolonising Research in the Himalayas’ at the Association of Nepal and Himalayan Studies Conference hosted by the University of Colorado, Boulder, in September 2017 generated heated, if necessary debate.For most of my indigenous colleagues in Canada, decolonisation is not a metaphor. Rather, it involves implementing tangible, measurable and structural changes in who controls, creates and administers knowledge. Decolonising education and research are about substance not symbol, and necessarily involving a sincere commitment to promoting indigenous voices in the academy and in society.Nepal’s federal restructuring provides a unique opportunity for the state to engage deeply with th<a href="https://www.nepalitimes.com/here-now/hail-to-the-chiefs/" target="_blank" rel="noopener">e needs, goals and dreams of the hundreds of indigenous communities </a>who contribute to this richly diverse nation. Celebrating and promoting inspiring indigenous voices (whether in Canada, Nepal or in other multi-cultural federal democracies) helps make a country stronger, more representative and more just. Do Nepali attitudes need to be decolonised?

A wide-eyed sociology graduate I was aspiring to change the world, though I did not know exactly how.My first job as Resettlement Caseworker changed the trajectory of my life. The first family I was helping were three men from Bhutan, a father and two sons who had arrived in Pittsburgh but needed help to adjust and find work.Now, as a graduate student I came to Nepal to learn more about the people from Bhutan who were my neighbours and friends back in the United States. They were among the 75,000 <a href="https://www.nepalitimes.com/here-now/no-one-to-care-for-doctor-who-cared-for-everyone/" target="_blank" rel="noopener">Nepali-speaking Lhotsampa people</a> forced out by Bhutan’s royal regime and with Indian help sent to Nepal. They were housed in refugee camps for the next 20 years until they started being <a href="http://archive.nepalitimes.com/article/Nepali-Times-Buzz/resettlement-of-Bhutan-refugees-in-United-States,3404" target="_blank" rel="noopener">repatriated to the US</a>, <a href="http://archive.nepalitimes.com/article/nation/Bhutanese-refugees-in-united-kingdom-find-stability,1585" target="_blank" rel="noopener">the UK</a>, Canada, Norway, <a href="http://archive.nepalitimes.com/news.php?id=15045#.W2gmdmaB1TY" target="_blank" rel="noopener">the Netherlands</a>, <a href="http://archive.nepalitimes.com/news.php?id=17868#.Wk3SKlWWbIU" target="_blank" rel="noopener">New Zealand</a> and Australia.<a href="http://archive.nepalitimes.com/article/Nepali-Times-Buzz/camps-for-Bhutanese-refugees-are-emptying-but-some-want-to-return-home,2748" target="_blank" rel="noopener">Over 8,000 refugees still remain in Nepal</a>, mostly in the camps. But <a href="http://archive.nepalitimes.com/blogs/thebrief/2017/02/01/trump-affects-bhutanese-refugees/" target="_blank" rel="noopener">restrictive immigration policies</a> in some of these countries have brought resettlement to a halt for the Bhutanese, some of whom have been living in the camp for nearly three decades. The result: <a href="http://archive.nepalitimes.com/news.php?id=19646" target="_blank" rel="noopener">families have been separated</a>, much in the same way that children were taken away from illegal migrants in the United States. <figure><img width="640" height="445" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/2022110714114/636903199c7e80680e037ca1jpeg.jpg" alt=""><figcaption> </figcaption></figure>Tikaram Rasaily is the elected camp secretary at Beldangi, one of the last remaining refugee centres. He was forced to leave his home in Bhutan when he was five years old, and has very few memories of his home but says: “I feel Bhutan in my heart.” And he wants to return one day.Rasaily’s family is now resettled to the United States. His mother and brother live in Atlanta and his sister in Akron, Ohio. Since going back to Bhutan is likely impossible, he would like to be reunited with his family. But he remains in the camp with his wife and child because his application for family reunification was <a href="http://archive.nepalitimes.com/page/state-of-statelessness-for-refugees-in-nepal" target="_blank" rel="noopener">denied by the United States Department of Human Services and UNHCR</a>.“I was never told why, I have human rights, but no one is allowing me to express them,” he says. <figure><img width="640" height="427" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/2022110714114/6369031c9c7e80680e037ca2jpeg.jpg" alt=""><figcaption> </figcaption></figure>As camp secretary, Rasaily is worried about the funding cuts that will affect fellow-refugees who remain. The UN stipend for refugees is now only Rs650 per person every month in lieu of food rations.The World Food Program (WFP) supplies of oil, sugar, salt and other rations have also been slashed, only rice is distributed. Additionally, education funding for 951 students is being cut and students beginning Grade 5 must get enrolled in Nepali government schools.There are only three options for refugees according to UNHCR guidelines: assimilation in Nepal,  repatriation to Bhutan, or third-country resettlement. Unfortunately, for many of the remaining refugees, none of these options are viable. Nepal has not accepted the 1951 Convention Relating to the Status of Refugees, its 1967 Protocol, nor established a national legal framework concerning refugees and asylum-seekers, and Bhutan refuses to take its people back.Applications for resettlement to a third country have been closed since December 2016. Only those approved for family reunification may travel, though many are still waiting for their departure dates. The only other remaining camp in Sanischare may be closed soon.Meanwhile, Bhutanese outside the camps <a href="http://archive.nepalitimes.com/news.php?id=4842#.W2gm-GaB1TY" target="_blank" rel="noopener">face different challenges. Tek Nath Rizal</a>, 71, the leader of the Bhutanese in forced exile used to be a member of the Royal Advisory Council in Thimphu. He fled to Nepal after being accused of a conspiracy against the King, but Nepal’s royal government kidnapped him from his home in Kathmandu and deported him back to Bhutan in 1989. He was <a href="http://archive.nepalitimes.com/news.php?id=17869" target="_blank" rel="noopener">jailed and tortured</a> for 10 years and named a Prisoner of Conscience by Amnesty International. <figure><img width="640" height="790" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/2022110714114/636903209c7e80680e037ca3jpeg.jpg" alt=""><figcaption> </figcaption></figure><figure><img width="612" height="753" src="https://superdesk-pro-c.s3.amazonaws.com/sd-nepalitimes/2022110714114/636903239c7e80680e037ca4jpeg.jpg" alt=""><figcaption> </figcaption></figure>Rizal now lives in Kathmandu, Nepal, he is not recognised as a refugee by the Nepal government. He has been adamantly opposed to third country resettlement, and wants all Lhotsampa to be allowed to return to Bhutan. He worries that the international community has abandoned the refugees, especially the case of unregistered refugees, family separations, and justice. ”Those who violated our human rights are still in power in Thimphu today, all I want is to bring democracy to Bhutan before I die,” he told us.<a href="https://www.nepalitimes.com/here-now/no-one-to-care-for-doctor-who-cared-for-everyone/" target="_blank" rel="noopener">Bhampa Rai</a> was a royal physician in Bhutan, and did not have to leave his country. But seeing the plight of his compatriots in refugee camps in Nepal, he thought they needed his care more than the royal family. He lived with his wife taking care of sick refugees for nearly three decades. Rai has relatives resettled in Texas, but refuses to go.“I will either return to Bhutan or die here as a refugee,” he says. The UN has tried to convince the couple to return to Bhutan, but Thimphu has repeatedly rejected it.There are many <a href="http://archive.nepalitimes.com/news.php?id=15760#.W2gmBWaB1TY" target="_blank" rel="noopener">Bhutanese I met in the United States</a> and in Nepal who remain positive despite what they have been through for so long. They are still hopeful about justice being served some day, but it may have to be a long wait.

Family separation, Bhutan-style

On 20 June 2016, 13 Nepali guards were killed and five injured when they were travelling to the Canadian embassy on an unarmored bus. The plaintiffs have asked the Canada government what measures it had taken to protect the Nepalis guarding its people and property in Kabul.They have sought $20.4 million in compensation and damages from the Canada government and Sabre International. Widows of the victims and survivors claim that Sabre International owed $300,000 to each of them in compensation, but they have received only a fraction of their dues. They have asked the Canada government to pay the amount yet unpaid by Sabre International.After the Kabul attack, Sabre International terminated its contract with the Canadian embassy, and shut down all its contact offices in Afghanistan as well as in Nepal. Sabre is no longer operating, and a legal notice is yet to be served to it.Canadian lawyer Joe Fiorante, who is representing the Nepali plaintiffs, <a href="https://www.cbc.ca/news/politics/suicide-bombing-gurkhas-lawsuit-1.470887" target="_blank" rel="noopener">has told CBC:</a> "These men died in the service of our country and have basically been cast aside…They were abandoned by our government and we thought that was dishonourable and frankly unacceptable."Also read: <a href="http://archive.nepalitimes.com/blogs/thebrief/2016/06/21/nepal-mp-slams-canada/" target="_blank" rel="noopener">Nepali MP slams Canada</a>

Nepali guards sue Canada government

Turkish Airlines is offering special fares and extra baggage allowance to students travelling from Kathmandu to Europe, USA and Canada via its hub in Istanbul. Born in Khandbari in eastern Nepal, Parashuram Pathak helped his family around the farm, sold what they grew in the market and lent a hand in the kitchen.&nbsp; After working as a chef in Dubai, San Francisco, Denmark, Australia, and on cruise ships, Pathak has now brought back what he has learnt to the Tusa Restaurant in Bhaktapur that opened on Nepali New Year on 13 April. Tusa uses fresh indigenous ingredients from various parts of Nepal, and fuses them with international methods to produce unique dishes. Pathak is a global Nepali, and is introducing global Nepali cuisine to his homeland. Pathak left an executive chef job to intern at three-Michelin-starred Noma in Denmark, named the best restaurant in the world five times. Noma runs on a philosophy of foraging to rediscover wild local ingredients, and Tusa’s mission is similarly noble: preparing dishes with Nepali ingredients using modern techniques and equipment. “We are taking Nepali food beyond dal-bhat and momo, we are taking it international,” Pathak said on the phone from Sydney. The three realised they shared the same dream, and over the past five years have travelled across Nepal to research their menu, collecting ingredients and ideas from homestays, food carts, and nature. The team then scouted for Nepal’s best architect, and zeroed in on Bhaktapur-based heritage conservationist Rabindra Puri who designed the Malla-era house for Tusa in the Nag Pokhari neighbourhood. Tusa can seat 28, and dining here is a sensory experience with a live kitchen. The chefs cook and place dishes on a large granite countertop with induction sections built in. Behind the counter is a grill on an indoor fire with pulley control to adjust the fire. Everything that can be made in Nepal — chairs and tables, ceramic dishes, the grill — is locally sourced. The executive kitchen/laboratory is downstairs. It is spacious, spotless, and contains appliances rarely seen in restaurants here: a sous vide machine that cooks vacuum-sealed packets at consistent temperatures, and a dehydrator for sisnu nettles. A fresh batch of deep purple kimbu (mulberry) muffins has just come out of the oven. Fridges have dry-aged fish and marigold kombucha. The restaurant serves a tasting menu with six courses, plus surprises. It starts with a fermented potato and millet roti with charred green garlic and tomato chutney. The bread tastes like a mix of alu paratha and kodoko roti with a satisfying, mild flavour. The chefs do not show off, and overdo it. Dishes are tastefully simple and faithful, a theme that runs through the meal. The second course is a filet of fish charred on one side and placed in a broth. It is delicate and smokey, and does not mask the character of the fish.&nbsp; The next is Batuk Chukauni, a Magar dish with a lentil snack and a yoghurt-based potato achar. The batuk, made of lentil batter, is light and the chukauni has potatoes and peas. Photo: VISHAD ONTA</figcaption> </figure>  Next is a skewer of jackfruit with a tamarind and mustard glaze that has the texture of a slice of sausage and melts in the mouth. Then comes the first off-menu item: a steak of watermelon, glazed and grilled, tasting sweet, sour and smokey. After that a palate cleanser sorbet made with laligurans syrup adorned with a frozen candied rhododendron petal. Finally the main course: barbeque chicken and chyakla coarse corn grits. The chicken has been brined, marinated, cooked sous-vide and seared on the grill. The delicate consistency of the chicken stands out. Desert is a smooth, creamy cheesecake that uses the local juju-dhau yoghurt. And the last course is a moist, moss-green sisnu cake laced with mulberry jam and cream.&nbsp; There is nothing gimmicky about Tusa. It is the coming together of skilled Nepalis with international exposure who have mixed what they have learnt abroad with the flavours of home.&nbsp; The tasting menu is Rs3,500, and it may take some time before Nepalis develop a predilection for some of its items. The chefs are excited, vindicated, and relieved. Coming back to Nepal, uprooting successful careers abroad to take a chance on Nepal must not have been easy.&nbsp; Tusa had a soft launch on New Year’s day with Kathmandu-based diplomats. Australian Ambassador Felicity Volk was one of them, and wrote on a Facebook post: ‘Chefs who honed their skills in Australia and returned to Nepal to give back. The return of the natives

For a year or two after the 25 April 2015 earthquake, the residents of Kathmandu were too terrified to return to their high-rise apartments. None of them collapsed in the 7.8 disaster, but many sustained serious structural damage. &nbsp;
Fast forward nine years, and they have all but forgotten that frightful day. Kathmandu is back to building substandard structures, even as land prices drive developers to build taller.&nbsp;
With no more space to spread horizontally, Kathmandu is going vertical. But structural engineers say most of the high rises do not take into account seismicity, soil condition, construction methods, quality of raw materials, fire hazard, and search and rescue in collapsed concrete structures.
“Much of our focus since the 2015 earthquake has been on building and construction, but not as much on where we are building,” warns Sangeeta Singh, Professor of Urban Planning and Deputy Director of Centre for Disaster Studies at the Institute of Engineering.

She adds: “Kathmandu is not really suited for high-rises. We have to first test the condition of the soil, but building permits are being issued without this fundamental step.”
Kathmandu Valley is a former lakebed with soft topsoil prone to liquefaction and excessive shaking, as seen during the 1934 megaquake. Many ruptures tore up the surface in 2015. &nbsp;
During an earthquake, the rock layers below Kathmandu ring like a bell and the vibrations on the surface take between 0.5 to 2 seconds for one oscillation. Buildings also vibrate, but at different frequencies depending on their height, construction material, and arrangement of their structural components.
At five floors, the vibration period of a building is 0.5 seconds, which is the same as that for Kathmandu Valley, and this could cause more damage, says structural engineer Surya Narayan Shrestha at the National Society for Earthquake Technology - Nepal (NSET).
“Building anything that is five storeys or higher in Kathmandu needs special design and structural considerations,” says Shrestha.

Technologies exist to reduce seismic risk in high-rises, and these are used in earthquake-prone cities like Tokyo, Los Angeles, Jakarta or Mexico City.&nbsp;
Base isolation, for example, separates the vibration of the land and the building, reducing damage from soil-building resonance. Base isolators move and stretch under pressure, absorbing much of an earthquake's impact by reducing swaying and shaking. &nbsp;
Seismic dampers change the pattern of vibration altogether, dissipating energy as vibrations move across a structure. But these are all expensive technologies, and none of the high-rises in Kathmandu use them.
However, Nepali engineers who can help with technology transfer are working in the field in Nepal and overseas. Kathmandu’s high-rises are already very expensive, and making them seismic-resistant would be an incremental cost.

The shape of high-rises also matters. Reinforced concrete buildings with asymmetric designs of the kind that are seen in newer structures in Kathmandu experience more torsion and shear during quakes. High-rises with regular geometry are stronger. &nbsp;&nbsp;
An even bigger concern is that of emergency evacuation and rescue in case of fire or earthquake. Kathmandu fire services do not have ladders that reach the higher floors of most new structures.
“High-rises mean more people and potentially higher casualties,” explains Shrestha. “We need immediate evacuation routes, fire escapes, emergency ladders, and fire trucks that can reach higher. Right now, safety features are voluntary and not mandatory.”
The street access, shelters, open spaces, and evacuation routes are integral to disaster preparedness and the safety of neighbourhoods and not just buildings. Most new high-rises in Kathmandu have narrow access roads.

Since most of the buildings that survived the 2015 disaster were reinforced concrete structures, it fed the misconception that they are safer. But Himalayan seismologists say that if the intensity and duration of the shaking had been just a little higher, many substandard concrete structures would have collapsed.&nbsp;
And that is the final gap: Nepal’s limited expertise and equipment for search and rescue inside collapsed concrete structures. Kathmandu’s high-rises need to be better prepared for the next Big One.
“Structural safety and design were at the front and the centre after the 2015 earthquake, we also revised some building codes but we are back to square one with contractor-driven construction, especially in peri-urban areas,” says Sangeeta Singh, who is also with the National Planning Commission. “We need to monitor construction as much as design.”&nbsp;
Shrestha at NSET agrees there have been improvements in building practices in the past nine years, but adds, “We have both learnt and unlearnt lessons from 2015. The awareness hasn’t yet translated into action on safety.”

The rise of high-rises

Midway along the stretch of the ancient trade route between Tibet and India lies the Kel Tol neighbourhood. The name is derived from the original Koligrām, and it is believed the Koli people, who were originally from Rāmagrām in present-day southern Nepal near the Indian border, settled here. The Koli were the maternal ancestors of none other than the Buddha. Kel Tol is famous for the Buddhist monastic complex of Kanak Chaitya Mahāvihar, featuring the majestic two-tiered gilded temple of the white god Karunāmaya.&nbsp; This elaborately decorated courtyard is a bustling centre of the Vajrayāna sect of Buddhism, practised widely by the indigenous Newā people of Kathmandu Valley. Karunāmaya, also known as Ārya Avalokiteshwor, is defined in great detail in the 1st century CE Buddhist text Sadharmapundarikā where he liberates all sentient beings from suffering. He helps rid the eight external fears metaphorically equated with their equivalent internal states of mind: lions (pride), wild elephants (ignorance), fire (anger), snakes (jealousy), floods (attachment), imprisonment (miserliness), thieves (wrong views) and cannibals (doubt).  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20240418130432_fe370cbee75003cd3eb5dccc7c3b2671630da193b0744db2aeac1bab3ff4a85c.jpg" data-media-id="editor_0" data-image-id="20240418130432_fe370cbee75003cd3eb5dccc7c3b2671630da193b0744db2aeac1bab3ff4a85c" data-rendition-name="original" width="1338" height="2000" loading="lazy" alt="Seto Machhindranath"> </figure>  In the Pancha Rakshyā Sutra, a Buddhist scripture from 200 CE, Ārya Avalokiteshwor was counted among the eight major deities. Followers of the Brāhminical god Shiva worship Ārya Avalokiteshwor as Seto Machhindranāth. For Shaivites, Machhindranāth is the Indian saint who founded the Nāth cult in the 10th century CE. He is the guru of saint Gorakhnāth. During the reign of Yakshya Malla (1428–1482 CE), a beautiful image of Ārya Avalokiteshwor was dug up by a farmer in present-day Jamal, which was then a cultivated area outside the city. The farmer, known as a Jamami (meaning the one from Jamal) took the image home for safekeeping. That night, Ārya Avalokiteshwor appeared in the farmer’s dream and told him that the proper place for him to reside is at the confluence of two rivers. The nearest confluence was at present-day Wongha (Indrachok) and the image was installed in the Kanak Chaitya Mahāvihar complex in Kel Tol near Wongha. This made it easier for city residents to pay homage to Ārya Avalokiteshwor and spread compassion. Soon, the deity came to be revered highly as Jamaleshwor, the one found in Jamal. Eventually, the name got corrupted, as happens often in Nepāl Bhāsā, to Janabahā Dyo. The courtyard where his temple is located is now popularly known as Janabahā.  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20240418130432_5c9b219530e400445ef4e7f64856b43e7cdb756be26d9ed4565c84044c178a7e.jpg" data-media-id="editor_1" data-image-id="20240418130432_5c9b219530e400445ef4e7f64856b43e7cdb756be26d9ed4565c84044c178a7e" data-rendition-name="original" width="2500" height="1668" loading="lazy" alt="Seto Machhindranath"> </figure>  The gilded temple of Janabahā Dyo, first built in the early 16th century CE, is adorned with wooden and metal artefacts that symbolise 108 forms of Ārya Avalokiteshwor. It stands out as the most decorated temple of its kind in Kathmandu. Today, Janabahā is a living heritage site where many ancient customs and rituals are widely practised as per Vajrayāna Buddhist tradition. Devotees throng the Janabahā Dyo shrine for daily worship and to receive Karunāmaya’s blessings. Being the compassionate one, Ārya Avalokiteshwor goes around town every year in his tall wooden chariot to allow sick and physically disabled devotees to pay homage to him from the comfort of their homes. One could say it is a door-to-door visit by the Compassionate One.&nbsp; For the pragmatic minded, the chariot festival is an annual renewal of communal harmony, validation of our ancient mathematical supremacy and demonstration of the need to keep practical skills alive, including the craft of building earthquake resilient houses.  <figure> <img src="https://publisher-publish.s3.eu-central-1.amazonaws.com/pb-nepalitimes/swp/asv65r/media/20240418130432_fc8b234ceca87dee4b99e897a485cef121fb953857fb61492a413fbfcc48360c.jpg" data-media-id="editor_2" data-image-id="20240418130432_fc8b234ceca87dee4b99e897a485cef121fb953857fb61492a413fbfcc48360c" data-rendition-name="original" width="2500" height="1667" loading="lazy" alt="Seto Machhindranath"> </figure>  The Janabahā Dyo chariot is pulled from Jamal, where his image was found by the farmer, through the historic heart of Kathmandu in a gala parade every year. The procession, accompanied by folk music ensembles and revellers, starts on the eighth day of the bright half of the month of Chaitra, and lasts up to a week (ending on Saturday this year). Hundreds of devotees pull the chariot along the streets as a way of expressing their gratitude to lord Karunāmaya for blessing them with compassion and well-being. Purna Ratna Vajrāchārya is an ordained priest who belongs to the clan responsible for taking care of Janabahā Dyo. He has been studying the design and architecture of the chariot for the past 40 years, and overseeing its construction for the past 15. He has learnt that the engineering principles of building the chariot are based on the mathematical system in which Buddhism is taught. For example, 365 pieces of wood are used in the chariot, each representing a day of the year. Each of the four wheels consist of 25 pieces of wood, totalling 100, representing completeness or fulfilment. The height and length of the chariot is 32 arm’s length (hāt in Sanskrit), 14.8m. The number 32 represents the maximum number of auspicious and physical qualities one could possess to be considered an outstanding human being.&nbsp; Says Vajrācharya, “Observing how the chariot is built helps one learn the fundamental pillars of the Buddha’s teachings, and find an easier path to Nirvana.” The structural design of the nearly 15m wooden chariot is not only awe-inspiring but also gravity-defying. It leverages the pliancy of the materials used in its construction -- flexible joints tied with cane soaked in water for several days. But this has been achieved year after year, despite the fact that the devotees who tug wildly at the ropes lassoed to the two front wheels, are most likely in high-spirits (pun intended). Sanjay Manandhar, a US-based technology entrepreneur, recounts how his high school physics teacher from Canada asked his students to go observe the locals build the chariots of Karunāmaya if they were interested in becoming engineers in the future.&nbsp; “That made no sense to me then, but, after all these decades, I now see clearly how the structural design of the chariot, adopted early on by our ancestors is full of earthquake-resilient properties that need to be applied in building houses in an earthquake-prone zone like Nepal,” says Manandhar. A highlight of the chariot festival is that human goddess Kumari makes an appearance at the final destination in Lagan, usually on the third day. For close to four centuries, the construction of the chariot and its operation has proven to be a phenomenal engineering feat, and the people’s faith in divinity means the tradition is alive.&nbsp; The essence of the colourful rituals and the religious beliefs of this ancient chariot festival is now all but lost. The logic, technology and practicality must be brought back to light, as they reflect the high civilisation and wisdom of our ancestors that we can leverage in modern times and into the future. &nbsp; Alok Tuladhar is a culture and heritage documentarian.

Kathmandu’s gravity-defying chariot festival

In the run-up to the third Nepal Investment Summit this weekend, there have been seminars, conferences and workshops where the discourse has revolved around the economy and the investment climate.
The consensus that Nepal needs foreign direct investments (FDI) to grow was repeated, and the familiar litany of reasons about why it has not been able to was discussed.&nbsp;
Policy advocates and regulators have understood that the lack of urgency is compounded by procedural inconsistencies, on top of the already deficient investment environment in the country.
It is a welcome change from what used to be flippantly accepting matters as given. There now seems to be a sense of urgency, with procedural inconsistencies and lack of harmonisation between various Acts and regulations openly discussed.&nbsp;
Government stakeholders also appear more willing to learn and attempt to be part of the solution. Whatever policy changes have been introduced in the past have been piecemeal and address the few rather than the entire industry. This left dual regulatory approaches aimed at similar players.&nbsp;

This time, unlike in the past two Summits, the government seems to be committed to amending 9 Acts, a positive step towards showing commitment to change. However, the deadline to do so during the winter session of Parliament is over. The option mooted has been to have it passed through ordinance, a lesser appealing step; albeit, a positive one moving forward.&nbsp;
To attract FDI in a competitive global market means that Nepal has to demonstrate that it is serious about bringing in investments with a more consultative and collaborative approach with investors. A departure from procedural to a result-oriented focus is needed.&nbsp;
To put issues in perspective, Nepal needs US$20 billion in investments to meet the UN’s Sustainable Development Goals (SDG) targets by 2030. If net-zero decarbonisation targets are to be met by 2045, another US$7 billion will be required annually.&nbsp;
Looking at our investment history and poor government capital expenditure, the gap is long and wide. In fiscal year 2022-23 Nepal booked a lamentable ~$59 million in FDI (equity). Nepal is in fact the lowest market in South Asia for FDI with 0.3% of the regional average.&nbsp;
What is it that we can do to fill the gap?&nbsp;
First, we need to move away from the notion that Nepal only needs large investments. This has proven to be a mistake, and time series data have proven that smaller investments, in aggregate, make a larger impact on economies.&nbsp;

We talk about an ‘enabling environment’ but without the right tools. We place restrictions on interest on debt ceiling (SOFR +5.5), without risk premium adjustments, we do not have an active secondary market for bond trading, nor do we have a yield curve, an integral part of the bond market, which is inhibiting us from tapping into the trillion dollar green bond market.&nbsp;
In order to attract green financing, Nepal needs to develop its bond market. Sovereign risk rating has been mooted and was expected to be operationalised before the Investment Summit.&nbsp;
However, to be rated in an adverse economic environment could further deteriorate investment potential due to a lesser-than-expected rating.&nbsp;
Hedging is another instrument that needs further research on. A commercial bank last year showcased the first risk-hedging mechanism for an investment of $8 million. This can be the beginning to expand on its modality. &nbsp;
Subordinated debt instruments have been introduced, but on a special nod basis, this now needs to be institutionalised as it is the most applicable form of investment after equity in a market that has volatile forex reserves.&nbsp;

Viability Gap Funding has been introduced by multilateral development agencies implemented in solar installations. It is a tool to incentivise the private sector to invest in projects that are not financially lucrative initially, but have potential for profitability in the long run. This needs to be scaled up and replicated in sectors like infrastructure, where returns may not be immediate.
Moving forward, to attract FDI, Nepal needs to tap into the funds that are available for the growth of small and medium enterprises (SMEs) and climate change. Alternative investments such as Private Equity Venture Capital (PEVC) have been around in a structured manner in Nepal for nearly a decade now.
These funds have blended finance components and have attracted climate funding as well. PEVC is a new asset class and can address the issues of penetrating into SME financing by incorporating environment, social and governance issues into their investment process.&nbsp;
SMEs are the backbone of any economy, PEVC comes with the ability not only to scale up the enterprise with risk capital, but with the ability to bring technical knowhow to enhance not only the enterprise but also the entrepreneur.&nbsp;

A differentiator from all other forms of financing available till date in Nepal. Blended finance is a way of de-risking investments, especially in frontier markets. Business Oxygen (BO2) is an example of blended finance with subordinated debt investments of IFC (World Bank Group) taking the lead and Climate Investment Funds along with FCDO as co-investors.&nbsp;
On a larger scale, the 216MW Upper Trisuli 1 is another example of blended finance with IFC, a Korean consortium and local investments. So far, we see that development finance Institutions have been taking the lead in Nepal as their risk appetite is greater than commercial investors and they are eager to help develop the financial markets.&nbsp;
In order to be sustainable, we need to step on this and attract commercial capital from all over the world. To do this there has to be political will to make that pivot.&nbsp;
Instead of being a means to an end, the two previous Investment Summits turned out to be intermittent and cosmetic, providing hardly any results. The third one’s success will depend on how the event will be implemented as a platform for continuous marketing for the country and facilitation for investors in future.&nbsp;
Nepal has outdone many countries in its macro-economic indicators, with sound forex reserves and a stellar history of debt payments to its creditors. This story needs to be propagated along with the drive for change to attract potential investors.
